In our modern age, however, the advent and accessibility of assisted reproductive technologies (ARTs) and the ease with which they have traversed global borders, has fundamentally altered the meaning of childbearing and parenting. In thetwenty-first century, parenthood is no longer achieved only through gestation, adoption, or traditional surrogacy, but also via assisted reproductive technologies (ARTs), where science and technology play lead roles. Furthermore, in a globalized world economy, where the movement and transfer of people and commodities are increasing to serve the interests of capitalism, gamete donation and surrogate birth can traverse innumerable geographic, socio-economic, racialized, and political borderlands. Thus, reproduction itself can be outsourced. This edited volume explores one specific aspect of the new assisted reproductive technologies: gestational surrogacy and how its practice is changing the traditional concept of parenthood across the globe. The phenomenon of transnational surrogacy has given rise to a thriving international industry where money is being ‘legally’ exchanged for babies and ‘reproductive labor’ has taken on a lucrative commercial tone. Yet, law, research, and activism are barely aware of this experience and are still playing catch-up with rapidly changing on-the-ground realities. This interdisciplinary collection of essays assuages the dearth of knowledge and addresses significant issues in transnational commercial gestational surrogacy as it takes shape in a peculiar relation between the West (primarily the United States) and India.

In the first detailed ethnography of India's surrogacy industry, Amrita Pande visits clinics and hostels and speaks with surrogates and their families, clients, doctors, brokers, and hostel matrons in order to shed light on this burgeoning business and the experiences of the laborers within it. From recruitment to training to delivery, Pande's research focuses on how reproduction meets production in surrogacy and how this reflects characteristics of India's larger labor system. Pande's interviews prove surrogates are more than victims of disciplinary power, and she examines the strategies they deploy to retain control over their bodies and reproductive futures. While some women are coerced into the business by their families, others negotiate with clients and their clinics to gain access to technologies and networks otherwise closed to them. As surrogates, the women Pande meets get to know and make the most of advanced medical discoveries. They traverse borders and straddle relationships that test the boundaries of race, class, religion, and nationality. Those who focus on the inherent inequalities of India's surrogacy industry believe the practice should be either banned or strictly regulated. Pande instead advocates for a better understanding of this complex labor market, envisioning an international model of fair-trade surrogacy founded on openness and transparency in all business, medical, and emotional exchanges.

Drawing from rich interviews with surrogate mothers and egg donors in Bangalore, as well as twenty straight and gay couples in the U.S. and Australia, Discounted Life focuses on the processes of social and market exchange in transnational surrogacy. Sharmila Rudrappa interrogates the creation and maintenance of reproductive labor markets, the function of agencies and surrogacy brokers, and how women become surrogate mothers. Is surrogacy solely a labor contract for which the surrogate mother receives wages, or do its meanings and import exceed the confines of the market? Rudrappa argues that this reproductive industry is organized to control and disempower women workers and yet her interviews reveal that, by and large, the surrogate mothers in Bangalore found the experience life affirming. Rudrappa explores this tension, and the lived realities of many surrogate mothers whose deepening bodily commodification is paradoxically experienced as a revitalizing life development. A detailed and moving study, Discounted Life delineates how local labor markets intertwine with global reproduction industries, how Bangalore’s surrogate mothers make sense of their participation in reproductive assembly lines, and the remarkable ways in which they negotiate positions of power for themselves in progressively untenable socio-economic conditions.

While processes of human reproduction have become increasingly commodified and disaggregated, a new spatial division of labor has surfaced as laws in different countries facilitate or impede various fertility treatments. In recent years, India has emerged as a global "hub" of transnational surrogacy arrangements, in part because of lower costs but also due to minimal regulatory frameworks for the provision of ARTs. This dissertation details how these variables---the absence of laws governing ARTs in India, the relatively low cost of services, and the transnational clientele---influenced the expansion of ART services in India aimed specifically at global consumers, and the attendant implications for understanding kinship relations within global reproductive networks.

In a developing country like India, bio-technologies therefore create reproductive objects of certain female bodies while promoting an image of reproductive liberation for others. This critical book refers to a range of liberal, radical and postcolonial feminist frameworks on surrogacy, and questions the individual reproductive rights perspective as an approach to examine global surrogacy. Its practice had been linked to conflict, poverty, gender inequality, and claims of human trafficking, ultimately leading to the establishment of the Hague Convention on Intercountry Adoption (HCIA). This international private law along with the Convention on the Rights of the Child affirm the best interests of the child as paramount in making decisions on behalf of children and families with obligations specifically oriented to safeguards in adoption practices. In 2004, as intercountry adoption peaked and then began a dramatic decline, commercial global surrogacy contracts began to take off in India. Global surrogacy gained in popularity owing, in part, to improved assisted reproductive technology methods, the ease with which people can make global surrogacy arrangements, and same-sex couples seeking the option to have their own genetically-related children. Yet regulation remains an issue, so much so that the Hague Conference on Private International Law has undertaken research and assessed the many dilemmas as an expert group considers drafting a new law, with some similarities to the HCIA and a strong emphasis on parentage. This ground-breaking book presents a detailed history and applies policy and human rights issues with an emphasis on the best interests of the child within intercountry adoption and the new conceptions of protection necessary in global surrogacy. To meet this end, voices of surrogate mothers in the US and India ground discourse as authors consider the human rights concerns and policy implications. For both intercountry adoption and global surrogacy, the complexity of the social context anchors the discourse inclusive of the intersections of poverty and privilege. This examination of the inevitable problems is presented at a time in which the pathways to global surrogacy appear to be shifting as the Supreme Court of India weighs in on the future of the industry there while Thailand, Cambodia and other countries have banned the practice all together. There is speculation that countries in Africa and possibly Central America appear poised to pick up the multi-million dollar industry as the demand for healthy infants continues on.

