Available in PDF, EPUB and Kindle. Book excerpt: What happens to your teaching business when students don't pay or don't pay on time? There aren't any rules unless you put them into place yourself. Set the rules at the first meeting because a freelance teacher's income is jeopardised when they are not paid on time, and their bills cannot be paid. And that is why you should always set payment rules from the outset. A regular income - a steady cash flow - keeps your teaching business alive. Remember, 80 per cent of businesses fail because they run out of money. Make sure you have a teaching service contract detailing your payment policies: when students are expected to pay and what happens when payment is late when customers sit before you. Teaching service contracts secure a legally sound footing for freelancers when making payment claims. It is their only legal and binding proof a teaching payment agreement exists between them and their students. In fact, should their relationship with one of their student turn sour, and they need a lawyer, the first thing they will be asked is: Do you have a contract? Contracts are simple reality checks to decide whether freelancers can work with a customer. If both sides respect the contract, they can work together. A lawyer is the best person to guarantee a contract is made correctly. On the other hand, they are expensive. For most teaching freelancers, a lawyer is a luxury they cannot afford - so a self-made contract must suffice. A self-made teaching service contract is better than none. If you have never prepared a business contract before, you may be quite daunted by the prospect of creating one. For example: § What details must be written into contracts? § What elements are usually forgotten in agreements (absenteeism, etc.)? § Situations when a lawyer must check the wording in contracts For this purpose, freelancers can use a teaching service agreement example as a basis for creating their own contracts. The contract example presented is for educational

Book excerpt: This clearly written text, which is adapted from its parent volume, Education Law, Fourth edition, provides a concise introduction to topics in education law that are most relevant to teachers. The greater the likelihood of litigation or error in a particular area of professional practice the more extensive the discussion. Topics concerning teacher relationships with their students include: student rights, discipline, negligence, discrimination, and special education. Topics concerning teacher relationships with their employers include: teacher rights, hiring and firing, contracts, unions, collective bargaining, and tenure. All chapters have been updated to include the case law and legislation of the past five years, and the index contains almost 200 more entries than in the third edition. Because it is concise and affordable, A Teacherâe(tm)s Guide to Education Law can be used in a variety of courses or in professional seminars dealing with teachers and the law, including any course within a teacher education program that is devoted solely or partly to the legal issues that concern teachers.

Book excerpt: Drafting and Analyzing Contracts (called Drafting Contracts in its first two editions) is organized around the topics that are studied in the first year Contracts course. The purpose of this book is to apply the principles of contract law to the drafting of agreements. Each chapter discusses the substance of contracts as applied to drafting and suggests language that may be employed to accomplish the purpose. Drafting and Analyzing Contracts uses drafting to: exemplify the principles of contract law illustrate the principles in a planning context develop the skills of a lawyer Part I (How the Principles of Contract Law are Exemplified in Drafting) contains 14 chapters that illuminate the substantive law. For example: Chapter 7 demonstrates the problems that can arise from ambiguity and how to cure them; and Chapter 10 makes clear how drafters can use the concepts to accomplish different goals. Part II (How the Principles of Drafting are Exemplified in Contracts) teaches techniques for contact drafting, including Drafting in Plain Language and Drafting with a Computer. Part II reinforces the substantive law and is particularly useful for classes that teach drafting. New in this edition is Part III (How to Read and Analyze a Contract). Attorneys rely on forms and models and often employ form contracts where there is no opportunity for drafting. Therefore, attorneys must first read a contract before drafting or explaining it to a client. Students who follow the "5 passes" process for reading contracts will develop and deepen their analytical skills. A thorough Teacher's Manual (available only to professors) provides guidance on teaching drafting, commentary on all parts of the book, solutions to all the problems, additional problems, and a bibliography.

Available in PDF, EPUB and Kindle. Book excerpt: This paper reports on a study that systematically analyzes the hundreds of collective-bargaining agreements for school districts in the state of Michigan. It examines collective bargaining's impact on Michigan's public education and makes recommendations that school boards should incorporate into their union contracts to improve their ability to deliver quality education to students. Part I provides a background to collective bargaining in Michigan: its history, the laws that have shaped and are shaping it, especially Public Act 112 of 1994, and the challenges it presents to school board members, parents, taxpayers, teachers, and students. Recommendations to school boards on what to bargain and what not to bargain are also included. Part II analyzes collective-bargaining agreements, obtained using the Freedom of Information Act, from each of Michigan's 583 school districts, identifies 8 key provisions that commonly hinder the educational process, and makes recommendations on how school boards can best improve their ability to provide the best education. Part II also reviews seven court rulings on collective-bargaining agreement issues and advises school districts on how to avoid contract provisions that might expose them to costly legal and financial penalties resulting from employee lawsuits. Employees' workplace rights are also explained, while demonstrating the school district's role in protecting those rights. Appendixes include Health Care Options for School Districts, Select Data from 583 Michigan K-12 Collective Bargaining Agreements, and Michigan School Financial Data. (Contains 122 references.) (DFR)

