Book excerpt: At a hearing in Honolulu (Hawaii), the Subcommittee on Labor, Health and Human Services, Education and Related Agencies of the U.S. Senate Committee on Appropriations received testimony on health, education, and employment and training programs serving the Native people of Hawaii. In July 1999, a federal government brief filed in a U.S. Supreme Court case established the official legal position of the United States that Native Hawaiians have the same status as other Native people of the United States and that there is a federal trust responsibility for Native Hawaiians. Testimony from state-level administrators outlined the current status of health, housing, education, and job training for Native Hawaiians and proposed recommendations for pending federal legislation: the Native American Housing Assistance and Self-Determination Amendments of 1999, the Native Hawaiian Health Care Improvement Act, and the Native Hawaiian Education Act. Other testimony described Native Hawaiian health care systems, the Native Hawaiian heart health initiative, the Native Hawaiian Cancer Awareness Research and Training Center, the Hawaii high schools health study, the Native Hawaiian Health Scholarship Program, the practice of naturopathic medicine with Native Hawaiians, the Native Hawaiian Higher Education Program and its outcomes and impacts, programs focused on Hawaiian language and cultural maintenance, family-based early childhood education programs, the Native Hawaiian Center of Excellence (to improve the health of indigenous Hawaiians), comprehensive school-based services, and the Native Hawaiian Special Education Project. P4P programs have become widespread in health care in just the past decade and have generated a great deal of enthusiasm in health policy circles and among legislators, despite limited evidence of their effectiveness. On a positive note, this movement has developed and tested many new types of health care payment systems and has stimulated much new thinking about how to improve quality of care and reduce the costs of health care. The current interest in P4P echoes earlier enthusiasms in health policy—such as those for capitation and managed care in the 1990s—that failed to live up to their early promise. The fate of P4P is not yet certain, but we can learn a number of lessons from experiences with P4P to date, and ways to improve the designs of P4P programs are becoming apparent. We anticipate that a “second generation” of P4P programs can now be developed that can have greater impact and be better integrated with other interventions to improve the quality of care and reduce costs.

The OSHAct of 1970 is the worker protection safety and health act that encourages the States to develop and enforce their own worker protection laws. The States must be “as effective as” the OSHA administration and enforcement program. The Act required that States develop their own experimental and demonstrative programs to protect workers. However, the OSHA interpretation of “as effective as” means that the States must “do the same as” OSHA. In 2015 OSHA penalties increased and the States were required to adopt the same. The penalty increase resulted in higher performance measures or quotas used to compare the States with OSHA. This means compliance officers focus on keeping the penalties in accordance with national statistics. Efforts to reduce or eliminate workplace hazards are diminished with the higher penalties and unfair processes.

Book excerpt: A Senate committee hearing received testimony about high dropout rates and other problems at seven off-reservation boarding schools operated by the Bureau of Indian Affairs (BIA) or by tribal groups under BIA contract. The schools are Pierre Indian Learning Center (South Dakota), Sequoyah Indian High School (Oklahoma), Wahpeton Indian School (North Dakota), Chemawa Indian School (Oregon), Flandreau Indian School (South Dakota), Riverside Indian School (Oklahoma), and Sherman Indian High School (California). Together, these seven schools enrolled 2,623 students at the start of the 1993-94 school year, but had only 1,557 students in attendance at the end of the year. In addition, persons associated with the schools had expressed concern that inadequate funding made it impossible for the schools to deal with rising numbers of court referred students and students with serious social and emotional problems. Testimony from BIA and Indian Health Service administrators, school administrators and board members, tribal leaders, and students discussed the feasibility of the therapeutic community school model, whether the model can be developed for implementation in off-reservation boarding schools, per-pupil funding at the seven schools compared to funding at comparable state residential institutions, needs for psychiatric and other mental health services, substance abuse, parent participation, school monitoring and evaluation procedures, and inadequate dormitories. An appendix of additional materials includes school mission statements, descriptions of service delivery models, a review of the Indian School Equalization Program (ISEP) suggesting that ISEP funding is inadequate, investigations of student criminal activities, profiles of student needs and problems, concept papers on the development of alternative schools, data on academic achievement and mental health indicators, federal boarding school evaluations, research reports on student tobacco use, and a summary of identified school strengths and needs based on correlates of effective schools.
