Yet to date, most nation-states have been able to develop viable freshwater agreements to share this precious resource. Frederick D. Gordon examines how effective these accords are in sharing and redistributing water and whether they are sufficient to meet the increasing threat of water scarcity. Using an innovative ranking system, he assesses the significance of cooperation within both bilateral and multilateral accords, including the Israeli-Palestinian Interim Accords of 1993 1995, the Lesotho Highlands Water Treaty of 1986, and the 1994 Convention on Cooperation for the Protection and Sustainable Use of the River Danube. Gordon identifies central factors and stakeholders that are necessary for mitigating the risk of conflict and presents a template for understanding how state behavior can manage and sustain regional water resources. Continuing population growth and rapid development, coupled with environmental events such as droughts, have led to increasing water shortages in sections of the nation. In Interstate Water Compacts author Joseph F. Zimmerman highlights the growing importance of water issues within the United States and a device that has been instrumental in facilitating interstate cooperation to solve water-related problems: the interstate compact. This groundbreaking work is the first to devote itself exclusively to interstate and federal-interstate compacts pertaining to controversies including the abatement of water pollution, apportionment of river waters, economic development, flood control, inland fisheries, marine fisheries, and restoration to rivers of anadromous fish, such as salmon and shad. The process for entering into interstate and federal-interstate compacts is explained in detail, as is the exercise of original jurisdiction by the US Supreme Court to resolve intractable interstate controversies involving interpretation of provisions of compacts, water apportionment, and water pollution abatement. Zimmerman concludes by calling for the President, Congress, governors, state legislatures, and local governments to devote more attention and resources to finding solutions for water-related problems.

In each case, Elhance examines the basin's physical, economic, and political geography; the possibilities for acute conflict; and efforts to develop bilateral and multilateral agreements for sharing water resources. The case studies lead to some sobering conclusions about impediments to cooperation but also to some encouraging ones--among them, that it may not be possible for Third World states to solve their water problems by going to war, and that eventually even the strongest riparian states are compelled to seek cooperation with their weaker neighbors.

Freshwater resources are scarce and different nations, actors and users compete for limited resources in transboundary river basins; often conflicting with each other. Water is a resource with no substitute: it cannot be secured in sufficiently large quantities through long-distance trade deals; and, due to the interconnectivity of the hydrological system, the actions of one country in its water management have a direct bearing on the interests of neighbouring countries. For instance, in the Mekong River Basin, current hydropower and navigation developments in certain countries impact on traditional sources of income such as fisheries, and rice production in others. These kinds of changes in water use have given rise to conflict between countries in that region and others, but have also led, in some cases, to greater cooperation. The past few decades have seen a number of new agreements about the sharing of river resources and cooperation between riparian states. Negotiating for Water Resources explores the drivers of conflict and cooperation between states in transnational river basins. Drawing on extensive fieldwork and interviews on the Mekong, Danube and La Plata River Basins, the book provides a three level analysis across three case studies, including the regional framework (EU, ASEAN and Mercosur), the River Basin Organisations (ICPDR, MRC and CIC) and the micro-level. The key question of the book is: To what extent do power asymmetries prevent or inhibit cooperation between riparian states over water resources? This is linked to the question of how institutions contribute to mitigate competition for natural resources and how states interact in a multilateral arena. Overall, the book argues that cooperation in transboundary river basins is possible even where there are asymmetric power relations, challenging realist assumptions about competition and conflict over resources.

Book excerpt: At the UN General Assembly in 1997, an overwhelming majority of States voted for the adoption of the United Nations Convention on the Law of the Non-Navigational Uses of International Watercourses – a global overarching framework governing the rights and duties of States sharing freshwater systems. Globally, there are 263 internationally shared watersheds, which drain the territories of 145 countries and represent more than forty percent of the Earth's land surface. Hence, inter-State cooperation towards the sustainable management of transboundary water supplies, in accordance with applicable international legal instruments, is a topic of crucial importance, especially in the context of the current global water crisis. This volume provides an assessment of the role and relevance of the UN Watercourses Convention and describes and evaluates its entry into force as a key component of transboundary water governance. To date, the Convention still requires further contracting States before it can enter into force. The authors describe the drafting and negotiation of the Convention and its relationship to other multilateral environmental agreements. A series of case studies assess the role of the Convention at various levels: regional (European Union, East Africa, West Africa, Central Asia, Central America and South America), river basin (e.g. the Mekong and Congo) and national (e.g. Ethiopia and Mexico). The book concludes by proposing how future implementation might further strengthen international cooperation in the management of water resources, to promote biodiversity conservation as well as sustainable and equitable use.
