This book was released on 2023-05-19 with total page 241 pages. Available in PDF, EPUB and Kindle.

Book Synopsis Global Justice, Human Rights and the Modernization of International Law by : Riccardo Pisillo Mazzeschi
Download or read book Global Justice, Human Rights and the Modernization of International Law written by Riccardo Pisillo Mazzeschi and published by Springer. This book was released on 2018-07-27 with total page 293 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is based on the observation that international law is undergoing a process of change and modernization, driven by many factors, among which the affirmation and consolidation of the role of the individual and of the theory of human rights stand out. In the contemporary world, international law has demonstrated an ability to evolve rapidly. But it is still unclear whether its modernization process is also producing structural changes, which affect the subjects, the sources and even the very purpose of this law. Is it truly possible to speak of a paradigmatic and ideological change in the international legal system, one that also involves a transition from a state-centred international order to a human-centred one, and from inter-state justice to global justice? The book addresses three fundamental aspects of the modernization process of international law: the possible widening of the concept of international community and of the classic assumptions of statehood; the possible diversification of the sources of general international law; and the ability of international law to adapt to new challenges and to achieve the main goals for humanity set by the United Nations. The overall objective of the book is to provide the tools for a deeper understanding of the transition phase of contemporary international law, by examining the major problems that characterize this phase. The book will also stimulate critical reflection on the future prospects of international law.
Book Synopsis Criminal Law and Morality in the Age of Consent by : Aniceto Masferrer
Download or read book Criminal Law and Morality in the Age of Consent written by Aniceto Masferrer and published by Springer Nature. This book was released on 2021-02-09 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book discusses the relation between morality and politics, and morality and law, a field that has been studied for more than two thousand years The law is a part of human culture, and this touches upon a dynamic reality that is connected to the relation between nature and freedom, nature and culture. If such relations are not clearly understood, as is the case today, the relation between morality and law cannot be properly comprehended either. The relationship between morality and criminal law must constantly evolve to meet the needs of changing times and circumstances. Social changes and new situations require new answers. And since the relationship involves criminal law, legal philosophy and legal history, interdisciplinary approaches are always needed. Featuring fifteen original contributions by legal scholars from various European and American universities, the book does not pretend to solve the complexity of the relation between morality and criminal law, but instead expresses criticism, offers some proposals and stimulates further thought. The book tackles the topic from an interdisciplinary perspective (criminal law, constitutional law, legal philosophy and legal history, among others). As such, it appeals not only to scholars and students, but also to lawyers, policymakers, historians, theologians, philosophers and general readers who are interested in the legal, social, political and philosophical issues of our time.
Download or read book On Tyranny written by Leo Strauss and published by University of Chicago Press. This book was released on 2013-11-15 with total page 359 pages. Available in PDF, EPUB and Kindle. Book excerpt: On Tyranny is Leo Strauss’s classic reading of Xenophon’s dialogue Hiero, or Tyrannicus, in which the tyrant Hiero and the poet Simonides discuss the advantages and disadvantages of exercising tyranny. Included are a translation of the dialogue from its original Greek, a critique of Strauss’s commentary by the French philosopher Alexandre Kojève, and the complete correspondence between the two. This revised and expanded edition introduces important corrections throughout and expands Strauss’s restatement of his position in light of Kojève’s commentary to bring it into conformity with the text as it was originally published in France.

Book Synopsis At the Origins of Modernity by : José María Beneyto
Download or read book At the Origins of Modernity written by José María Beneyto and published by Springer. This book was released on 2017-08-30 with total page 211 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is based on an international project conducted by the Institute for European Studies of the University CEU San Pablo in Madrid and a seminar on Vitoria and International Law which took place on July 2nd 2015 in the convent of San Esteban, the place where Vitoria spent his most productive years as Chair of Theology at the University of Salamanca. It argues that Vitoria not only lived at a time bridging the Middle Ages and Modernity, but also that his thoughts went beyond the times he lived in, giving us inspiration for meeting current challenges that could also be described as “modern” or even post-modern. There has been renewed interest in Francisco de Vitoria in the last few years, and he is now at the centre of a debate on such central international topics as political modernity, colonialism, the discovery of the “Other” and the legitimation of military interventions. All these subjects include Vitoria’s contributions to the formation of the idea of modernity and modern international law. The book explores two concepts of modernity: one referring to the post-medieval ages and the other to our times. It discusses the connections between the challenges that the New World posed for XVIth century thinkers and those that we are currently facing, for example those related to the cyberworld. It also addresses the idea of international law and the legitimation of the use of force, two concepts that are at the core of Vitoria’s texts, in the context of “modern” problems related to a multipolar world and the war against terrorism. This is not a historical book on Vitoria, but a very current one that argues the value of Vitoria’s reflections for contemporary issues of international law.

Book Synopsis Knowledge and Reality by : P. Parrini
Download or read book Knowledge and Reality written by P. Parrini and published by Springer Science & Business Media. This book was released on 1998-03-31 with total page 246 pages. Available in PDF, EPUB and Kindle. Book excerpt: XIV The stability of a philosophical construction will depend not only upon the solidity of the blocks, of the pillars and architraves that make it up, but also upon the way in which all these parts are connected. Of course, it will not be possible to argue for every single part of a philosophical building: to do so would mean to embark in a virtually endless enterprise. Accordingly, some of the parts of a philosophical building will have to be taken from the literature on the subject as 'ready made' or 'semi-finished' elements, while others will be argued for in the course of building. This is what happened in my work too. In some cases (for in stance, in the case of epistemic relativism), my concern was to illustrate theses which I believed to be sufficiently consolidated, rather than to ar gue for them. In other cases - where I was directly engaged in building the theory that I want to fonnulate - I did exactly the opposite. This is what I have tried to achieve, for example, for those proper architraves of my construction, viz. the connection between scepticism and metaphysi cal realism. and the thesis of the nonnative value of the fundamental epistemological notions (truth, objectivity, and rationality).
