Luego, se trata el tema de la sociedad patrimonial entre compañeros permanentes surgida de la unión marital de hecho, que reúna los requisitos exigidos en el artículo 2.° de la Ley 54 de 1990 modificada por la Ley 979 de 2005, su similitud y diferencias con la sociedad conyugal, para termi nar con la sociedad de hecho surgida de la relación de pareja que no reúna los requisitos exigidos por la Ley 54 de 1990, tomando como fundamento el Código de Comercio y la jurisprudencia nacional. Para una mejor comprensión, se presenta el tema desde el punto de vista sustancial y procesal incluyendo algunos ejemplos de la manera como se debe proceder a la liquidación de la sociedad conyugal, que es el mismo tratamiento empleado para la liquidación de la sociedad patrimonial, con las particularidades propias de cada institución.
