Book excerpt: Maastricht and Beyond is a critical assessment of the European Union brought into being by the Treaty of Maastricht. A team of experts provide a clear and thorough appraisal of the main provisions of the Treaty - including the three pillared structure of Economic and Monetary Union, common foreign and security policy and home affairs and justice - showing how these elements will change the function and eventually the character of the European Union. The book draws conclusions from the Maastricht process for the next reform of the Union in 1996, and it examines the practicalities of achieving a fully-fledged federal democracy, making proposals for a constitutional settlement. Maastricht and Beyond will appeal to both informed generalists and to students and scholars who want a fresh approach to the stale arguments over Maastricht, who seek enlightenment over what the Treaty is for and who have the curiosity to look forward to 1996 and beyond.

Book excerpt: The creation of the European Union arguably ranks among the most extraordinary achievements in modern world politics. Observers disagree, however, about the reasons why European governments have chosen to co- ordinate core economic policies and surrender sovereign perogatives. This text analyzes the history of the region's movement toward economic and political union. Do these unifying steps demonstrate the pre-eminence of national security concerns, the power of federalist ideals, the skill of political entrepreneurs like Jean Monnet and Jacques Delors, or the triumph of technocratic planning? Moravcsik rejects such views. Economic interdependence has been, he maintains, the primary force compelling these democracies to move in this surprising direction. Politicians rationally pursued national economic advantage through the exploitation of asymmetrical interdependence and the manipulation of institutional commitments.

Available in PDF, EPUB and Kindle. Book excerpt: Stephen Martin* The fourteen essays that constitute this work provide a coherent review of the past and present of the European Community, and consider some of its possible futures. Werner Abelshauser and Richard Griffiths offer separate perspectives on the precursors of the European Community. Abelshauser argues that comparison of the fates of the European Coal and Steel Community and the European Defense Community demonstrate the dominance of political over economic considerations in the integration process. Griffiths considers the stillborn European Political Community, many of the proposed features of which, somewhat transformed, were embodied in the Treaty of Rome. Both suggest that as a practical matter a coming together of French and German interests has been a precondition for advances in European integration. Stephen Martin and Andrew Evans discuss the development of the Com munity's Structural Funds, first envisaged as tools to smooth the transition from a collection of regional economies to a continent-wide single market, now increasingly seen as devices to guide adjustment to long-term struc tural problems. Stuart Holland emphasizes the role of the Structural Funds as one element in a broad range of strategies to ensure social and economic cohesion as the Maastrict Treaty ushers the European Union into the next stage of its development.

Available in PDF, EPUB and Kindle. Book excerpt: This work is the first systematic study of the presidency of the European Commission. Drawing upon cases of attempted leadership by Jacques Delors, the Commission President from 1985-95, it examines the leadership capacity of the office-holder. This points to the inherently shared and contingent nature of Commission President's leadership in a Union where the leadership sources are widely dispersed. While this is essentially an empirical study, Endo addresses some of the theoretical implications of its findings and resulting issues.

Book excerpt: Modern constitutionalism as an idea and practice is facing great uncertainty in current times. Scholarly debates focus predominantly on constitutions beyond the state, while the predicament of domestic constitutionalism is much less considered. This volume contributes to a theoretically informed analysis of the key challenges and changes affecting domestic constitutionalism in Europe and beyond, departing from the idea of ‘constitutional acceleration’ or the increased propensity of different actors to engage in (formal) reform of the constitutional order. The volume points to a fundamental change in the function of constitutions in that constitutions themselves are increasingly subjects of political contestation rather than framing political debates. The collection of essays addresses a range of critical challenges – including societal acceleration, depoliticization, civic engagement, multi-faceted constituent power, modernization, populism and nationalism, and transnationalization. The volume includes a variety of disciplinary, and in some cases interdisciplinary, approaches, including (political) sociology, political science, constitutional law, and constitutional and legal theory, and will be of interest to researchers and students in any of these areas. Case studies focus on the EU and the wider European context, and include highly relevant but little known or ill-understood cases, such as the recent constitutional events in Iceland, Italy, or Romania, and cases of democratic reversal, such as Hungary, while also engaging with traditional but rapidly changing cases of constitutional interest, such as the UK.

Available in PDF, EPUB and Kindle. Book excerpt: This coherent and pragmatically relevant monograph examines the soundness of the legal framework in education. Deriving from the disadvantage doctrine, it presents an analytical scheme for diagnosing whether or not domestic education law is in harmony with international human rights and minority rights law. The book examines law as a system and focuses on the reported perpetuation of educational disadvantage among Roma all over Europe. This focus suggests that minority individuals falling into several partly overlapping categories may become subjected to educational discrimination even by states that appear to fulfil relevant international standards. A functional approach to skills acquisition is suggested as a constructive way forward towards sustainable and inclusive education systems.

Available in PDF, EPUB and Kindle. Book excerpt: Why have the national governments of EU member states successively endowed the European Parliament with supervisory, budgetary, and legislative powers over the past fifty years? Building Europe's Parliament sheds new light on this pivotal issue, and provides a major contribution to the study of the European Parliament.Rittberger develops a theory of delegation to representative institutions in international politics which combines elements of democratic theory and different strands of institutionalist theory. To test the plausibility of his theory, Rittberger draws on extensive archival material and offers theory-guided, in-depth case studies of three landmark decisions in the history of the European Parliament: the creation of the Common Assembly of the ECSC in 1951 and the concomitant acquisition ofsupervisory powers vis-à-vis the quasi-executive High Authority; the delegation of budgetary powers following the signing of the Treaty of Luxembourg in 1970; and the delegation of legislative powers resulting from the adoption of the Single European Act signed in 1986. This is followed by the charting ofmore recent key developments, culminating in the adoption of the Constitutional Treaty in 2004.The book provides a welcome addition to the literature on institutional design by reflecting on the conditions under which governments opt for the creation and empowerment of parliamentary institutions in international politics. It also makes a valuable contribution to the application of democratic theory to the study of the European Union by demonstrating that political elites shared the view that the new supranational polity which emerged from the debris of World War II suffered from'democratic deficit' since its inception, thus disproving the claim that the lamented 'democratic deficit' is a recent phenomenon.
