For over two decades, Congress has failed to enact legislation that would adequately protect consumers from unsafe dietary supplements. Today, with millions of Americans using dietary supplements, the controversy over how dietary supplements should be regulated continues while enforcement remains stymied.This article focuses on the limitations of the current dietary supplement regulation system regarding consumer safety, primarily due to Congressional inaction. Part II details the evolution of dietary supplement regulation by examining the history of DSHEA, the role of outside influences and politics in dietary supplement regulation, and the FDA's current role in regulating the industry. Part III examines the critical issues with our current system, including safety concerns exacerbated by the lack of authority provided to FDA to effectively regulate dietary supplements, and the issue of political influence thwarting proponents of increased regulation. Finally, Part IV focuses on the future of dietary supplement regulation by examining the need for reform, comparing the United States' current regulation system with the European Union's Food Supplements Directive, recommending proposed modifications to the United States' current system, and considering how these changes might be attained.
