Book Synopsis Deepening the EU’s Single Market for Services by : Mr.Christian H Ebeke
Download or read book Deepening the EU’s Single Market for Services written by Mr.Christian H Ebeke and published by International Monetary Fund. This book was released on 2019-12-06 with total page 21 pages. Available in PDF, EPUB and Kindle. Book excerpt: The services sector is increasingly important for the euro area economy, but productivity growth in the sector has stalled over the past two decades. Remaining barriers to cross-border trade in services within the EU Single Market contribute to this weak performance. Our empirical analysis suggests that slow progress in tackling these barriers is associated with political economy factors such as weak government support in parliaments, low government efficiency and high markups. To remove the cross-border restrictions on services trade, we suggest combining incentives such as financial support, technical assistance and improved communication on barriers with more effective enforcement.

Book excerpt: In March 2005, the European Commission issued a Communication designed to improve the EU regulatory environment in order to promote competition and trade and facilitate job creation. The Committee's report examines the proposals for better regulation, including the 'regulation tools' of impact assessment, simplification and consultation, the position of small and medium-sized enterprises (SMEs), the case for a new regulatory body to oversee regulation in the EU, the Inter-Institutional Agreement on Better Law-making and the role of Member States, the ambitions and activities of the UK presidency of the EU in this area. The Committee welcomes the initiatives and the attitudinal change that seems to be filtering through the Commission but highlights the need for full implementation and assessment; and also calls on the UK Government to ensure the issue is placed at the top of the EU political agenda.

Book Synopsis Remedies Concerning Enforcement of Foreign Judgements by : Vesna Rijavec
Download or read book Remedies Concerning Enforcement of Foreign Judgements written by Vesna Rijavec and published by Kluwer Law International B.V.. This book was released on 2018-09-14 with total page 387 pages. Available in PDF, EPUB and Kindle. Book excerpt: Brussels I Recast (Regulation No 1215/2012 on the recognition and enforcement of judgments in civil and commercial matters) is intended to simplify and expedite cross-border enforcement of debts. However, some existing issues remain unresolved, and new ones have already been identi?ed since the Regulation entered into force in 2015. This collection of expert essays, the ?rst book to focus systematically and comprehensively on the area of remedies in the light of Brussels I Recast, offers detailed analyses of inherent problems and includes practical hypothetical cases illustrating major issues and how they may be resolved. The aspects covered by the contributors – all well-known academics, lawyers, and judges from different EU Member States – include the following: – grounds for refusal of recognition and enforcement; – certi?cation of enforceability and timely service of the certi?cate; – adaptation of enforcement measures that are determined in the judgment but are not known in the Member State of enforcement; – effect of requesting a translation of the judgment; – ?nancial implications of remedies; and – provisional measures and their role in a timely protection of rights. Because the success of Brussels I Recast depends on a very unpredictable implementation into national systems, the extent to which national barriers represent obstacles to fair and ef?cient judicial protection is thoroughly examined. A very useful concluding chapter presents practical cases highlighting the most important, as well as problematic, issues concerning enforcement of foreign judgments. The in-depth analyses conducted by the contributors clearly de?ne serious obstacles and propose solutions that will lead to better implementation of Brussels I Recast, better protection of party's rights, and further harmonisation in this ?eld of civil justice. This book is sure to be of exceptional value to counsel for multinational enterprises, EU and Member State legislators, enforcement agencies, and academics worldwide.
Book Synopsis Telecommunications Policy-making in the European Union by : Joseph W. Goodman
Download or read book Telecommunications Policy-making in the European Union written by Joseph W. Goodman and published by Edward Elgar Publishing. This book was released on 2006-01-01 with total page 318 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book offers a good study of the development of telecommunications policy by the EU. . . Great value to those interested in understanding both European telecommunications policy and more generally in how policy-making operates in the EU. Mark Thatcher, West European Politics . . . the book provides an interesting perspective on the evolution of nature of telecommunications policy-making within the EU. As a consequence, the book should be of interest to telecommunications and politics/government researchers alike, Jason Whalley, Communications Booknotes Quarterly This well-written book deals with the emergence and shaping of telecommunications policy in Europe, with a particular focus on the time period of 1987 1998. . . This book fills an important gap reviewing the initial formative years of European telecommunications policy development and liberalization in detail. The book captures the complicated and interdependent policy formation process in Europe in a credible and thoughtful way, without falling into the trap of admiring critical personalities and key actors. . . The author has written an important and useful book, which invites the research community to further explore the evolution of European telecommunications policy. Erik Bohlin, Communications & Strategies Examining the emergence of a European Union telecommunications policy, Joseph Goodman explains how and why the policy developed as it did and why certain reforms in the sector were easier to achieve than others. He provides a history of the key actors in the policy-making process from the first attempts by the national postal, telegraph, and telecommunication administrations to coordinate their telecommunications policies in the 1950s, to the implementation of a comprehensive EU telecommunications regulatory structure in 1998 and the development of a new regulatory structure in 2003. The analytical framework employed by the author draws upon new institutionalism and actor-based approaches, providing an opportunity to evaluate the utility of a synthetic approach for examining and explaining EU policy-making. The focus of his analysis is on the European Commission s two-pronged strategy of liberalisation and harmonisation, which began in the late 1980s and culminated in an important milestone on January 1st 1998, when the EU Member States fully opened their telecommunications markets to competition. He concludes that a synthetic approach, which enables the researcher to apply a number of approaches to multiple settings and various levels of analysis, is useful even necessary in understanding and explaining the many dimensions of EU policy-making. This authoritative study will be of interest to all those in the telecommunications industry including attorneys, consultants, and lobbyists who would like to know how the EU s policy developed. It will appeal, more generally, to political scientists and scholars of European history and politics.

Book Synopsis Impact assessments in the EU by : Great Britain: Parliament: House of Lords: European Union Committee
Download or read book Impact assessments in the EU written by Great Britain: Parliament: House of Lords: European Union Committee and published by The Stationery Office. This book was released on 2010-03-09 with total page 104 pages. Available in PDF, EPUB and Kindle. Book excerpt: This inquiry was launched in summer 2009 in order to investigate the progress of the EU Better Regulation agenda. The agenda has been running since 2005 with the aim of cutting red tape, reducing administrative burdens and improving the legislative process by means of impact assessment. In January 2009, new Impact Assessment Guidelines were issued, which, among other things, introduced the inclusion of an "SME test", that is, an assessment of the particular impact any likely legislation would have on small businesses, to the standard Commission impact assessment. This report focuses to a large extent on the impact assessment process, in particular how IAs are produced, the role of the Impact Assessment Board in monitoring their quality, and their subsequent use by the European Institutions. The intention of this report is to take the views of various stakeholders in EU better regulation and to suggest areas where further examination might be necessary. It does seem to be the case that the Council of Ministers and the European Parliament are not making as full use of impact assessments as they might. Certain other areas have been highlighted where the situation is unclear and further investigation might be warranted. These include the conformity of IAs to the Guidelines, the production and use of IAs on comitology proposals, the adequacy of consultation exercises in the preparation of assessments, whether the SME test is working and the use of ex-post evaluation
