Available in PDF, EPUB and Kindle. Book excerpt: Few areas of law practice cover as many issues as family law. The subject embraces marriage and divorce, annulment, custody of children, spousal and child support, complex property issues, paternity, domestic violence, adoption, and alternative means of reproduction. Each of these topics itself is complex. For example, within the broad subject of child custody lie the issues of interstate move away cases, international parental child abduction, and the impact of domestic violence on a parent's right to custody or visitation. In addition to purely legal issues, family law has a large psychological component, touching on some of the most important and sensitive aspects of human nature and interaction, such as, what is a family, what are the rights and responsibilities of parents toward children, and how should society respond to child abuse and domestic violence? All of these issues, and more, are discussed in this Nutshell. The book provides a thorough introduction to this challenging field of practice. As you prepare for the bar examination, check to see if family law is tested on the bar you intend to take. The Uniform Bar Exam tests family law. A number of state bar exams include family law. This book covers the family law topics you will encounter on the bar and in a family law course.

Family law is a dynamic part of the legal landscape and is ever evolving. It also intersects with other areas of law and involves many disciplines. An emerging theme in family law is that a thorough appreciation of social science research is essential. This book stands apart from others because it has a comprehensive chapter on social science which not only summarises the latest research but also analyses the case law to demonstrate how this research is used in family law decision-making. It also has a chapter touching on international family law, an area of increasing importance. The author team brings a unique blend of practice experience and academic expertise, to ensure this text will have a broad appeal to all readers. Students, academics, new practitioners, and also more experienced practitioners looking for a refresher, will all find Family Law Principles a useful resource.

Available in PDF, EPUB and Kindle. Book excerpt: Trade Secret Law is the first and only book in the Nutshell series to cover trade secret law in depth. It was written as a companion to Cases and Materials on Trade Secret Law by Rowe and Sandeen (the first casebook on trade secret law), but adds more practical advice. Thus, it is a useful resource for attorneys and law students alike. It could be a supplement to a course on trade secret law or an IP survey course that covers trade secret law, as most now do. Like the casebook, it focuses on the predominate law governing trade secrets in the U.S.: The Uniform Trade Secrets Act (now applicable in 47 of 50 states). Trade Secret Law in a Nutshell addresses both international and criminal enforcement of trade secret rights. In February of 2013, President Obama issued a report calling for increased enforcement of trade secret rights, both domestically and internationally, making the topic both current and relevant.

Available in PDF, EPUB and Kindle. Book excerpt: For many years family law was viewed as a study of the regulation of relationships of husband and wife and parent and child. Both relationships were clearly defined. In the case of husband and wife, it was through formal legal procedures or informal arrangements called marriage. In the case of parent and child it was either through biology or adoption. Equally defined were the stages by which these relationships were established, maintained, and terminated. By the close of the twentieth century, basic questions about who should be officially designated a family member and by what procedure were being raised both in the legislature and in litigation. In addition, conventional models that had defined domestic relations such as marriage, divorce, and adoption were either being expanded to include contemporary patterns of living arrangements and the current reality or new models were being constructed. In Family Law in America, Professor Sanford N. Katz examines the present state of family law in America. Themes include the tension between individual autonomy and governmental regulation in all aspects of family law, the extent to which relationships established before marriage are being regulated, and how marriage is being redefined to take into account equality of the sexes. It demonstrates how the definition of marriage as a partnership in which the individual spouse's rights are recognized has resulted in protection of the vulnerable spouse and examines fault and no-fault divorce procedures and the extent to which these procedures reflect social realities. This volume describes state intervention into the parent and child relationship and how this is reflected in the reexamination of the privacy of the family unit. It concludes with a discussion of the conventional model of adoption of children and how additional models are being developed to take into account new family forms.
