The Schengen area, established in 1985 and today encompassing twenty-nine European countries, allows people, goods, and capital to cross borders without restraint. Schengen transformed European life, advancing both a democratic project of transnational citizenship and a neoliberal project of international free trade. But the right of free movement always excluded non-Europeans, especially migrants of color from former colonies of the Schengen states. In Europe without Borders, Isaac Stanley-Becker explores the contested creation of free movement in Schengen, from treatymaking at European summits and disputes in international courts to the street protests of undocumented immigrants who claimed free movement as a human right. Schengen laid the groundwork for the making of a single market and the founding of the European Union. Yet its emergence is one of the great untold stories of modern European history, one hidden in archives long embargoed. Stanley-Becker is among the first to have access to records of the treatymaking—such as letters between France’s François Mitterrand and West Germany’s Helmut Kohl—and Europe without Borders offers a pathbreaking account of Schengen’s creation. Stanley-Becker argues that Schengen gave a humanist cast to a market paradigm; but even in pairing the border crossing of human beings with the principles of free-market exchange, this vision of free movement was hedged by alarm about foreign migrants. Meanwhile, these migrants—the sans-papiers—saw in the promise of a borderless Europe only a neocolonial enterprise.

But is the wall more than an historical relict for the management of borders? Book excerpt: Migrants in irregular situations are confronted with dangerous circumstances during their journeys toward Western countries and upon their arrival in those countries of destination. While continuously disputed by social and political forces, migrants and their children continue to live an isolated life in our communities, facing discrimination, abuse, and labour exploitation. Courts and tribunals in our societies try to make sense of this human mobility by sorting out basic human rights and economic privileges in a way which is too revolutionary for conservative parties and too slow and unfair for human rights activists. This book focuses on the issue of human rights protection of migrants in irregular situations. The concept of protection does not refer to a humanitarian definition of aid and intervention on behalf of the victims of migration. Protection here means official recognition by the State and by the law of migrants in irregular situations. It also means recognition of the human rights of migrants, recognition of the migrant as a political actor, and from there, political inclusion and politicization of the migrant. Discussions in international forums are dominated by Westphalian visions of the world, and no change can be envisioned in the near future with this kind of discourse. In a highly individualized and fragmented world, an undocumented migrants destiny is instead decided on a case-by-case basis in our national courts, and today the most effort is put into advocacy and legal representation. How successful the rights claims are today, what the political context of their development is, and how social and political actors position themselves in regards to irregular migration are points discussed in this book. Book excerpt: This research analyzes mechanisms fostering states’ compliance to international treaties. It argues that a treaty accountability network surrounds states when they commit to an international covenant and that actors belonging to the network have leverage on states to hold them accountable. This study is particularly interested in the role NGOs and IOs play as actors within this network. It identifies two main ways for holding states accountable: direct and indirect. Indirect accountability is conceptualized as mechanisms where aid recipients are empowered by organizations and will henceforth hold their states accountable. This research provides a small-N case-study on the UNCRC, maps the treaty accountability network surrounding it, identifies accountability mechanisms developed by one IO (UNICEF) and one NGO (Terre des Hommes Suisse) and examines pathways used by one state (Switzerland).
