Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this practical guide to cyber law – the law affecting information and communication technology (ICT) – in Italy covers every aspect of the subject, including intellectual property rights in the ICT sector, relevant competition rules, drafting and negotiating ICT-related contracts, electronic transactions, privacy issues, and computer crime. Lawyers who handle transnational matters will appreciate the detailed explanation of specific characteristics of practice and procedure. Following a general introduction, the book assembles its information and guidance in seven main areas of practice: the regulatory framework of the electronic communications market; software protection, legal protection of databases or chips, and other intellectual property matters; contracts with regard to software licensing and network services, with special attention to case law in this area; rules with regard to electronic evidence, regulation of electronic signatures, electronic banking, and electronic commerce; specific laws and regulations with respect to the liability of network operators and service providers and related product liability; protection of individual persons in the context of the processing of personal data and confidentiality; and the application of substantive criminal law in the area of ICT. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for business and legal professionals alike. Lawyers representing parties with interests in Italy will welcome this very useful guide, and academics and researchers will appreciate its value in the study of comparative law in this relatively new and challenging field.

Book excerpt: We live in a wired society, with computers containing and passing around vital information on both personal and public matters. Keeping this data safe is of paramount concern to all. Yet, not a day seems able to pass without some new threat to our computers. Unfortunately, the march of technology has given us the benefits of computers and electronic tools, while also opening us to unforeseen dangers. Identity theft, electronic spying, and the like are now standard worries. In the effort to defend both personal privacy and crucial databases, computer security has become a key industry. A vast array of companies devoted to defending computers from hackers and viruses have cropped up. Research and academic institutions devote a considerable amount of time and effort to the study of information systems and computer security. Anyone with access to a computer needs to be aware of the developing trends and growth of computer security. To that end, this book presents a comprehensive and carefully selected bibliography of the literature most relevant to understanding computer security. Following the bibliography section, continued access is provided via author, title, and subject indexes. With such a format, this book serves as an important guide and reference tool in the defence of our computerised culture.

Book Synopsis Investigating and Preventing Crime in the Digital Era by : Lorena Bachmaier Winter
Download or read book Investigating and Preventing Crime in the Digital Era written by Lorena Bachmaier Winter and published by Springer Nature. This book was released on 2022-10-07 with total page 230 pages. Available in PDF, EPUB and Kindle. Book excerpt: The aim of this book is to delve into the impact of the Information and Communications Technologies in the criminal prevention and investigation, by addressing the state of the art of different measures and its implementation in different legal systems vis à vis the protection of human rights. Yet this research not only pursues a diagnostic goal but furthermore aims at providing a reconstruction of this problematic area in light of modern, human rights-oriented notion of criminal justice. This broadens the scope of this investigation, which encompasses both unprecedented safeguards to traditional, or anyway widely recognized individual rights and the emergence of new rights, such as the right to informational self-determination, and the right to information technology privacy. The book addresses the problems and potentials in the areas of criminal prevention and criminal investigation, taking into account that due to electronic surveillance and the progress in the use of big data for identifying risks, the borders between preventive and investigative e-measures is not clear-cut.

Book Synopsis Artificial Intelligence, Computational Modelling and Criminal Proceedings by : Serena Quattrocolo
Download or read book Artificial Intelligence, Computational Modelling and Criminal Proceedings written by Serena Quattrocolo and published by Springer Nature. This book was released on 2020-08-27 with total page 230 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book discusses issues relating to the application of AI and computational modelling in criminal proceedings from a European perspective. Part one provides a definition of the topics. Rather than focusing on policing or prevention of crime – largely tackled by recent literature – it explores ways in which AI can affect the investigation and adjudication of crime. There are two main areas of application: the first is evidence gathering, which is addressed in Part two. This section examines how traditional evidentiary law is affected by both new ways of investigation – based on automated processes (often using machine learning) – and new kinds of evidence, automatically generated by AI instruments. Drawing on the comprehensive case law of the European Court of Human Rights, it also presents reflections on the reliability and, ultimately, the admissibility of such evidence. Part three investigates the second application area: judicial decision-making, providing an unbiased review of the meaning, benefits, and possible long-term effects of ‘predictive justice’ in the criminal field. It highlights the prediction of both violent behaviour, or recidivism, and future court decisions, based on precedents. Touching on the foundations of common law and civil law traditions, the book offers insights into the usefulness of ‘prediction’ in criminal proceedings.

Available in PDF, EPUB and Kindle.
Book Synopsis Investigating European Fraud in the EU Member States by : Alessandro Bernardi
Download or read book Investigating European Fraud in the EU Member States written by Alessandro Bernardi and published by Bloomsbury Publishing. This book was released on 2017-07-13 with total page 200 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book offers a detailed overview of the rules regarding criminal investigations into financial-economic criminality in the EU's main legal systems. These rules have become fundamental to the effective protection of the Union's financial interests. It undertakes a comparative study of six national legislatures (Italy, Spain, France, Germany, Poland, the UK) which serve as paradigms of the different judicial systems existing in the Union, in order to offer a complete overview of the different approaches to financial-economic investigation in the EU. The work is further enriched with cross–sectional essays that deal with the more general issues, such as data-protection and the future of investigations in the view of the establishment of the European Public Prosecutor's Office (or EPPO). This provides a wider perspective on the themes considered. The book also examines trans-national issues, providing essential context to the EU's legislative instruments intended to protect the financial interests of the Union.

It permeates our society’s practices, symbols, and shared meanings, and it makes old distinctions, such as the one between online and offline, real and virtual, and material and immaterial, obsolete. It also introduces digitally native objects of research, such as cyber-bullying and digital identities, which have a direct impact on mainstream sociological problems.
