This book was released on 2013-12-03 with total page 126 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Money Advice Service is not currently fit for purpose. The Committee considered whether to recommend that the MAS be scrapped completely but given that the Treasury had already announced its intention to conduct a review of the MAS they granted a stay of execution. They asked the Government to expedite this review and recommended that it should be independent, rather than led by the Treasury. The review must assess whether the MAS should continue to exist and, if so, how it can overcome the serious problems discussed. The current management of the MAS should also explain how they are going to act on the concerns identified. The independent review should seek to answer the following questions: Should the Money Advice Service-or something like it-exist as a statutory organisation? If so, what should the role and strategy of such a body be? Should it be a co-ordinator, commissioner or direct provider of advice? What channels should it use? If not, should the FCA take responsibility for the objectives of the Service? Does the FCA need greater statutory powers to hold the Money Advice Service to account? What are the views of other bodies in this sector about the way in which the Money Advice Service is now engaging with them? To what extent does the work of the Money Advice Service unnecessarily duplicate existing provision? What should the role of the Service be in each of the areas in which it operates? Is the remuneration of the Service's senior staff set at an appropriate level?

Available in PDF, EPUB and Kindle. Book excerpt: This document accompanies the introduction into Parliament of the Financial Services Bill (HC Bill 278, session 2010-12, ISBN 9780215039545 and Explanatory notes Bill 278-EN, ISBN 9780215039132) and explains the Government's final proposals to reform the failed system of financial services regulation. These proposals follow on from extensive consultation, and a draft of the Bill was subject to pre-legislative scrutiny by a Joint Committee (report published as HL Paper 236/HC 1447, ISBN 9780108474064). This document details the main changes the Government is making to the Bill. Chapters cover: Bank of England and Financial Policy Committee; Prudential Regulation Authority; Financial Conduct Authority; regulatory processes and coordination; European and international regulation. Annexes include the Government's responses to the Joint Committee and to the Treasury Committee's inquiries into financial services regulation. The core proposals are: to establish a strong and expert macro-prudential authority, the Financial Policy Committee within the Bank of England to monitor and respond to systemic risks; to transfer responsibility for micro-prudential management of firms that manage complex risks on their balance sheets to a focused new regulator, the Prudential Regulatory Authority; and to provide for a focused new conduct of business regulator, the Financial Conduct Authority, to ensure that business across financial services and markets is conducted in a way that advances the interests of all users and participants. In any future crisis it will be clear that the Chancellor of the Exchequer is in charge. Regulation of consumer credit will be brought within the remit of the Financial Conduct Authority.
Book Synopsis The Future of Financial Regulation by : Iain G MacNeil
Download or read book The Future of Financial Regulation written by Iain G MacNeil and published by Bloomsbury Publishing. This book was released on 2010-03-12 with total page 484 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Future of Financial Regulation is an edited collection of papers presented at a major conference at the University of Glasgow in spring 2009, co-sponsored by the Economic and Social Research Council World Economy and Finance Programme and the the Australian Research Council Governance Research Network. It draws together a variety of different perspectives on the international financial crisis which began in August 2007 and later turned into a more widespread economic crisis following the collapse of Lehman Brothers in the autumn of 2008. Spring 2009 was in many respects the nadir since valuations in financial markets had reached their low point and crisis management rather than regulatory reform was the main focus of attention. The conference and book were deliberately framed as an attempt to re-focus attention from the former to the latter. The first part of the book focuses on the context of the crisis, discussing the general characteristics of financial crises and the specific influences that were at work this time round. The second part focuses more specifically on regulatory techniques and practices implicated in the crisis, noting in particular an over-reliance on the capacity of regulators and financial institutions to manage risk and on the capacity of markets to self-correct. The third part focuses on the role of governance and ethics in the crisis and in particular the need for a common ethical framework to underpin governance practices and to provide greater clarity in the design of accountability mechanisms. The final part focuses on the trajectory of regulatory reform, noting the considerable potential for change as a result of the role of the state in the rescue and recuperation of the financial system and stressing the need for fundamental re-appraisal of business and regulatory models.

Book Synopsis Financial stability and transparency by : Great Britain: Parliament: House of Commons: Treasury Committee
Download or read book Financial stability and transparency written by Great Britain: Parliament: House of Commons: Treasury Committee and published by The Stationery Office. This book was released on 2008-03-03 with total page 96 pages. Available in PDF, EPUB and Kindle. Book excerpt: The period since early August 2007 has been one of large-scale turbulence and instability in global financial markets. This report examines the causes of the dislocation of international financial markets, subsequent developments in global financial markets and lessons learnt, as well as the prospects for international action and other developments to promote financial stability and transparency. The unfolding crisis of confidence is important given the particular impact on the United Kingdom through the run on the Northern Rock Bank. The report deals with: changes in financial markets; events leading to the closure of the credit markets; events since August 2007; international action; securitisation markets; credit rating agencies; off-balance sheet vehicles; and heeding the warnings. This last chapter finds that warnings from the Bank of England and the Financial Services Authority on the deteriorating financial situation in 2007 were not taken on board by some banks and building societies.

