Book excerpt: The effective operation of devolution stands the best chance of success if both the UK and Welsh governments share knowledge and understanding, concludes the Welsh Affairs Committee in this report. The Committee makes a number of recommendations to improve the relationship between Wales and Whitehall. A broad review of how intergovernmental relationships are coordinated is required. The Joint Ministerial Committee should meet on a regular basis and ministers at all levels should be alert to the consequences of policy and legislation on devolved areas. The Cabinet Office should take lead responsibility for devolution strategy in Whitehall. Whitehall has lost a focus on the devolution settlement and too often has displayed poor knowledge and understanding of the specificities of the Welsh settlement. The Civil Service needs more consistent training and clear department-by-department focus on retaining devolution knowledge and understanding. The Welsh Assembly Government should have the confidence to interact with Whitehall and to promote areas of good practice. The Cabinet Secretary and the Permanent Secretary to the Welsh Assembly Government should give evidence annually to the Welsh Affairs Committee. Finally, reform of the Barnett Formula is required. The current financial settlement does not appear sustainable and a new arrangement needs to be built on an agreed and enduring basis which is demonstrably fair and sensitive to the particular circumstances of Wales.

Book excerpt: The current Advisory Committee on Business Appointments (ACoBA) lacks adequate powers and resources; does not have appropriate membership for its function; and should be abolished. Instead, the Committee says, Government should legislate to establish statutory ethics regulation with a code of conduct and enforceable statutory penalties, overseen by an independent ethics Commissioner. The new Commissioner would also take over the role of the Prime Minister's Adviser on Ministers' Interests - who advises on ministerial conduct. PASC also renews their call for the power to initiate investigations into the Ministerial Code on his or her own initiative. Enforceable statutory penalties should be introduced for failing to comply with the Commissioner's recommendations. Government reforms are implementing increasingly close working between public servants and the private and voluntary sectors. Changes to public service delivery - including the outsourcing of public sector functions and the active promotion of "interchange" between sectors-are blurring the boundaries between the public sector and other organisations. This could present greater opportunities for public officials to use their position for personal gain, and may give rise to public concern about the probity of former, and serving, public officials. The Committee says that ACoBA's procedures are "opaque" and not helpful to departing public officials who may need guidance about what appointments may be regarded as inappropriate for them to take up and does nothing to deter misleading and damaging mis-reporting of individual cases

However, some of the increase in whiplash claims will have been due to fraud or exaggeration. The Government must tighten up the requirements for motor insurance claims and ensure that insurers honour their commitment to reduce premiums. The Government should consider requiring claimants to provide proof that they have either been seen by a doctor or attended A&E shortly after the accident. The MPs also note that their previous recommendation on making the links between insurers and other parties involved with claims more transparent has been ignored. The absence of comprehensive statistics about road traffic accidents means that it is impossible to relate the increasing number of personal injury claims in recent years to the number of accidents. Data collection about road accidents needs to be improved help to assist detection of fraudulent personal injury claims and help highways authorities improve road safety by targeting spending on accident black-spots. The Committee also supports the proposal for an accreditation scheme for medical practitioners who provide medical reports in relation to whiplash claims. Access to justice could also be impaired by Government proposals to switch whiplash claims between £1,000 and £5,000 to the small claims court, particularly for people who do not feel confident to represent themselves against insurers who will use legal professionals to contest claims. Ways in which use of the small claims track could be combined with the routine submission of expert evidence should be considered

Building an entirely new hub airport east of London could not be done without huge public investment in new ground transport infrastructure, and there could be a substantial impact on wildlife habitat in the Thames estuary. The viability of an estuary hub airport would also require the closure of Heathrow - a course of action that would have unacceptable consequences. Adding new runways to expand a number of other existing airports will not, on its own, provide a long-term solution to the hub capacity problem. The report also rejects the notion of linking existing airports by high-speed rail to form a split-hub; the outcome from this would be highly uncompetitive in terms of passenger transfer times compared to competitor hubs overseas. Other recommendations cover: compensation for people affected by noise from expansion at Heathrow; a national strategy to improve road and rail access to major UK airports; ensure that the High Speed 2 (HS2) rail network serves Heathrow and develop dedicated rail services to serve Gatwick and Stansted; study how far Air Passenger Duty impacts on the UK economy; carry out an objective analysis of the impacts of introducing differential rates of Air Passenger Duty; promotion of airports in regions outside the south east and introduce an APD tax holiday for a 12-month trial period for new services from them.

The Committee also recommends, considering the decision to strip Fred Goodwin of his knighthood, that the Honours Forfeiture Committee be made independent and transparent, with clear and expanded criteria for forfeiture, chaired by an independent figure, such as a retired high court judge

Promoters of roads schemes must look to improve road safety (including for cyclists and pedestrians). The Government is seeking to accommodate increasing demand for roads by building more infrastructure rather than seeking to manage demand. Investment in the road network will require new funding streams, a challenge that must be addressed. However, a consensus would be required to introduce any road user charging scheme across the strategic road network as an alternative to road taxation.

Book excerpt: This report examines whether the Ministry of Defence's (MoD) governance and budgeting arrangements are fit for purpose and whether it understands the serious implications of reprioritising projects after committing to them. The Committee identifies the serious consequences of failings in the governance and budgetary processes. Even using the MoD' own, over-optimistic estimates the defence budget is unaffordable by some £6 billion. The exact size of the gap is dependent on the assumptions made about future funding, but the gap could easily be £36 billion. Intentional decisions to delay some projects have increased total procurement costs and represent economies of the short term and overall are poor value for money on the specific projects affected, the report said. The decisions were taken as part of a wider package to try to make the defence programme affordable over the next few years. They account for two thirds of the £1 billion of cost increases on projects in the last year. Crucially, they mean the Armed Forces will not get the operational benefits of new capabilities as quickly as expected. Decisions to delay projects, change requirements and reduce the numbers of equipments being procured adversely affect the MoD's ability to secure value for money from its commercial partners. The MoD is in the strongest negotiating position with industry before it places a contract. Slowing projects down once started almost inevitably increases their costs and takes pressure off contractors to become more efficient.
