Book excerpt: Foundations of Law is designed to help law and pre-law students make sense of law in a changeful age. It is founded upon the conviction of the English jurist William Blackstone that students who intend to study law need both technical instruction in law and liberal education in the history and jurisprudential concepts of law. The book considers the enduring nature of law and its relationship to equity and justice with the assistance of the authors of what we today call the Great Books. It also emphasizes enduring aspects of legal practice: the role of logic; the meaning and importance of conscience and of due process; different approaches to textual interpretation; and the relation of law to other normative concepts (such as morality and religion) and to science (such as economics). The book surveys classic writings concerning law and justice--for example, the works of Sophocles, Plato, Aristotle, and Aquinas. It contains writings that are foundational to Anglo-American legal norms and institutions--Blackstone, Bentham, Locke, the Federalists, Lincoln, Holmes, and others. It includes helpful analytical insights from influential jurisprudence scholars--Austin, Hart, Hohfeld, Dworkin, and Finnis, among others. Most uniquely, it matches each of those writings with constitutions, declarations, statutes, judicial decisions, and other legal and political texts (even a letter from jail) that illustrate and reinforce the key lessons drawn from the great works. The book does not leave students adrift in abstractions. It provides a solid grounding for understanding and practicing law in a rapidly-changing world. Combines technical instruction in law with liberal education in the history and jurisprudential concepts of law. Provides a solid grounding in the enduring characteristics of law to enable students to understand and practice law in a rapidly-changing world. Surveys the great books concerning law, equity, and justice. Uniquely matches each great book excerpt with judicial decisions, statutes, proclamations, and other legal materials to illustrate how foundational concepts recur in contemporary legal norms and institutions and to illustrate and reinforce the key lessons drawn from the great works. Emphasizes enduring aspects of legal practice: the role of logic; the meaning and importance of conscience and of due process; different approaches to textual interpretation; and the relation of law to other normative concepts (such as morality and religion) and to science (such as economics). Opens each chapter with reading questions to assist beginning students. Follows readings with notes to direct more advanced students to additional reading and further lines of inquiry.

Book excerpt: The second edition of this leading reference work provides a comprehensive discussion of the dynamic and important field of international law concerned with environmental protection. It is edited by globally-recognised international environmental law scholars, Professor Lavanya Rajamani and Professor Jacqueline Peel, and features 67 chapters authored by 76 renowned experts in their fields. The Handbook discusses the key principles underpinning international environmental law, its relevant actors and tools, and rules applying in its substantive sub-fields such as climate law, oceans law, wildlife and biodiversity law, and hazardous substances regulation. It also explores the intersection of international environmental law with other areas of international law, such as those concerned with trade, investment, disaster, migration, armed conflict, intellectual property, energy, and human rights. The Handbook sets its discussion of international environmental law in the broader interdisciplinary context of developments in science, ethics, politics and economics, which inform the way in which environmental rules are made, implemented, and enforced. It provides an introduction to the foundations of international environmental law while also engaging with questions at the frontiers of research, teaching, and practice in the field, including the role of Global South perspectives, the contribution made by Earth jurisprudence, and the growing role of a diverse range of actors from indigenous peoples to business and industry. Like the first edition, this second edition of the Handbook is an essential reference text for all engaged with environmental issues at the international level and the applicable governance and regulatory structures.

Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook of Fiduciary Law provides a comprehensive overview of critical topics in fiduciary law and theory through chapters authored by leading scholars. The Handbook opens with surveys of the many fields of law in which fiduciary duties arise, including agency law, trust law, corporate law, pension law, bankruptcy law, family law, employment law, legal representation, health care, and international law. Drawing on these surveys, the Handbook offers a synthetic analysis of fiduciary law's key concepts and principles. Chapters in the Handbook explore the defining features of fiduciary relationships, clarify the distinctive fiduciary duties that arise in these relationships, and identify the remedies available for breach of fiduciary duties. The volume also provides numerous comparative perspectives on fiduciary law from eminent legal historians and from scholars with deep expertise in a diverse array of the world's legal systems. Finally, the Handbook lays the groundwork for future research on fiduciary law and theory by highlighting cross-cutting themes, identifying persistent theoretical and practical challenges, and exploring how the field could be enriched through empirical analysis and interdisciplinary insights from economics, philosophy, and psychology. Unparalleled in its breadth and depth of coverage, The Oxford Handbook of Fiduciary Law represents an invaluable resource for practitioners, policymakers, scholars, and students in this essential field of law.

Book excerpt: Excerpt from The Distinctions and Anomalies, Arising Out of the Equitable Doctrine of the Legal Estate The endeavour at the same time made to deal with the matter upon principle, and more especially to find an intel ligible basis for the doctrines of the priority of the legal estate and tacking, may also be of some practical utility. The ascertainment of principles is of importance as well to the study of the law, as to its successful amendment1 and judicial development. If the explanation of tacking here advanced be the true one, it will appear that there has been in recent times a tendency of the courts to extend in more than one direction that justly reprobated doctrine, which, however, ao cording to the accepted judicial axiom is to be applied only within the bare limits of the old authorities which established it. But if the theories put forward should prove upon further investigation not to be sustainable, they may perhaps claim the merit appertaining to hypotheses in general, that they are necessary steps to something more certain. Perhaps too the statement as a whole of equitable doctrine concerning the legal estate as it now stands - its intricacy, its fortuitous results, its occasional injustice, its technicality and immaturities - may help to make more clear the urgency of the case for the legislative reform of English property law. Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook of Health Economics provides an accessible and authoritative guide to health economics, intended for scholars and students in the field, as well as those in adjacent disciplines including health policy and clinical medicine. The chapters stress the direct impact of health economics reasoning on policy and practice, offering readers an introduction to the potential reach of the discipline. Contributions come from internationally-recognized leaders in health economics and reflect the worldwide reach of the discipline. Authoritative, but non-technical, the chapters place great emphasis on the connections between theory and policy-making, and develop the contributions of health economics to problems arising in a variety of institutional contexts, from primary care to the operations of health insurers. The volume addresses policy concerns relevant to health systems in both developed and developing countries. It takes a broad perspective, with relevance to systems with single or multi-payer health insurance arrangements, and to those relying predominantly on user charges; contributions are also included that focus both on medical care and on non-medical factors that affect health. Each chapter provides a succinct summary of the current state of economic thinking in a given area, as well as the author's unique perspective on issues that remain open to debate. The volume presents a view of health economics as a vibrant and continually advancing field, highlighting ongoing challenges and pointing to new directions for further progress.

Available in PDF, EPUB and Kindle. Book excerpt: Distributional cost-effectiveness analysis aims to help healthcare and public health organizations make fairer decisions with better outcomes. It can provide information about equity in the distribution of costs and effects - who gains, who loses, and by how much - and the trade-offs that sometimes occur between equity and efficiency. This is a practical guide to methods for quantifying the equity impacts of health programmes in high, middle, and low-income countries. The methods can be tailored to analyse different equity concerns in different decision making contexts. The handbook provides both hands-on training for postgraduate students and analysts and an accessible guide for academics, practitioners, managers, policymakers, and stakeholders. Part I is an introduction and overview for research commissioners, users, and producers. Parts II and III provide step-by-step guidance on how to simulate and evaluate distributions, with accompanying spreadsheet training exercises. Part IV concludes with discussions about how to handle uncertainty about facts and disagreement about values, and the future challenges facing this growing field. Book jacket.
