Available in PDF, EPUB and Kindle. Book excerpt: At the start of the Civil War, Dr. William McPheeters was a distinguished physician in St. Louis, conducting unprecedented public-health research, forging new medical standards, and organizing the state's first professional associations. But Missouri was a volatile border state. Under martial law, Union authorities kept close watch on known Confederate sympathizers. McPheeters was followed, arrested, threatened, and finally, in 1862, given an ultimatum: sign an oath of allegiance to the Union or go to federal prison. McPheeters "acted from principle" instead, fleeing by night to Confederate territory. He served as a surgeon under Gen. Sterling Price and his Missouri forces west of the Mississippi River, treating soldiers' diseases, malnutrition, and terrible battle wounds. From almost the moment of his departure, the doctor kept a diary. It was a pocket-size notebook which he made by folding sheets of pale blue writing paper in half and in which he wrote in miniature with his steel pen. It is the first known daily account by a Confederate medical officer in the Trans-Mississippi Department. It also tells his wife's story, which included harassment by Federal military officials, imprisonment in St. Louis, and banishment from Missouri with the couple's two small children. The journal appears here in its complete and original form, exactly as the doctor first wrote it, with the addition of the editors' full annotation and vivid introductions to each section.

Available in PDF, EPUB and Kindle. Book excerpt: 'Two things', wrote Kant, 'fill the mind with ever new and increasing admiration and awe: the starry heavens above and the moral law within'. Many would argue that since Kant's day, the study of the starry heavens has advanced while ethics has stagnated, and in particular that Kant's ethics offers an empty formalism that tells us nothing about how we should live. In Acting on Principle Onora O'Neill shows that Kantian ethics has practical as well as philosophical importance. First published in 1975, the book is regarded as a classic account and defence of the Kantian ethical position. It addresses Kant's account of reasoning about action, in particular his controversial claim that the Categorical Imperative guides action and is basic to ethics and justice. This second edition offers a substantial new introduction and updated bibliography, and will be valuable for a wide readership in Kant studies and those studying ethics.

Available in PDF, EPUB and Kindle. Book excerpt: Seeking what he describes as "the utmost limit of the knowledge our natural reason can achieve . . . concerning the True Existence [that is God]," John Duns Scotus (1265–1308) offers in this treatise one of philosophy’s most rigorous and ambitious attempts to deduce God’s existence from purely metaphysical theorems. As elucidated by its concise philosophical commentary, Thomas M. Ward's new translation of the Treatise on the First Principle puts a masterpiece of natural theology within reach of a new generation of English-reading students of philosophy.

Book excerpt: This 1992 volume makes available to a student audience one of the most controversial and misunderstood works published during the last two hundred years. Malthus' Essay on the Principle of Population began life in 1798 as a polite attack on some post-French-revolutionary speculations on the theme of social and human perfectibility. It remains one of the most powerful statements of the limits to human hopes set by the tension between population growth and natural resources. This edition is based on the authoritative variorum of the mature versions of the Essay published over the period 1803 to 1826. The introduction, notes and bibliographic apparatus are aimed specifically at a modern audience interested in how Malthusianism impinges on the history of political thought.

Book excerpt: The right to equal treatment is undoubtedly one of the most fundamental human rights. As such, it can be found in international human rights treaties, in constitutions and in national legislation. In this book the principle of equality is analysed from different angles, bearing in mind the South African and Belgian experiences in this area. Firstly, a general overview is given of the different sources of human rights law in the Belgian and South African legal system, the relation between international and national law, the direct applicability and third party-applicability of rights and freedoms in the legal order(s), and the implementation mechanisms available both in Belgium and South Africa. Secondly, the principle of equality, as found in the Belgian Constitution, in the European Convention on Human Rights and in the South African Constitution, and the South African Antidiscrimination Bill are analyzed. Finally, the principle of equality is being studied from a thematic perspective, i.e. with regard to the use of languages and from a gender perspective. The book is concluded with a contribution on the access to medical and health care in South Africa.

Book excerpt: This collection presents a comparative analysis of the principle of effective legal protection in administrative law in Europe. It examines how European states consider and enforce the related requirements in their domestic administrative law. The book is divided into three parts: the first comprises a theoretical introductory chapter along with perspectives from International and European Law; part two presents 15 individual country reports on the principle of effective legal protection in mostly EU member states. The core function of the reports is to provide an analysis of the domestic instruments and procedures. Adopting a contextual approach, they consider the historical, political and legal circumstances as well as analysing the relevant case law of the domestic courts; the third part provides a comparative analysis of the country reports. The final chapter assesses the influence and relevance of EU law and the ECHR. The book thus identifies the most important trends and makes a valuable contribution to the debate around convergence and divergence in European national administrative systems.
