Book excerpt: The majority of the people who make up the United States' seasonal agricultural workforce are nonimmigrant Mexican citizens. Immigration policies such as the Immigration Reform and Control Act (IRCA) and the H-2A agricultural guest worker program were meant to encourage growers to employ legal labor workforces. A study of the laws and practices that eventually resulted in the H-2A program shows how and why the demographics are predominantly Mexican. In addition, such study is revealing as to why the US enacted the H-2A program-including definitional details of the program itself. However, does this program really work? This question has radically different answers. In theory, the program seems to be well designed; but, in practice, it does not function as intended because of its many shortcomings, loopholes, open-ended issues, and poor enforcement. I will analyze and demonstrate how these inadequacies perpetuate illegal immigration and exploitation of both legal and illegal seasonal agricultural farm workers. Lastly, I will offer a composite of recommendations for legislative reform of the H-2A program; as well as provide pertinent, resourceful questions for further research.

Book excerpt: In response to a congressional request, GAO reviewed the: (1) wage and nonwage protection that the Department of Labor's (DOL) regulations afford U.S. farmworkers under the H-2A Program, which allows for the admission of foreign agricultural workers; and (2) quality of the Department of Agriculture (USDA) surveys DOL used to set minimum wages and to certify a shortage of U.S. workers. GAO found that: (1) USDA never measured the precision of the annual hourly wage rate estimates that DOL used to set statewide minimum wages; (2) there may be unacceptably large error margins for at least three regions of the country; (3) the USDA surveys measured a general farm wage that was lower than the average U.S. wage for workers employed in the same crop activities as H-2A workers; and (4) the technical quality of the 15 wage surveys conducted during 1987 varied because of the inconsistent counting of undocumented workers, low response rates, unsystematically compiled employer lists, analytical miscalculations, inadequate survey quality indicators, poor interview schedule quality, and inadequate monitoring. GAO also found that: (1) since DOL determined the prevailing wage only with regard to the most common unit of payment, differing payment units could result in inaccuracies; (2) wage minimums based solely on prevailing wages would not grant relevant protections because the presence of foreign workers would depress the prevailing wages; (3) DOL set an adverse-effect wage rate as a minimum wage to offset wage depression and generally indexed it to a large-scale wage survey; and (4) because the legislative mandate was so broad, DOL could interpret adverse effect in several ways. In addition, GAO found that: (1) DOL practices provided weak protection for U.S. workers; (2) some growers preferred foreign workers because they could recruit more selectively; (3) DOL referred few U.S. workers at the wages and working conditions offered; and (4) government welfare and unemployment benefits were not a critical factor, since the potentially employable among those collecting the benefits constituted only a small part of the needed labor force.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. An economy in which agriculture once flourished was converted wholesale to an oil-based rentier state of the most extreme kind. Following the immediate post-revolution oil-consumption boom, in 2014 Libya's economy is in recession. Security is the greatest challenge to stability (World Bank 2014). Today, limited opportunities exist for reintegrating youth and ex-combatants into the labor market. This policy note provides an initial assessment of Libya's labor market and discusses policy options for promoting employability as part of a broader jobs strategy. It is intended as a contribution to evidence on Libya's labor market for the benefit of policy makers, civil society and the broader international community. The report finds that the overall unemployment rate in Libya increased from 13.5 percent in 2010 prior to the uprising to 19 percent as of 2012, having changed little since then. Youth unemployment stands at approximately 48 percent and female unemployment 25 percent. The vast majority (85 percent) of Libya's active labor force is employed in the public sector, a high rate even by regional standards. The rate for women is even higher (93 percent). Employment in industry (largely the oil sector) and agriculture accounts for only 10 percent of the labor force. While nearly all public sector workers are covered by some form of social insurance, only 46 percent of private sector workers are enrolled - a striking difference. The report further discusses the implications of Libyan jobseeker profiles. Thirty percent of firms have reported difficulty in recruiting qualified Libyan nationals. Only 15-30 percent of Libya’s labor force is relatively skilled and likely could be hired readily if given access to basic job training and job search assistance. For the remainder of the unemployed work force, targeted interventions would need to be designed for advanced skills development, vocational training, reconversion, and apprenticeship and entrepreneurship programs. The report discusses options for shifting Libya from a rentier state to a diversified, productive economy through economic and technical partnerships to help accelerate creating economic opportunities and jobs.

Merchants of Labor examines the businesses that move low-skilled workers over national borders, asking how much they collect from migrant workers and what can be done to reduce worker-paid migration costs. For-profit recruiters are likely to be an enduring feature of international labor migration, which makes developing tools to improve the management of their activities ever more crucial. The UN recognized in the Sustainable Development Goals for 2030 the need to measure what workers pay to get jobs in other countries with the goal of reducing worker-paid costs so that workers and their families can benefit more from international labor migration. Using cost data from over 3,000 workers, Merchants of Labor examines the often murky world of labor brokers, travel agents, and others who move low-skilled workers from one country to another in order to explore lower worker-paid migration costs. It explains the three core functions of labor markets-- recruitment, remuneration, and retention-- and shows how national borders increase recruitment costs. New data on what workers pay to get jobs in other countries are presented, and incentives to complement enforcement are explored as a way to induce recruiters to protect migrant workers.
