Esto, si quiere conservarse la idea de que el derecho penal internacional es un derecho común a la humanidad. Este texto busca plantear una interpretación de los elementos subjetivos del delito, consagrados en el Estatuto de Roma, a partir de la comprensión y comparación de cinco sistemas jurídicopenales: Inglaterra, Estados Unidos, Francia, España y Colombia. El objetivo es aumentar la seguridad jurídica, la legitimidad del ordenamiento penal internacional y aportar a que la Corte haga una aplicación garantista del derecho penal internacional. La comparación realizada pone en evidencia que todos los Estados comparten criterios mínimos de aplicación de los elementos subjetivos del derecho penal, con base en los cuales debe fortalecerse la actividad universal de la Corte Penal Internacional.
