È dunque anche nell'interesse dei due diritti fondamentali che i mercati sperimentino dei livelli di sana pressione competitiva, che spingano le imprese a migliorare la qualità di servizi e prodotti offerti. Si colloca in siffatto contesto il Regolamento (UE) 2022/2065 del 19 ottobre 2022, relativo al mercato unico dei servizi digitali e noto come Digital Services Act. Si tratta di una riforma caratterizzata da un approccio basato sul rischio, destinata a rappresentare la cornice normativa della maggior parte delle attività quotidiane di consumatori, di imprenditori e di professionisti. Si è di fronte ad un quadro giuridico molto puntuale, ma non sempre armonizzato e coerente e ancora troppo poco attento ai profili rimediali. Il dibattito che ha animato il convegno leccese, tra i primi in Italia sul Digital Services Act, ha posto al centro dell’attenzione le trasformazioni in atto nel mercato digitale cercando di delineare le alternative possibili per affrontare e sciogliere la contraddittoria ambivalenza dell’ambiente online, nato come spazio “libero”, refrattario alla regolamentazione e caratterizzato da assenza di intermediazione, eppure tanto bisognoso di garanzie di sicurezza e protezione per i diritti fondamentali.

Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.
