Available in PDF, EPUB and Kindle. Book excerpt: The practice of regulatory impact assessment has long needed a critical evaluation. This volume, which is interdisciplinary and international, and combines academic and practitioner insights, hits the spot to great effect. Colin Scott, UCD College of Business and Law and UCD School of Law, Ireland Better state regulation is a key component of economic reform. This is the first book to comprehensively explore international experience in the use of Regulatory Impact Assessment (RIA), which involves assessing the potential benefits and costs of any regulatory change. The contributors reveal that RIA is being adopted by an increasing number of countries as a route to better regulation with varying degrees of success. The book includes contributions from leading experts on regulatory reform and introduces a range of case studies from developed, developing and transitional economies. Comprehensive in its approach, this book contributes to the literature on evidence-based decision making as part of the new public management. By rigorously examining the principles of better regulation and focusing on the problem of applicability and adoption of RIA practices around the world, it will greatly aid understanding of regulatory policy design and implementation. The book will be invaluable for academics and researchers of public policy and management in developed, developing and transitional countries. It will also be of great practical relevance to government administrators and policymakers challenged by the need to understand the scope and limitations of RIA.

Available in PDF, EPUB and Kindle. Book excerpt: The European Union and its member states are investing in ambitious programmes for ‘better regulation’ and targets of regulatory quality. This book, available in paperback for the first time, lifts the veil of excessively optimistic propositions covering the whole better regulation agenda. It provides an innovative conceptual framework to handle the political complexity of regulatory governance. It approaches better regulation as an emerging public policy, with its own political context, actors, problems, rules of interaction, instruments, activities and impacts. Focusing on the key tools of impact assessment, consultation, simplification, and access to legislation, the authors provide fresh empirical evidence on the progress made in the member states and in Brussels, drawing on an extensive research project and an original survey of directors of better regulation programmes in Europe. Radaelli and De Francesco show how indicators define, measure, and appraise better regulation policy, linking measures to policy processes in which the stakeholders learn by monitoring. Although better regulation is a top priority for competitiveness in Europe and the legitimacy of EU policy, the level of commitment and the development of tools vary considerably. The major challenge for better regulation is institutionalisation - this calls for clear choices in terms of what the EU wants from better regulation. Essential reading for academics (political scientists, lawyers, and public economists) and policy-makers in charge of regulatory reforms in governments and international organisations.

Book excerpt: In March 2005, the European Commission issued a Communication designed to improve the EU regulatory environment in order to promote competition and trade and facilitate job creation. The Committee's report examines the proposals for better regulation, including the 'regulation tools' of impact assessment, simplification and consultation, the position of small and medium-sized enterprises (SMEs), the case for a new regulatory body to oversee regulation in the EU, the Inter-Institutional Agreement on Better Law-making and the role of Member States, the ambitions and activities of the UK presidency of the EU in this area. The Committee welcomes the initiatives and the attitudinal change that seems to be filtering through the Commission but highlights the need for full implementation and assessment; and also calls on the UK Government to ensure the issue is placed at the top of the EU political agenda.

Book excerpt: The importance of ex ante and ex post impact assessment in streamlining the regulatory environment and improving the legislative process has been stressed by scholars and testified to by international best practices. The potential benefits of regulatory impact assessment are also being rediscovered by EU officials, who lose no chance to recall that the Commission's ambitious "growth and jobs" strategy heavily depends on the pervasiveness of impact assessment in the regulatory process at EU and member state level. This study, conceived for scholars and policymakers, provides an overview of the state of the art on impact assessment. It focuses on the latest developments in the United States, UK, and EU, and presents a scorecard analysis of the Commission's extended impact assessments. The author concludes with a road map for improving the transparency, efficiency, and effectiveness of the EU Integrated Impact Assessment model.

