Many of its members were recruited in Cobb, Troup, Taylor, and Heard counties. The unit moved to North Mississippi, sustained heavy casualties in Kentucky at Perryville, then returned to Mississippi. Here it was assigned to General Barton's Brigade in the Department of Mississippi and East Louisiana, fought in the battles around Vicksburg, and was captured on July 4, 1863. After being exchanged and assigned to General Stovall's Brigade, the 41st participated in the operations of the Army of Tennessee from Chattanooga to Nashville, and fought its last battle at Bentonville. The 41st contained 269 men and 218 arms in December, 1863, and totaled 197 effectives in November, 1864. It was consolidated with the Fortieth and Forty-third Georgia and participated in the campaign of the Carolinas and in General Johnston's surrender on April 26, 1865. It fought in many conflicts from the Seven Days' Battles to Cold Harbor, then moved with Early to the Shenandoah Valley and was active around Appomattox. The unit lost 54 killed and 118 wounded at Gaines' Mill and sixty-two percent of the 123 engaged at Sharpsburg. In the fight at Fredericksburg there were 10 killed and 91 wounded, and of the 341 at Gettysburg, more than thirty-five percent were disabled. It surrendered with 112, of which 73 were armed.

Book excerpt: The Georgia 40th Infantry Regiment was organized during the fall of 1861 and raised its companies in Bartow, Floyd, Calhoun, Gordon, Whitfield, Paulding, and Haralson counties. They assembled at Camp McDonald near Big Shanty (Kennesaw), GA. They were brigaded with the 41st, 42nd, 43rd, and 52nd Georgia regiments. The 40th was first sent to Tennessee, then Mississippi, and was placed in Barton's Brigade, Department of Mississippi, and East Louisiana. The 40th participated in the conflicts at Chickasaw Bayou and Champion's Hill and were part of the garrison surrendered at Vicksburg on July 4, 1863. Col. Johnson was wounded in this conflict. After being exchanged the 40th was attached to General Stovall's Brigade, Army of Tennessee. Gen. Stovall's brigade consisted of the 40th., 41st., 42nd., 43rd., & 52nd. Ga. Regiments and the 1st. Georgia State Line Troops. The 40th served on many battlefields from Chattanooga to Nashville, and ended the war in North Carolina. Several of the companies of this regiment were from Bartow, Paulding, and Floyd counties and ended up fighting on their own farms and in their own homes as Sherman ransacked his way across north Georgia in the spring and summer of 1864. During this time they lost 174 men, yet still mustered 74 men to accompany the army into Tennessee and North Carolina. The 40th reported 36 casualties at Chattanooga, totaled 223 men and 105 arms in December, 1863, and had 74 effectives in November, 1864. It surrendered on April 26, 1865. Only a handful remained to return to northwest Georgia to find their families scattered and their farms totally destroyed. Several once prosperous towns including Cassville, Etowah, Stilesboro, Taylorsville, and Kingston have never recovered. The regiment reported 7 casualties at New Hope Church, 30 at Kennesaw Mountain, 5 at the Chattahoochee River, and 48 in the Battle of Atlanta. Few surrendered with the Department of Alabama, Mississippi, and East Louisiana.

In his ongoing attempt to maintain a body of troops under Georgia command, Brown then organized the Georgia State Guards and the Georgia State Reserves, both commanded by Major Gen. Howell Cobb. The State Guards were short-lived had been disbanded by early 1864 due to pressure from the CS government and changes in the conscription law. Shortly after disbanding the Guards, Gov. Brown and Gen. The unit was officially mustered into Confederate service on August 24, 1861. Soon after being mustered into Confederate service the regiment was moved to Lynchburg, Virginia. Within a week of arriving there, however, it was ordered to Goldsborough, North Carolina. There it joined the Department of North Carolina. The unit remained there until early in 1862. After serving in the Department of North Carolina, the unit moved to Virginia where it was brigaded under Generals H. Cobb, T. R. R. Cobb, Wofford, and DuBose. It fought in the difficult campaigns of the Army of Northern Virginia from the Seven Days' Battles to Gettysburg, then moved to Georgia with Longstreet. The 24th was not engaged at Chickamauga, but did see action in the Knoxville Campaign. Returning to Virginia, Col. McMillan resigned on January 9, 1864. Lieutenant Colonel Christopher Columbus Sanders assumed command and continued until his capture at Saylor's Creek. Upon its arrival in western Virginia, the regiment was assigned to H. R. Jackson's command and participated in Lee's Cheat Mountain campaign. As part of the famous Doles /Cook brigade from central and south Georgia they participated in Stonewall Jackson's Valley campaign, then fought with the Army of Northern Virginia from Seven Days to Cold Harbor. The 12th later took part in Early's Shenandoah Valley operations and the Appomattox campaign. An excellent first hand account of the Doles Cook Brigade was published by Henry W. Thomas of Company G of the 12th Georgia. From the introduction: "No brigade in the Confederate army did more service, or suffered more hardships, and none can boast of a prouder or more brilliant record than that made by the Doles-Cook Brigade. Its regiments were amongst the first to take arms in defense of the South, and did not lay them down until General Robert E. Lee surrendered the army of Northern Virginia at Appomattox Court-house, Virginia on the 9th day of April, 1865. On that fatal day the remnant of the Doles-Cook Brigade followed the Stars and Bars as gallantly, fought as bravely, and drove the enemy as steadily as they had done in the past. Not until then did they cease to bear arms in defense of the South. Read the history of all the armies of any nation, and you will not find a single one to compare to that of the Confederate army. They were intelligent, brave fearless and determined, but kind and gentlemanly in their bearings, respectful of their officers and obedient to orders. They did not fight for conquest or glory, but simply for the protection of their homes and the independence of the South. However, the consolidation was declared illegal and during April, 1863, it was reorganized as the 51st and 52nd Consolidated Regiment and each unit kept separate records. It participated in many battles of the Army of Tennessee from Murfreesboro to Atlanta, returned to Tennessee with Hood, and was involved in the North Carolina Campaign.

Most of the units' members had seen pre-War militia service. The regiment was mustered in at Camp Bartow, Howard's Grove, Richmond, Virginia in June of 1861. Francis S. Bartow was its first commander. Bartow was killed at First Manassas. Bartow and Gen. Bernard Bee were struggling to hold their ground and many Confederate troops were withdrawing when Jackson and his brigade came up. In the midst of a fierce battle, Bee is reported to have said: "There stands Jackson like a stone wall! Rally behind the Virginians!" The remark has been taken as a tribute to Jackson for standing firm in the face of superior Federal forces, a courageous example and rallying point for Bee, Bartow, and the men of the 8th. Tragically for Bee and Bartow, both were soon killed. Bartow took a bullet in the heart after having one horse shot from under him and receiving a minor wound; Bee was mortally wounded, dying a short time after he was shot. Bartow and Bee became the second and third Confederate generals to be killed in the war, The 8th Georgia continued throughout the war in Virginia except when they accompanied Longstreet to Tennessee, participating in Chickamauga, Chattanooga, and Knoxville. They surrendered at Appomattox.
