Available in PDF, EPUB and Kindle. Book excerpt: The passage of Citizens United by the Supreme Court in 2010 sparked a renewed debate about campaign spending by large political action committees, or Super PACs. Its ruling said that it is okay for corporations and labor unions to spend as much as they want in advertising and other methods to convince people to vote for or against a candidate. This book provides a wide range of opinions on the issue. Includes primary and secondary sources from a variety of perspectives; eyewitnesses, scientific journals, government officials, and many others.

Four of the country's leading experts on campaign finance reform have contributed original essays on important facets of finance law and administration. The essays are accompanied by a list of corresponding documents available on the website. The book offers a thorough overview and analysis of this highly controversial issue, including the history of campaign finance regulation and the current state of the law, current practices and trends in the flow of money, the constitutional debate, the use of political party money, issue advocacy, public financing of presidential elections, implementing and enforcing campaign finance laws, and campaigning on the internet. The authors conclude with a broad overview of alternative approaches to reform. The related website (www.brookings.edu/campaignfinance) features sidebars that correspond to the book's chapters as well as associated documents. The site is frequently updated with recent developments in campaign finance regulation and analyses of current court cases and administrative decisions. There are also links to advisory opinions from the Federal Elections Commission, nonprofit organizations that study reform, and related publications-.

Available in PDF, EPUB and Kindle. Book excerpt: Corporate Political Activities Deskbook provides a thorough grounding in the current state of the law on federal and state campaign finance, pay-to-play, lobbying, and gift compliance. It serves as a practical manual for in-house attorneys who advise corporations about involvement in the political process. After describing the impact of the U.S. Supreme Court decisions in Citizens United--that began the expansion of permitted corporate speech in the political realm--and McCutcheon v. FEC--that expanded the exemption further, the book examines thoroughly the Federal Election Campaign Act (FECA) requirements, federal lobbying and gift rules, the Foreign Agents Registration Act, and practice and appearances before the FEC. The Deskbook includes an overview of state lobbying, gift, placement agent rules and pay-to-play rules as well as the federal pay-to-play rules (MSRB Rule G-37, SEC Rule 206(4)-5 and FINRA's proposed pay-to-play rule).Appendices include model documents, such as sample PAC bylaws, a PAC contribution card, a resolution for establishing a PAC, as well as a summary chart of the corporate, PAC and individual contribution limits in each of the 50 states.Corporate Political Activities Deskbook provides practical examples of best practices and "dos and don'ts." In many cases, the suggestions go beyond the black letter requirements to incorporate advice that can help corporations utilize the available avenues of interacting with the government while avoiding negative press, and public as well as legal regulatory attention.

Available in PDF, EPUB and Kindle. Book excerpt: The issues surrounding money in American elections are continually controversial. How much does money affect the outcome of elections? Do those who help finance candidates exert undue influence in the making of public policy? In this landmark book, one of America's most distinguished political scientists explores the dynamics and consequences of campaign finance in America and explodes many myths about this widely debated subject. Frank J. Sorauf provides balanced and informative commentary on such critical issues in campaign financing as: - the growing problems of regulating American campaign finance under the post-Watergate legislation of 1974; - the forces that affect the supply of money available for campaigning, from economic conditions to the competitiveness of elections; - the increasing power of incumbent candidates in the two-way exchange between candidates and contributors; - political learning and the search for ways to avoid the laws on campaign finance; - the myths and realities about the role and influence of PACs; - the vanishing funds for public funding of the presidential campaigns; - the new middlemen and brokers (e.g., the case of Charles Keating); - the major options for reform: private versus public funding; - the political deadlock over reform: parties, public opinion, and the interests of incumbents; - the possibility of new levels of competition and spending in 1992. Sorauf argues that the American system of campaign financing has become increasingly stable and institutionalized during the last sixteen years, and that the major players in the system--PACs, individual fund-raisers, party committees, and incumbent candidates--now behave in fairly predictable ways. His book is a fresh and persuasive account of the importance and the limits of money as a base of political influence in the United States.

Available in PDF, EPUB and Kindle. Book excerpt: Stifling Political Competition examines the history and array of laws, regulations, subsidies and programs that benefit the two major parties and discourage even the possibility of a serious challenge to the Democrat-Republican duopoly. The analysis synthesizes political science, economics and American history to demonstrate how the two-party system is the artificial creation of a network of laws, restrictions and subsidies that favor the Democrats and Republicans and cripple potential challenges. The American Founders, as it has been generally forgotten, distrusted political parties. Nowhere in the U.S. Constitution are parties mentioned, much less given legal protection or privilege. This provocative book traces how by the end of the Civil War the Republicans and Democrats had guaranteed their dominance and subsequently influenced a range of policies developed to protect the duopoly. For example, Bennett examines how the Federal Election Campaign Act of 1971 (as amended in 1974 and 1976), which was sold to the public as a nonpartisan act of good government reformism actually reinforced the dominance of the two parties. While focused primarily on the American experience, the book does consider the prevalence of two-party systems around the world (especially in emerging democracies) and the widespread contempt with which they are often viewed. The concluding chapter considers the potential of truly radical reform toward opening the field to vigorous, lively, contentious third-party candidacies that might finally offer alienated voters a choice, not an echo.
