Book excerpt: The radical changes taking place in the international scene during the late 1980s have presented the European Communities with important new challenges. The twelve Member States agreed that the only way to respond effectively to this new situation was to speed up the European integration process, and in December 1990 two Intergovernmental Conferences were inaugurated, focusing respectively on the development of an Economic and Monetary Union and a Political Union. It was the difficult task of the Luxembourg and Dutch Presidencies to channel the often very diverging positions of the different actors in the process into one coherent set of amendments to the Treaties forming the European Communities. This publication examines the positions which the different Member States, the Commission and the European Parliament have been defending in the Intergovernmental Conference on Political Union and more particularly with regard to one of the most sensitive topics under discussion, namely the development of a Common Foreign and Security Policy (CFSP). The introduction places the debate on the development of a Political Union and a CFSP in an historical perspective and gives an overview of the progression of the negotiations. The concluding chapter presents a general framework for better understanding of the course and results of the negotiations, and a critical evaluation of the outcome. The annexes reproduce the main proposals on the development of a CFSP submitted to the Conference.

Book excerpt: The European Union Intergovernmental Conference (IGC) opened on 23 July 2007 and was initiated following a report originally produced by the German Presidency on the "Treaty establishing a Constitution for Europe" (Constitutional Treaty, Cm.6429, ISBN 9780101642927), which in turn led to a "Draft IGC Mandate" setting out a detailed prescription on issues raised by the above report, circulated by the Presidency of the European Council. The report itself recommended a "Reform Treaty" which would amend existing treaties and so required an intergovernmental conference. The European Scrutiny Committee has set out a number of conclusions, including: the Committee questioned the aims of the European Council in engaging with EU citizens on the EU Constitution whilst setting out changes to the constitution in an essentially secretive manner; that the substance of the Reform Treaty is substantially equivalent to the Constitutional Treaty itself; the Committee is concerned about the UK's position under the Charter; that the UK retains opt-outs that were previously arranged under the Constitutional Treaty will still be retained under the Reform Treaty; that the proposals in the Reform Treaty raise a serious difficulty of a constitutional order, appearing to impose a legal duty on national parliaments to the European Union itself, the Committee calls such a legal duty on Parliament, objectionable, and states that as a matter of principle it should be resisted.

Book excerpt: This is the first comprehensive review of the Intergovernmental Committee (IGC) of the World Intellectual Property Organization (WIPO) established in 2000. It provides an in-depth consideration of the key thematic areas within WIPO discussions – genetic resources (GRs), traditional knowledge (TK) and traditional cultural expressions (TCEs) through the perspectives of a broad range of experts and stakeholders, including indigenous peoples and local communities. It also looks at how these areas have been treated in a number of forums and settings (including national systems and experiences, and also in trade agreements) and the interface with WIPO discussions. Furthermore, the book analyses the process and the negotiation dynamics since the IGC received a mandate from WIPO members, in 2009, to undertake formal text-based negotiations towards legal instruments for the protection of GR, TK and TCEs. While there has been some progress in these negotiations, important disagreements persist. If these are to be resolved, the adoption of these legal instruments would be a significant development towards resolving key gaps in the modern intellectual property system. In this regard, the book considers the future of the IGC and suggests options which could contribute towards achieving a consensual outcome.

Institutions, understood as rules of behaviour constraining and facilitating social interaction, are subject to different forms and processes of change. A change may be designed intentionally on a large scale and then be followed by a period of only incremental adjustments to new conditions. But institutions may also emerge as informal rules, persist for a long time and only be formalized later. Why? The causes, processes and outcomes of institutional change raise a number of conceptual, theoretical and empirical questions. While we know a lot about the creation of institutions, relatively little research has been conducted about their transformation once they have been put into place. Attention has focused on politically salient events of change, such as the Intergovernmental Conferences of Treaty reform. In focussing on such grand events, we overlook inconspicuous changes of European institutional rules that are occurring on a daily basis. Thus, the European Parliament has gradually acquired a right of investing individual Commissioners. This has never been an issue in the negotiations of formal treaty revisions. Or, the decision-making rule(s) under which the European Parliament participates in the legislative process have drastically changed over the last decades starting from a modest consultation ending up with codecision. The book discusses various theories accounting for long-term institutional change and explores them on the basis of five important institutional rules in the European Union. It proposes typical sequences of long-term institutional change and their theorization which hold for other contexts as well, if the number of actors and their goals are clearly defined, and interaction takes place under the "shadow of the future" .