Available in PDF, EPUB and Kindle. Book excerpt: The Pedagogical Contract explores the relationship between teacher and student and argues for ways of reconceiving pedagogy. It discloses this relationship as one that since antiquity has been regarded as a scene of give-and-take, where the teacher exchanges knowledge for some sort of payment by the student and where pedagogy always runs the risk of becoming a broken contract. The book seeks to liberate teaching and learning from this historical scene and the anxieties that it engenders, arguing that there are alternative ways of conceiving the economy underlying pedagogical activities. Reading ancient material together with contemporary representations of teaching and learning, Yun Lee Too shows that apart from being conceived as a scene of self-interest in which a professional teacher, or sophist, is the charlatan who cheats his pupil, pedagogy might also purport to be a disinterested process of socialization or a scene in which lack and neediness are redeemed through the realization that they are required precisely to stimulate the desire to learn. The author also argues that pedagogy ideally ignores the imperative of the conventional marketplace for relevance, utility, and productivity, inasmuch as teaching and learning most enrich a community when they disregard the immediate material concerns of the community. The book will appeal to all those who understand scholarship as having an important social and/or political role to play; it will also be of interest to literary scholars, literary and cultural theorists, philosophers, historians, legal theorists, feminists, scholars of education, sociologists, and political theorists. Yun Lee Too is Assistant Professor of Classics, Columbia University. She is the author of Rethinking Sexual Harassment; The Rhetoric of Identity in Socrates: Text, Power, Pedagogy; and The Idea of Ancient Literary Criticism, forthcoming; and coeditor, with Niall Livingstone, of Pedagogy and Power: Rhetorics of Classical Learning.

Available in PDF, EPUB and Kindle. Book excerpt: Contract drafting is different from the other types of writing that a new lawyer is faced with. Law school contracts classes rarely consider the issues that arise in sophisticated commercial transactions. A new lawyer is therefore forced to learn by doing and observing -- in high-pressure 'on the job' training. Now there is help. Working with Contracts: What Law School Doesn't Teach You provides the beginning lawyer with an operative understanding of the vocabulary and the building blocks of contracts. It introduces the basic elements of all contracts; describes the lawyer's role in the drafting and negotiating process; discusses amendments, waivers, and consents; and addresses issues that arise in reviewing contracts, including due diligence issues. It also offers sample provisions, drafting checklists, and an expansive glossary of contract language and basic transactional practice.

Book excerpt: Transformative Classroom Management The natural condition of any classroom is harmonious, satisfying, and productive, so why do so many teachers struggle with problems of apathy, hostility, anxiety, inefficiency, and resistance? In this groundbreaking book, education expert John Shindler presents a powerful model, Transformative Classroom Management (TCM), that can be implemented by any teacher to restore the natural positive feelings in his or her classroom—the love of learning, collaboration, inspiration, and giving—and create a productive learning environment in which all students can achieve. Unlike other classroom management systems that view problems as something to be “handled,” TCM offers suggestions for creating optimal conditions for learning, performance, motivation, and growth. This practical book shows teachers how to abandon ineffective short-term gimmicks, bribes, and punishments and adopt the proven management practices and new habits of mind that will transform their classrooms. Praise for Transformative Classroom Management “Transformative Classroom Management is a practical resource that explains the how and why of classroom management for novice and veteran teachers. Dr. Shindler recognizes the importance of preserving the teacher’s sanity while ensuring the student’s development of a personal sense of responsibility and a positive self-esteem.” —Eileen Matus, principal, South Toms River Elementary School, New Jersey “I have read many other management books by other authors, but Transformative Classroom Management has been the best so far at demystifying the invisible forces in the classroom.” —WILL McELROY, 4th grade teacher, Los Angeles United School District “This book was an invaluable tool for me during my student teaching. It served as a reference book that I found myself continually drawn to while struggling to find ways to effectively manage 29 first graders. The ideas, concepts and suggestions in the book were so innovative and helpful that even my Master Teacher found herself implementing some of the ideas! A must have for all student teachers!” —Carol Gillon, student teacher, Seattle University “Insightful and thoroughly researched, Transformative Classroom Management is an invaluable tool to help teachers, newbies and veterans alike, develop fully functional and engaged learning communities.” —LISA GAMACHE RODRIGUEZ, teacher, Los Angeles Unified School District