During this time, beginning in 2002, this practice was and continues to be scrutinized by scholars from various academic fields. In this study the researcher analyzes how the emergence of transnational commercial surrogacy in India was portrayed in US media through multiple outlets including newswires, magazines, transcripts, and web publications. In this qualitative study, the researcher performed purposive sampling to locate articles within the Nexis Uni database between the dates of January 1, 2006 and January 1, 2015. Using flexible coding, and qualitative content analysis the researcher coded thirty news items. Four themes emerged including: law, money made in a certain period of time (with subthemes of globalization and exploitation), surrogate health, and intended parents desperation for children. Additionally, the researcher contextualizes transnational commercial surrogacy within Postcolonial Feminist critiques-specifically those arguing that the practice retrenches colonial thinking and practices. This study recommends that, should transnational commercial surrogacy become legal again in India, Indian lawmakers ensure surrogates ensure surrogates health and personal freedoms while performing this labor. Also, this study recommends that Indian surrogates are paid fees comparable to their Western counterparts.

Yet scholars and the media continue to examine them in geographical and conceptual isolation. South of the Future closes both these gaps. It investigates nannying, elder care, domestic work, and other forms of migrant labor in the Americas together with the emerging "Wild West" of biotechnology and surrogacy in the Indian subcontinent. The volume is profoundly interdisciplinary and includes both prominent and emerging scholars from a wide variety of fields, including anthropology, law, literary and cultural studies, science and technology studies, and social policy. These contributors speak to the dynamic, continually changing facets of the nexus of care and value across these two key regions of the global south. These techniques improve the health and well-being of some human beings using products or functions that come from the body of others. Growth in demand and absence of an appropriate international legal framework have led to the development of a lucrative global trade in which victims are often people living in insecure conditions who have no other ways to survive than to rent or sell part of their body. This growing market, in which parts of the human body are bought and sold with little respect for the human person, displays a kind of dehumanization that looks like a new form of slavery. This book is the result of a collective and multidisciplinary reflection organized by a group of international researchers working in the field of medicine and social sciences. It helps better understand how the emergence of new health industries may contribute to the development of a global medical tourism. It opens new avenues for reflection on technologies that are based on appropriation of parts of the body of others for health purposes, a type of practice that can be metaphorically compared to cannibalism. Starting in India, a “disruptive” model of surrogacy offered mass availability, rapid accessibility, and created new demands for surrogacy services from people who could not afford or access surrogacy elsewhere. In International Surrogacy as Disruptive Industry in Southeast Asia, Andrea Whittaker traces the development of this industry and its movement across Southeast Asia following a sequence of governmental bans in India, Nepal, Thailand, and Cambodia. Through a case study of the industry in Thailand, the book offers a nuanced and sympathetic examination of the industry from the perspectives of the people involved in it: surrogates, intended parents, and facilitators. The industry offers intended parents the opportunity to form much desired families, but also creates vulnerabilities for all people involved. These vulnerabilities became evident in cases of trafficking, exploitation, and criminality that emerged in southeast Asia, leading to greater scrutiny on the industry as a whole. Yet the trade continues in new flexible hybrid forms, involving the circulation of reproductive gametes, embryos, surrogates, and ova donors across international borders to circumvent regulations. The book demonstrates the need for new forms of regulation to protect those involved in international surrogacy arrangements.

Melinda Cooper and Catherine Waldby take on that project, analyzing what they call "clinical labor," and asking what such an analysis might indicate about the organization of the bioeconomy and the broader organization of labor and value today. At the same time, they reflect on the challenges that clinical labor might pose to some of the founding assumptions of classical, Marxist, and post-Fordist theories of labor. Cooper and Waldby examine the rapidly expanding transnational labor markets surrounding assisted reproduction and experimental drug trials. As they discuss, the pharmaceutical industry demands ever greater numbers of trial subjects to meet its innovation imperatives. The assisted reproductive market grows as more and more households look to third-party providers for fertility services and sectors of the biomedical industry seek reproductive tissues rich in stem cells. Cooper and Waldby trace the historical conditions, political economy, and contemporary trajectory of clinical labor. Ultimately, they reveal clinical labor to be emblematic of labor in twenty-first-century neoliberal economies.
