The we are preparatory work that was done has been most valuable. Equally delighted that the series is launched with the encouragement and backing of both the Research Committee on Sociology of Law of the International Sociological Association and the Institute of Sociology of Law for Europe. Indeed the current activities of the Research Committee and the recent establishment of the Institute, together with this series of Yearbooks, permit optimism that work in this field in Europe will progress and develop as never before. Whether this will happen does depend however, quite simply, on the nature of the research and writing that follows and the quality of work accomplished.

It aims to provide a forum for in-depth analysis and discussion of new developments in the field, both in Europe and beyond. This fourth volume of the EYCL addresses the underexplored and contentious topic of whether the EU possesses a constitutional identity of its own. To date, the main focus of scholarship and case law concerns the constitutional identities of the Member States of the EU. This is because the EU has to respect such identities according to article 4(2) TEU. The attention for Member States’ constitutional identities stands in stark contrast to the notion of an EU constitutional identity. Such an identity features very little in the literature and debate on constitutional identity and the legal architecture of the EU. Consequently, this edition of the EYCL addresses the gap in legal research by studying constitutional identity with a focus on the EU itself. The book explores various views on whether the EU possesses such an identity and what any possible identity might entail. Law has to be seen today not just as the law of the nation state, or international law that links nation states, but also as transnational law in many forms. The book suggests that the social environment in which law operates must also be rethought, with many implications for comparative legal studies. Law, Lawyers and Race: Critical Race Theory from the United States to Europe endeavours to fill this gap by providing an overview of the definition and consequences of CRT developed in American scholarship and describing its transplantation and application in the continental European context. The CRT approach adopted in this book illustrates the reasons why the relationship between race and law in European civil law jurisdictions is far from anodyne. Law plays a critical role in the construction, subordination and discrimination against racial minorities in Europe, making it comparable, albeit in slightly different ways, to the American experience of racial discrimination. Anti-Semitism, Islamophobia, anti-Roma and anti-Black racism constitute a fundamental factor, often tacitly accepted, in the relationship between law and race in Europe. Consequently, the broadly shared anti-race and anti-racist position is problematic because it acts to the detriment of victims of racism while privileging the White, Christian, male majority.
