Book excerpt: Beginning with an exploration of the awful miscarriages which prompted the establishment of the Royal Commission on Criminal Justice, the authors examine the role played by institutions and legal factors within the criminal process. Tracking the shift from due process rhetoric to the 'new penology' of efficient risk management of suspect populations, they assess the impact of recent reforms such as curtailment of the right to silence; the removal of the right to jury trial; and the appeal process itself.

Available in PDF, EPUB and Kindle. Book excerpt: This Brief explores police misconduct, through the lens of a 5-year study of civil liability cases against the New York Police Department in Kings County (Brooklyn), New York. The confluence of police misconduct and civil liability is an issue of growing concern for many communities throughout the United States. One measure of the severity of these concerns is the increase in the number of lawsuits alleging police misconduct and the civil liability resulting from these lawsuits. Using Brooklyn, New York as a case study, the author of this Brief uses lawsuits that resulted in a settlement or jury award, over a five-year period, as its measure of police misconduct. Police misconduct has many tangible and intangible consequences for a community, such as violations of the law, police brutality, social consequences, and long-term public trust of the police. On a very practical level, as the author demonstrates, the up-front financial costs of prevention, training, and support to curb police misconduct are less expensive than the costs of civil liability payments for lawsuits. This perspective creates a strong argument for policymakers for enhancing police training and police misconduct prevention programs. This work will be of interest to researchers in police studies, as well sociology and public policy.

Available in PDF, EPUB and Kindle. Book excerpt: Federal, state, county, and municipal police forces all have their own codes of conduct, yet the ethics of being a police officer remain perplexing and are often difficult to apply in dynamic situations. The police misconduct statistics are staggering and indicate that excessive use of force comprises almost a quarter of misconduct cases, with sexual harassment, fraud/theft, and false arrest being the next most prevalent factors. The ethical issues and dilemmas in criminal justice also reach deep into the legal professions, the structure and administration of justice in society, and the personal characteristics of those in the criminal justice professions. The Encyclopedia of Criminal Justice Ethics includes A to Z entries by experts in the field that explore the scope of ethical decision making and behaviors within the spheres of criminal justice systems, including policing, corrections, courts, forensic science, and policy analysis and research. This two-volume set is available in both print and electronic formats. Features: Entries are authored and signed by experts in the field and conclude with references and further readings, as well as cross references to related entries that guide readers to the next steps in their research journeys. A Reader's Guide groups related entries by broad topic areas and themes, making it easy for readers to quickly identify related entries. A Chronology highlights the development of the field and places material into historical context; a Glossary defines key terms from the fields of law and ethics; and a Resource Guide provides lists of classic books, academic journals, websites and associations focused on criminal justice ethics. Reports and statistics from such sources as the FBI, the United Nations, and the International Criminal Court are included in an appendix. In the electronic version, the Reader's Guide, index, and cross references combine to provide effective search-and-browse capabilities. The Encyclopedia of Criminal Justice Ethics provides a general, non-technical yet comprehensive resource for students who wish to understand the complexities of criminal justice ethics.

Book excerpt: "Arrest-Proof Yourself will teach you everything you need to know about dirty cops, racial profiling, probable cause, search and seizure laws, your right to remain silent, and much more. This how-not-to guide will keep you safe and sound all year long." --Zink magazine What do you say if a cop pulls you over and asks to search your car? What if he gets up in your face and uses a racial slur? What if there's a roach in the ashtray? And what if your hot-headed teenage son is at the wheel? If you read this book, you'll know exactly what to do and say. More people than ever are getting arrested—usually for petty offenses against laws that rarely used to be enforced. And because arrest information is so easily available via the Internet, just one little arrest can disqualify you from jobs, financing, and education. This eye-opening book tells you everything you need to know about how cops operate, the little things that can get you in trouble, and how to stay free from the hungry jaws of the criminal justice system. It is now updated with new and important information on the right of the police to search your car; on guns, knives, and self-defense; and on changes in surveillance methods. Dale C. Carson was an FBI field agent, a SWAT sniper, an instructor at the FBI academy, and a Miami police officer who set Florida records for felony arrests. He is currently a criminal defense attorney. Wes Denham is the author of Arrested.
