Excerpt: ...marshal of the United States Court in the district in which bankruptcy proceedings have been commenced, is designated as its messenger by the Bankrupt Act, and it is intended that he shall occupy a position similar to that of sheriff of a State Court. Under a warrant of seizure he is entitled to take charge of the bankrupt's property until an assignee can be appointed, and is in like manner responsible for the care he takes of the property; but if there is any dispute as to its ownership, he will not be compelled to assume this responsibility until he has been properly indemnified.' When in accordance with the provisions of section eleven of the Bankrupt Act, the Judge, or if there be no opposing interest the Register designated by the Judge to hear the same, shall be satisfied that the petitioning debtor owes debts to amount of three hundred dollars, 1. A sale by the marshal as messenger under the order of court, is to be regarded as in the nature of a sale made by a provisional assignee, and a claimant for any portion of the proceeds whose claim is valid, is entitled to be paid out cf the fund in the hands of the asssignee.--In re Hitchings, 4 B. R. 125. The marshal, under a warrant issued in accordance with section 40 of the bankrupt law may take ossession of the property of the debtor wheresoever he may find it or in whose ands soever he may find it. If indemnified, the law makes it his duty in the one case to retain possession and to tales possession in the other. With indemnity he would be liable if he did not exercise his authority, without it it is optional.--In re Briggs, 3 B.
