Additionally, "beneficial forgetting" is discussed, from treatments of individuals to reconciliation between social groups. In Psychoanalysis and Holocaust Testimony, a range of contributors draw upon their own clinical work, and on research findings from work with seriously disturbed Holocaust survivors, to illuminate how best to conduct clinical work with such patients in order to maximise the chances of a positive outcome, and to reflect transferred trauma for the clinician. Psychoanalysis and Holocaust Testimony closely examines the phenomenology of destruction inherent in the discourse of extreme traumatization, focusing on a particular case study: the recording of video testimonies from a group of extremely traumatized, chronically hospitalized Holocaust survivors in psychiatric institutions in Israel. This case study demonstrates how society reacts to unwanted memories, in media, history, and psychoanalysis – but it also shows how psychotherapists and researchers try to approach the buried memories of the survivors, through being receptive to shattered life narratives. Questions of bearing witness, testimony, the role of denial, and the impact of traumatic narrative on society and subsequent generations are explored. A central thread of this book is the unconscious countertransference resistance to the trauma discourse, which manifests itself in arenas that are widely apart, such as genocide denial, the "disappearance" of the hospitalized Holocaust survivors and of their life stories, mishearing their testimonies and ultimately refusing them the diagnosis of "traumatic psychosis". Making the Frontier Man examines early life and the origins of lawless behavior in Pennsylvania, Virginia, Kentucky, and Ohio from 1750 to 1815. It provides a key to understanding why the trans-Appalachian West was prone to violent struggles, especially between white men. Traumatic experiences of the Revolution and the Forty Years War legitimized killing as a means of self-defense—of property, reputation, and rights—transferring power from the county courts to the ordinary citizen. Backcountry men waged war against American Indians in state-sponsored militias as they worked to establish farms and seize property in the West. And white neighbors declared war on each other, often taking extreme measures to resolve petty disputes that ended with infamous family feuds. Making the Frontier Man focuses on these experiences of western expansion and how they influenced American culture and society, specifically the nature of western manhood, which radically transformed in the North American environment. In search of independence and improvement, the new American man was also destitute, frustrated by the economic and political power of his elite counterparts, and undermined by failure. Such trials often involve the testimonies of those who experienced or witnessed extremely traumatic events, which can make it hard for these witnesses to recall specific details. Testifying during trial may in itself also pose challenges to their well-being. Yet the legal process of determining whether someone can be held criminally responsible for the alleged crimes needs to be fair, in accordance with the right to a fair trial of the accused, and the facts need to be determined as accurately as possible. This book argues that to ensure fair and accurate fact-finding when in particular traumatised witnesses testify, a balance needs to be struck between the needs of witnesses who testify about traumatic experiences, the fair trial rights of the accused and the objective of the court to establish as accurately as possible the responsibility of the accused. This is crucial throughout the stages of selecting, preparing, presenting and assessing the testimonial evidence of traumatised witnesses. The methodology involves an analysis of transcripts of proceedings and case law of the International Criminal Tribunal for the former Yugoslavia, the International Criminal Court and Dutch courts prosecuting international crimes. The research demonstrates that it is often difficult to strike a balance between the competing objectives during proceedings when traumatised witnesses testify due to the current lack of regulations and guidelines applicable during investigations and prosecutions. This book shows that this balance can, and should, be achieved when traumatised witnesses testify during criminal proceedings for international crimes.
