Book excerpt: Since the very beginning, temporary agency work has been an accepted feature in the United States’ labour market. In the European Union, however, it took more than thirty years to agree on European-level legislation in this area. The European Directive 2008/104/EC on Temporary Agency Work was promulgated on 19 November 2008. Implementation was due by 5 December 2011. The directive left many options for Member States, such as regarding the fundamental issue of equal treatment between the temporary agency worker and a comparable worker in the user enterprise. Furthermore, Member States had to review restrictions or prohibitions on the use of temporary agency work in order to comply with the directive. This book provides in-depth insight into the transposition of Directive 2008/104/EC in national legislation, collective agreements, and practices throughout the European Union. A comparison with the regulation of temporary agency work in the United States gives perspective to the analysis and allows for an assessment of the level of protection afforded in this sector of the labour market both in the EU and in the US.

Book excerpt: Over half of all people working on behalf of any given organization are typically not their own employees. Some are freelance contractors working in their own right. A significant proportion is employed to provide these services by another firm, under agency or outsourcing service agreements. The services they perform under these agreements are often vital in supporting the organization’s customer relationships, reputation and brand identity. Yet, remarkably, little attention has been paid to how these ‘non-employees’ are managed, motivated and meaningfully engaged. Management protocol generally sees them as outside the organization’s remit or control. The law paints them as victims. This ground-breaking book challenges both these assumptions. Through a combination of pioneering legal analysis and rigorous case-study research, it demonstrates that non-employees are often the organization’s most important hidden resource. Patricia Leighton and her collaborators highlight the limited good practice that is available, based on examples in large corporations, public sector organizations and smaller firms in a variety of countries. More importantly she clearly sets out the issues and imperatives employers should address, supported by new management concepts and models of effective practice developed specifically for the book. Far from being victims, she argues, non-employees often choose flexible working patterns for their own intrinsic ends and have ambitions, career aspirations and workplace needs that can be responded to and exploited by forward-looking employers. “Looking at the role they now play, these people are no longer marginal, atypical or peripheral as they are still termed and regarded by both legal and management practitioners. It is understood generally to mean a limited company, the sole or main shareholder of which is also its director, who, instead of working directly for clients, or taking up employment with other businesses, operates through his company. The company contracts with clients, either directly or through an agency, to supply the services of its director. There are many reasons for the use of personal service companies, including the possibility of reducing tax and national insurance bills. The Government's anti-avoidance legislation, often referred to as IR35, is complex and raises its own problems. The report is not intended to be a comprehensive reference work; instead it focuses on five main areas: (1) The use of personal service companies, relevant legislation and recent trends; (2) the continuing viability of the IR35 legislation; (3) HMRC's administration and the effect of recent reforms; (4) implications for the lower-paid; (5) the public sector. The Committee point to the absence of reliable information collected by HMRC. This could be rectified by amending the personal tax return and employer year end declaration and making the questions on service companies compulsory, rather than optional. HMRC failed to demonstrate that they had a sound basis for the £550m of tax and national insurance that they cited as being at risk if IR35 were to be abolished or suspended. Low-paid workers may not be aware that employment by these companies means they have fewer employment rights.

Book excerpt: Since the International Labour Organisation's Maritime Labour Convention, 2006 (MLC) came into force internationally on 20 August 2013, it has already been amended, and a further two sets of amendments have been agreed and are expected to come into force in 2019 and 2020. Maritime Labour Convention, 2006 – UK and REG Implementation sets out in detail how the UK, Bermuda, Cayman Islands, Gibraltar and the Isle of Man (being the members of the Red Ensign Group (REG) which are subject to the MLC) have implemented the Convention. Specific references are given to the laws, merchant shipping notices and guidance, as well as identifying the areas where implementation is permitted by way of collective agreements. As the MLC sits in the context of the wider international regulatory regime, it expressly endorses the application of other international instruments and standards, particularly those of the International Maritime Organisation. Furthermore, many of the MLC's mandatory provisions have been incorporated into EU Directives, which are relevant to the UK and Gibraltar. These international and regional provisions are also referenced. Chapter 1 sets out an introduction to the ILO and the MLC. Chapter 2 describes the general approach of how the UK applies its legislation to UK ships and, while they are in UK waters, non-UK ships without MLC documentation, and non-UK ships with MLC documentation. Chapters 3-22 describe the UK provisions in more detail as the other REG members' laws are influenced by those to a significant extent. The specific provisions for Bermuda, the Cayman Islands, Gibraltar and the Isle of Man have been set out, with detailed references to the appropriate regulatory sources in Chapters 23-26. Due to the central role of the MLC's Title 5 on compliance and enforcement, this is set out in full (in Part VIII, Appendix 1), annotated with references to the relevant sections of the ILO's guidelines on flag state control and port state control. The full text of the amendments to the MLC have been set out in Part VIII, Appendix 2.
