Book excerpt: This report of the European Region of IFA evaluates the tax and social security implications of frontier workers in Europe. The exact meaning and scope of “frontier worker” differ in tax law and social security law. Several relatively old tax treaties contain special tax provisions attuned to the cross-border situation of frontier workers that deviate from the general allocation rules for employment income (article 15 of the OECD Model). The common characteristics of these special treaty provisions of daily return and geographical proximity may lead to unconscious tax biases in a changing landscape of digitalization and globalization. Tax treaties - primarily drafted at a time when physical presence was the most reliable element in determining taxing rights - are not attuned to the increasing flexible forms of frontier work, which have gradually developed and are becoming more prevalent. Enhanced means of communication tools and transportation enabling telework and highly mobile work (e.g. individuals who reside in one state and work in more than one other state), amongst others, have increased the mobility and diversity of frontier work. Frontier workers may also encounter difficulties in equal treatment with obtaining tax and social benefits. Further inconveniences may arise from the deviation of social security rules from tax rules. The key challenges in the legislative framework suggest the need to revise the definition and legal status of frontier workers, especially in the aftermath of the COVID-19 pandemic. Suggestions are made to minimize the detected application and interpretation problems, and to enable a better coordination of tax and social security rules.Full-text paper.

Book excerpt: The migrant worker is the most important constituent of the Free Movement of workers, freedom which, along with the other three, defines the essence of the existence of the European Union. Although the institution of the migrant worker is very well defined in the law and jurisprudence of the European Union, there are still a number of legal incidents of this institution which still raises questions of interpretation and uniform application: who enters in the category of workers? Which is the coverage sphere of intermediate categories and which are their rights? What types of legal restrictions the states may impose to the workers and their families or the rights of the latter? Once with the developing of the European policies of cross-border cooperation at the level of the European Union, the social-economic necessities determined the apparition of the border worker, as specific type of migrant worker. Even if the concept of border worker is well defined by the legislation of the European Union, the accelerated development of the cross-border cooperation and of multiplication of the European Groups of Territorial Cooperation creates legislative syncope at the level of the states members of the European Union. The case study on the frontier worker from the Romanian-Hungarian space will highlight the strengths and weaknesses of these issues, opportunities and threats faced by this category of workers, but also how to synchronize the laws of the two European countries with de facto situation in this border area.

Book excerpt: This case study analyses administrative obstacle, the access to social security services for frontier workers (also known as cross-border workers in everyday EU terminology). This issue affects both workers contemplating cross-border work as well as workers who are already employed and working across the border. Two European Union (EU) directives are particularly relevant: Directive 2004/38/EC on the EU freedom of movement and residence and Directive 883/2004 on the coordination of social security. The EU does not have competence to regulate social security systems; these are set by Member States. Social Security portfolios and their build up can therefore differ European citizens. To help coordinate social security for cross-border work, the EU defines "frontier workers" as: "any person pursuing an activity as an employed or self-employed person in a Member State and who resides in another Member State to which he/she returns as a rule daily or at least once a week". Frontier workers can face a significant amount of administrative complexity in receiving access to social security services. This is related to their being officially registered as residents in one country, while working and contributing to certain social security services in a different country. Common causes here are insufficient language capability and expertise amongst authorities to address the issue of cross-border workers' social security. Additionally, while individuals often inform themselves before going to work abroad, some obstacles only appear once a person is working in another country; these obstacles arise primarily due to inefficient administrative systems. This case study explores how this particular obstacle has manifested and been addressed in the Greater Region in Luxembourg, parts of France, Belgium and Germany. Evidence points to a number of good practices and potential solutions to this issue. These include: quicker, more efficient administrative processes through shared, digital information systems; creating some form of regularly updated organisational protocol or schematic of the different relevant authorities and administrative levels, along with who is in charge of the different departments. Involving the full range of useful and relevant actors and a centralised body was considered good practice in the case of the Greater Region, as was a European framework for conducting bilateral negations and agreements between countries with cross-border workers.
