It shall be the duty of the district attorney in any county of the state, when called upon by the commissioner or any of his assistants to render any legal assistance in his power to execute the laws, and to prosecute cases arising under the provisions of this act, and all fines and assessments collected in any prosecution begun or caused to be begun by said commissioner or his assistants shall be paid Into the state treasury. Section 6. With the consent of the governor, the state board of health may submit to the commissioner. Or to any of his assistants, samples of water or food or drink or drugs, for examination or analysis, and receive Special reports showing the results of such examinations or analysis. And the governor may also authorize the commissioner or his assistants, when not otherwise employed in the duties of their offices, to render such assist ance in the farmers' institutes, dairy and farmers' conventions, and the agricultural department of the university, as shall by the authorities be deemed advisable. Section 7. The salaries of the commissioner and his assistants shall be paid out of the state treasury in the same manner as the salaries of other officers are paid, and their official expenses shall be paid at the end of each calendar month upon bills duly itemized and approved by the gover nor, and the amount necessary to pay such salaries and expenses is hereby appropriated annually. Section 8. The commissioner may, under the direction of the gover nor, fit up a laboratory, with sufficient apparatus for making the analysis contemplated in this act, and for Such purpose the sum of fifteen hundred dollars, or so much thereof as may be necessary, is hereby appropriated, and for the purpose of providing materials, and for other necessary ex penses connected with the making of such analyses, there is also hereby appropriated so much as may be necessary, not exceeding six hundred dol lars annually. The appropriations provided for in this section shall be drawn from the state treasury upon the certificates of the governor. During the year beginning July 1, 1906. And ending June 30, 1907, the total expenses of the Dairy and Food Department were covered by a legis lative appropriation of together with received in fees collected from the registration of creameries, licensing of commercial feeding stuffs, etc. During the year beginning July 1, 1907, and ending June 30. 1908, the total expenses were being covered by a legislative appropriation of together with received in license fees as in the previous year. This appropriation has permitted of the employment, beside the regular office and laboratory force, of seven food inspectors and four dairy inspectors. This fund has also been drawn upon to pay the salaries of two additional laboratory assistants whose services have been required because of the extra work sent in to the laboratory. The rapid growth of this Department is shown from the fact that when I became its administrative head. January 15, 1905, the laboratory work was done entirely by the State Analyst without any assistance, his salary being At the present time the increased laboratory work of the De partment makes necessary aside from the State Analyst, the employment of four regular assistants throughout the entire year. The expense of maintenance of the laboratory for salaries alone is now per year. The expenses for laboratory equipment and other maintenance have like wise increased. Book excerpt: Excerpt from Sixteenth Annual Report of the Dairy and Food Commissioner of the State of Michigan: For the Year Ending June 30, 1909 The above statement shows an increase of over the amount available for the maintenance of the department during the previous year. This is practically the same amount represented by the item Fees collected for ice cream manufacturers' licenses. This amount was expended in the enforcement of the ice cream standard law passed by the legislature of 1909. This law is in conformity with the requirements of the State laws of most of the States. It differs from the national law in the fact that the butter fat requirement under the Michigan standard is whereas, under the national law the butterfat require ment is'14%. Inspectors reports in the department files Show that the passage of this law has resulted in raising the butterfat standard of ice cream in Michigan from an average of 9% to an average of 12 9-10 per cent. Reports from the manufacturers of ice cream further show that the raising of the standard of quality required has increased the volume of business. In other words, the putting into effect of this law has proven decidedly beneficial both to the consuming public and to the producers. Book excerpt: Excerpt from Twenty-Second Annual Report of the Dairy and Food Commissioner of the State of Michigan: For the Year Ending June 30, 1915 There were employed during the year on an average of eight regular food inspectors whose duties were to inspect stores, restaurants, hotels and other places where food is manufactured or stored. We have three dairy inspectors who inspect creameries and farm dairies. And two drug inspectors who inspect the drug stores of the State. During the year these inspectors have made inspections, being nearly more than we made last year without any handicaps. Of these, were food inspections, 809 were dairy inspections and were drug inspections, and 31 soft drink establishments were inspected under the new law. During the year I have had two practical and experienced experts in dairy and cheese making devoting their entire time to the inspection of butter and cheese factories and an additional expert of this character who is engaged in the educational work of showing dairies and cream eries of the State how to produce a better product in a more economical manner. Book excerpt: Excerpt from Twentieth Annual Report of the Dairy and Food Commissioner of the State of Michigan: For the Year Ending June 30, 1913 Sir: -In accordance with the provisions of the act creating the Dairy & Food Department I herewith transmit to you the report of the operations of this department in detail for the year ending July 1st, 1913. In transmitting this report it will be remembered that it includes six months under the administration of the present Commissioner and six months of the administration of my predecessor, Mr. Dame. In this connection I would suggest and recommend that the legislature in the future should change the time for the expiration of the term of Dairy & Food Commissioner so that the term of the Commissioner and the fiscal year will end at the same time. As the matter now stands while a Commissioner holds office for two years, his operations extend over three fiscal years and only one of those fiscal years is contained entirely within his term. It has sometimes happened in the past that the outgoing Commissioner has in the first six months of the fiscal year spent a very large proportion of the funds of the department leaving the new Commissioner with scant funds to carry on his operations for the first six months of his term. Thanks to my predecessor this did not happen during my term but it has happened several times in the past history of the department. It will be much more satisfactory to have the term of office of the Commissioner concurrent with the fiscal year and in that way each Commissioner would report upon his operations only and could use the funds to carry on his policies of administration without embarrassing his successor. FINANCES. The annual appropriation for the support of this department is $35,000 per year and in addition it derives certain revenues from the licensing of creameries, milk dealers, ire cream manufacturers and stock food manufacturers. During the past fiscal year about $10,000 was collected from these various sources giving the department an available fund for the fiscal year of $45,122.45. During the year there has been expended in the operations of the Dairy & Food Department a sum of $38,559.10, leaving a balance which was covered into the State Treasury at the end of the fiscal year of $6,563.35. The Drug Department is given a yearly appropriation of $6,000. Of this there was expended during the fiscal year $5,476.18 leaving a balance to be covered into the State Treasury of $523.82.