This book was released on 2012-01-13 with total page 168 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Treasury Committee report into the Financial Conduct Authority (FCA) contains a number of recommendations for the Government's consideration ahead of the drafting and publication of the Financial Services Bill early in 2012. Among the recommendations are: (a) that the Government should legislate to give the FCA a primary objective to promote effective competition for the benefit of the consumer (in line with the thinking of the Independent Commission on Banking and the Office of Fair Trading); (b) the Government must put competition at the heart of the new regulatory framework; (c) that the FCA develops far more reliable estimates, in collaboration with the industry, of its own cost effectiveness; (d) that the Government differentiates between retail and wholesale consumers; (e) that both the FCA and the financial services industry make better efforts to communicate with each other; (f) that the current legislative proposals be revised to ensure that the FCA is properly accountable to Parliament and that tools are available to enable the required level of explanation from the regulator.

Book Synopsis European Financial Services Regulation by : Great Britain: Parliament: House of Commons: Treasury Committee
Download or read book European Financial Services Regulation written by Great Britain: Parliament: House of Commons: Treasury Committee and published by The Stationery Office. This book was released on 2006-06-08 with total page 148 pages. Available in PDF, EPUB and Kindle. Book excerpt: The EU's ambitious Financial Services Action Plan, started in 1999, is drawing to an end. A single market in wholesale financial services exists. Many retail financial services institutions are expanding through acquisitions of banks and insurers across Europe, though the prospect of a single market in such services, with comparable products and services available to consumers direct across borders, is not a realistic proposition in the near future. The Commission has set out its policy objectives for 2005-2010, attaching greater importance to consistent and workable implementation of existing legislation. The Committee welcomes this, and the commitment to ensure that any new regulation will have a clear benefit to the European economy. The Committee examined three specific case studies: implementation of the Markets in Financial Instruments Directive (MiFID), the consideration of a Clearing and Settlement Directive, and consideration of mortgage credit in the context of the development of a single market in retail financial services. In all the Commission will need to demonstrate its commitment to "better regulation", and its new focus on implementation and enforcement. The Committee is concerned that MiFID will not be implemented consistently across Europe. It finds that the case for a new mortgage directive remains unproven, and that there is a clear need to reduce the additional costs associated with clearing and settlement across borders.

Book Synopsis Draft Financial Services Bill by : Great Britain: Parliament: Joint Committee on the Draft Financial Services Bill
Download or read book Draft Financial Services Bill written by Great Britain: Parliament: Joint Committee on the Draft Financial Services Bill and published by The Stationery Office. This book was released on 2011-12-19 with total page 136 pages. Available in PDF, EPUB and Kindle. Book excerpt: In autumn 2008, Britain's banking system came perilously close to collapse. To avert catastrophe, the Government was forced to step in with multi-billion pound bailouts. Many factors led to this crisis including failings in financial supervision and fuzzy allocation of responsibilities for preventing and managing systemic crises. The draft Financial Services Bill (printed as chapter 5 of 'A new approach to financial regulation: the blueprint for reform' (Cm. 8083, June 2011, 9780101808323) is aimed at preventing such a potentially calamitous systemic failure of the financial sector occurring again. It proposes far reaching changes to the regulatory structure, replacing the tripartite system of financial regulation with a twin peaks model. The Joint Committee's recommendations are intended to ensure that the new regulatory authorities have the right objectives, powers and responsibilities and systems of accountability which will be essential to make them effective.
Book Synopsis Capital Markets Law and Compliance by : Paul Nelson
Download or read book Capital Markets Law and Compliance written by Paul Nelson and published by Cambridge University Press. This book was released on 2008-01-10 with total page 19 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Markets in Financial Instruments Directive (MiFID) is a detailed re-writing of the regulation of capital markets. To the extent those rules permit, the Financial Services Authority (FSA) is also introducing high-level 'principles-based regulation'. In response to this, Paul Nelson presents practical guidance on the regulation of the capital markets, ranging from new issues and IPOs to investment banking, broker-dealing and asset management. All laws and rules relevant to the regulation of the capital markets are explained and put into context within the economic operation of markets, institutions and products, the European Single Market, the FSA's policies and objectives, the historical evolution of the regulations and the general civil and criminal law. Drawing on 30 years' experience as a practitioner, and referring to a vast range of supporting materials, the author provides an insightful analysis and critique of the rules, the rule makers and the institutions.