This book was released on 2013-12-04 with total page 52 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Charity Commission is not regulating charities effectively and there is a gap between what the public expects of the Commission and what it actually does. The NAO has concluded that the Commission does not do enough to identify and tackle abuse of charitable status. Between 2007-08 and 2013-14, the Commission's annual budget fell 40 per cent in real terms to £22.7 million but the number of main registered charities has remained fairly constant at around 160,000. In response to budget cuts, the Commission has reviewed how it works and successfully reduced demand for its services, but it has not identified what budget it would need to regulate effectively. The Commission makes little use of its enforcement powers, for example suspending only two trustees and removing none in 2012-13. And it can be slow to act when investigating regulatory concerns. The NAO found cases where periods of several months passed during which the Commission took no action. Furthermore, the Charity Commission does not take tough enough action in some of the most serious regulatory cases. It is also reactive rather than proactive, making insufficient use of the information it holds to identify risk. The Charity Commission needs to think radically about alternative ways of meeting its objectives with constrained resources. It also needs to make greater use of its statutory powers in line with its objective of maintaining confidence in the sector; and develop an approach to identify and deal with those few trustees who deliberately abuse charitable status. This report publishes alongside another NAO report, the Cup Trust.

Available in PDF, EPUB and Kindle. Book excerpt: Regulation is often thought of as an activity that restricts behaviour and prevents the occurrence of certain undesirable activities, but the influence of regulation can also be enabling or facilitative, as when a market could potentially be chaotic if uncontrolled. This Handbook provides a clear and authoritative discussion of the major trends and issues in regulation over the last thirty years, together with an outline of prospective developments. It brings together contributions from leading scholars from a range of disciplines and countries. Each chapter offers a broad overview of key current issues and provides an analysis of different perspectives on those issues. Experiences in different jurisdictions and insights from various disciplines are drawn upon, and particular attention is paid to the challenges that are encountered when specific approaches are applied in practice. Contributors develop their own distinctive arguments relating to the central issues in regulation and apply scholarly rigour and clear writing to matters of high policy-relevance. The essays are original, accessible, and agenda-setting, and the Handbook will be essential reading both to students and researchers and to with regulatory and regulated professionals.

Available in PDF, EPUB and Kindle. Book excerpt: In most countries, parliament has the constitutional mandate to both oversee and hold government to account. In light of the increased focus on good governance, academics and legislative strengthening practitioners are re-examining parliament's oversight function with a view to increasing public financial accountability, curbing corruption, and contributing to poverty reduction. This volume brings together research from many different perspectives and many different legislative settings worldwide. As the country case studies in section III demonstrate, the accountability mechanisms or oversight tools available to the legislature vary based on constitutionally defined powers of the legislature, institutional arrangements between the branches of government, divisions of authority between national, regional, and local governments, the degree of legitimacy conferred on the legislature, and the resources available to it. The budget process provides critical opportunities. Section II of this volume is devoted to examining budget oversight from the formulation and approval of the budget, to implementation and the ex post examination of the public accounts. Special attention is also paid to mechanisms to assist parliaments such as Public Accounts Committees and independent parliamentary budget offices. This title will be of interest to parliamentarians and parliamentary staff, legislative strengthening practitioners, and students of legislative development.

Book excerpt: Developed under the Strategic Defence Review, and a key element in the Smart Acquisition reforms policy, the Through-Life Management approach to defence acquisition has been adopted by the Ministry of Defence in order to deliver a faster, and cheaper set of processes and systems for developing an efficient military capability. This report examines whether that capability has been delivered. Among a number of observations and recommendations, the NAO found that Through-Life had yet to become firmly established in the Department, and so yield its' benefits; that despite strong management support, no clear, consolidated strategy existed across the Department itself and that a plan had now been developed to push through the changes needed to implement the Through-Life Management approach more effectively in the Department.

Book excerpt: This report examines the effectiveness of Regulatory Impact Assessments (RIAs), which have been used by Government to assess the costs and benefits of individual policies, and establish a balance between under and over regulation. The Government produces over 200 RIAs per year, and the NAO examined 23 to identify good practice and their effectiveness in underpinning good policy decision-making. The three factors that make RIAs effective are: starting the process early; consulting effectively with those effected by the proposal; analyzing appropriately the likely costs and benefits. The NAO has set out 11 recommendations to making RIAs an effective policy tool, among them are: that any RIA process should be initiated as early as possible in the policy making process; that training and resourcing of RIAs should also be undertaken early; that departments should follow past practice when initiating new RIAs; that all RIAs should have a clear statement of objectives with a range of options to achieve the aims, and that RIAs should also include a detailed risk assessment.
