Book Synopsis Lawyers and Savages by : Kaius Tuori
Download or read book Lawyers and Savages written by Kaius Tuori and published by Routledge. This book was released on 2014-09-19 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: Legal primitivism was a complex phenomenon that combined the study of early European legal traditions with studies of the legal customs of indigenous peoples. Lawyers and Savages: Ancient History and Legal Realism in the Making of Legal Anthropology explores the rise and fall of legal primitivism, and its connection to the colonial encounter. Through examples such as blood feuds, communalism, ordeals, ritual formalism and polygamy, this book traces the intellectual revolution of legal anthropology and demonstrates how this scholarship had a clear impact in legitimating the colonial experience. Detailing how legal realism drew on anthropology in order to help counter the hypothetical constructs of legal formalism, this book also shows how, despite their explicit rejection, the central themes of primitive law continue to influence current ideas – about indigenous legal systems, but also of the place and role of law in development. Written in an engaging style and rich in examples from history and literature, this book will be invaluable to those with interests in legal realism, legal history or legal anthropology.
Book Synopsis The Baiuvarii and Thuringi by : Janine Fries-Knoblach
Download or read book The Baiuvarii and Thuringi written by Janine Fries-Knoblach and published by Boydell & Brewer Ltd. This book was released on 2014 with total page 398 pages. Available in PDF, EPUB and Kindle. Book excerpt: A study of two Germanic tribes, the Baiuvarii and Thuringi, looking at their origins, development, and customs between the fifth and the eighth centuries. The large neighbouring tribes of the Baiuvarii and Thuringi, who lived between the Alps and the River Elbe from the fifth to eighth centuries, are the focus of this book. Using a variety of different sources drawn from the fieldsof archaeology, history, linguistics and religion, the contributions discuss how an ethnos, a gens, or a tribe, such as the Baiuvarii or Thuringi, might appear in the written and archaeological evidence. For the Thuringi tribal traditions started around the year 400 or even earlier, while the Baiuvarii experienced a much later ethnogenesis from both immigrants and a local, partly Romance population in the mid-sixth century. The Baiuvarii and Thuringi are studied together because of the astonishing connections between their two settlement landscapes. In the context of the row-grave civilisation the Thuringi belonged primarily to the eastern, the Baiuvarii to thewestern sphere. The kingdom of the Thuringi was assimilated into the Merovingian Empire after their defeat by the Franks in the 530s, which also changed their burial customs to the style of the western row-grave zone. In contrast, the Baiuvarii were not "Frankicised" until more than a century later and their grave customs remained more typically "Bavarian". The chapters highlight typical features of each region and beyond: settlements, agricultural economy, law, religion, language, names, craftsmanship, grave goods, mobility and communication. Janine Fries-Knoblach is a freelance archaeologist with a special interest in the fields of settlements, agriculture and technology of protohistoric Central Europe, and has taught at a number of German universities; Heiko Steuer is Professor Emeritus of Prehistoric and Protohistoric Archaeology and Archaeology of the Middle Ages at Freiburg University, Germany, with a special interest in the social and economic history of Germanic tribes in Central Europe; John Hines is Professor of Archaeology at Cardiff University and is supervising the publication of the remaining volumes inthis series. Contributors: Giorgio Ausenda, Janine Fries-Knoblach, Heike Grahn-Hoek, Dennis H. Green, Wolfgang Haubrichs, Joachim Henning, Max Martin, Peter Neumeister, Heiko Steuer, Claudia Theune-Vogt, Ian Wood.

Download or read book The Saxon Mirror written by and published by University of Pennsylvania Press. This book was released on 2014-10-11 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Sachsenspiegel, or Saxon Mirror, compiled in 1235 by Eike von Repgow, may be said to mark the beginning of vernacular German jurisprudence. For the first time, Maria Dobozy offers an English translation of this influential lawbook, the oldest, and most important, set of customary law in the German language. This lawbook with its amendments marks a major shift in the history of German law from purely oral authority and transmission to a written documentation that allowed greater consistency in legal procedure. The reception of the lawbook was vast. It was rapidly adapted across Germany, as the four hundred manuscript versions demonstrate. Beyond Germany, it was copied as the paradigm for lawbooks in Prussia, Silesia, Poland, Ukraine, Hungary, and Bohemia. These codes of law became the standard for over three hundred years. The Sachsenspiegel contains a compilation of the legal practices at the time in Saxony, an ethnically mixed territory, and encompasses the legal customs and procedures that regulated the daily life of peasants and landlords. It is a multidimensional resource for anyone seeking insight into German and Central European culture in art, literature, linguistics, literacy, law, ethnic diversity, women, and the Bible.

Download or read book English Law Before Magna Carta written by and published by BRILL. This book was released on 2010-09-14 with total page 346 pages. Available in PDF, EPUB and Kindle. Book excerpt: Felix Liebermann’s Die Gesetze der Angelsachsen (1903-1916) remains the single most important contribution to the study of early English law. This volume marks the Gesetze’s centenary by bringing together original essays by an international group of leading scholars specializing in medieval legal culture. The essays address not only Liebermann’s life and legacy, but also major issues in the study of early law, including the relationship between Old English legal and penitential texts, the provenance of early English legal manuscripts, the composition and dating of pre-Magna Carta legislation, and the nature of Anglo-Saxon and Norman legal practice and procedure. This collection provides an essential assessment of the current state of early legal studies as well as a roadmap for future work. Contributors are Hideyuki Arimitsu, Rebecca Brackmann, Daniela Fruscione, R.D. Fulk, Thomas Gobbitt, Janelle Greenberg, John Hudson, Stefan Jurasinski, Nicholas Karn, T.B. Lambert, Andrew Rabin, Mary P. Richards, Richard Sharpe, and Jürg Rainer Schwyter.
