Excerpt: ... must have annexed to the original summons and to the copy served on the defendant, a copy of the cause of action upon which the suit is based. The defendant may either be served personally or by leaving copy at his most notorious place of abode. The constable shall then enter his service upon the original and return to the justice for docketing. trial, judgment, verdict, etc. On the day of trial as set out in summons served upon defendant, if no defense is filed, the justice shall enter up judgment in default. The judgment must be written out and signed upon his docket at the time and place specified in the summons. Judgments entered elsewhere are void. If the defendant shall answer and deny the justness of plaintiff's demand, then an issue is formed to be determined by the judge after hearing all legal evidence touching on the case. The trial may be had at the first term if both parties are present and ready for trial; if not, the filing of a defense carries the case over to the next term by operation of law. In cases appealed to a jury in a justice court, the justice shall pass upon the admissibility of evidence, but the jury shall be the judge of both the law and evidence. A justice may not charge a jury in his court. The justice should keep a list of the jury returning a verdict on his docket, and should have foreman to sign verdict. Cohen sets out to rescue the egalitarian thesis that in a society in which distributive justice prevails, people’s material prospects are roughly equal. Arguing against the Rawlsian version of a just society, Cohen demonstrates that distributive justice does not tolerate deep inequality. In the course of providing a deep and sophisticated critique of Rawls’s theory of justice, Cohen demonstrates that questions of distributive justice arise not only for the state but also for people in their daily lives. The right rules for the macro scale of public institutions and policies also apply, with suitable adjustments, to the micro level of individual decision-making. Cohen also charges Rawls’s constructivism with systematically conflating the concept of justice with other concepts. Within the Rawlsian architectonic, justice is not distinguished either from other values or from optimal rules of social regulation. The elimination of those conflations brings justice closer to equality.
