Available in PDF, EPUB and Kindle. Book excerpt: Has globalization forever undermined the state as the mighty guarantor of public welfare and security? In the 1990s, the prevailing and even hopeful view was that it had. The euphoria did not last long. Today the "return of the state" is increasingly being discussed as a desirable reality. This book is the first to bring together a group of prominent scholars from comparative politics, international relations, and sociology to systematically reassess--through a historical lens that moves beyond the standard focus on the West--state-society relations and state power at the dawn of the twenty-first century. The contributors examine the sources and forms of state power in light of a range of welfare and security needs in order to tell us what states can do today. They assess the extent to which international social forces affect states, and the capacity of states to adapt in specific issue areas. Their striking conclusion is that states have continued to be pivotal in diverse areas such as nationalism, national security, multiculturalism, taxation, and industrial relations. Offering rich insights on the changing contours of state power, The Nation-State in Question will be of interest to social scientists, students, and policymakers alike. John Hall's introduction is followed by chapters by Peter Baldwin, John Campbell, Francesco Duina, Grzegorz Ekiert, Jeffrey Herbst, Christopher Hood, Anatoly Khazanov, Brendan O'Leary, T. V. Paul, Bernard Yack, Rudra Sil, and Minxin Pei. The conclusion is by John Ikenberry.

Available in PDF, EPUB and Kindle. Book excerpt: This book deals with banking integrations, which are now becoming crucial not only because of the increased number of economic integrations, but also in view of the qualitative improvement of such banking integrations. It compares the European Union (EU), as the most successful union, which was able to move from a common financial market to the prime example of banking integration; the Banking Union; and the Eurasian Economic Union (EAEU) as a relatively young one but with several of the prerequisites for becoming an influential union, and which was established by five countries – the Russian Federation, Kazakhstan, Belarus, Armenia, and the Kyrgyz Republic – in 2015. The key research question is whether the single market in banking services or a banking union is an achievable goal or merely a utopia. In this regard, the book reveals the bottlenecks and obstacles that the EU and EAEU policymakers faced during the difficult process of establishing a single market and banking union. However, along with the problems of banking integration, it identifies many peculiarities of the harmonization of banking legislation among the EU Member States. Recognizing and acknowledging these peculiarities can be very beneficial for young unions and help to guide their integration processes. In particular, the book concludes that evolutionary (not revolutionary) harmonization is required in order for the EAEU to become a full-fledged union.

Available in PDF, EPUB and Kindle. Book excerpt: This book offers a compelling new interpretation of the proliferation of regional trade agreements (RTAs) at the end of the twentieth century. Challenging the widespread assumption that RTAs should be seen as fundamentally similar economic initiatives to pursue free trade, Francesco Duina proposes that the world is reorganizing itself into regions that are highly distinctive and enduring. With evidence from Europe, North America, and South America, he challenges our understanding of globalization, the nature of markets, and the spread of neoliberalism. The pursuit of free trade is a profoundly social process and, as such, a unique endeavor wherever it takes place. In an unprecedented comparative analysis, the book offers striking evidence of differences in the legal architectures erected to standardize the worldview of market participants and the reaction of key societal organizations--interest groups, businesses, and national administrations--to a broader marketplace. The author gives special attention to developments in three key areas of economic life: women in the workplace, the dairy industry, and labor rights. With its bold and original approach and its impressive range of data, The Social Construction of Free Trade represents a major advance in the growing fields of economic sociology and comparative regional integration.

Available in PDF, EPUB and Kindle. Book excerpt: Class action and other group litigation procedures are increasingly being adopted in jurisdictions throughout the world, as more countries deal with the realities of increased globalization and access to information. As a result, attorneys and their clients face the ever-expanding prospect of a class or group action outside their home jurisdictions. World Class Actions: A Guide to Group and Representative Actions around the Globe is a guide for attorneys and their clients on the procedures available for class, group, and representative actions throughout the world. It helps lawyers navigate and develop strategies for litigation and risk management in the course of doing business abroad, or even in doing business locally in a way that impacts interests abroad. Part I of the book provides a jurisdiction-by-jurisdiction survey of the class action, group, collective, derivative, and other representative action procedures available across the globe. Each chapter is written from a local perspective, by an attorney familiar with the laws, best practices, legal climate, and culture of the jurisdiction. Part II provides guidance from the perspective of international attorneys practicing in foreign jurisdictions and the art of counseling and representing clients in international litigation. It also covers a variety of topics related to transnational, multi-jurisdictional, and class or collective actions that involve international issues and interests. Each chapter offers practice tips and cultural insights helpful to an attorney or litigant facing a dispute in a particular part of the world. Many of the chapters introduce key books, treatises, articles, or other reference materials to foster further research. Its focus on international class and group litigation law from a practitioner's perspective makes World Class Actions an essential guide for the lawyer or client.

Available in PDF, EPUB and Kindle. Book excerpt: Marital rape stands at the intersection of the socio-legal issues arising from both domestic violence and sexual assault. For centuries, women who suffered sexual assault perpetrated by their spouses had no legal recourse. A man's conjugal rights included his right to have sexual intercourse with his wife regardless of whether she consented. This right has been recognised in law, and still is in some jurisdictions today. This book emerges from the research undertaken by an innovative, multi-country, academic, collaborative project dedicated to comparatively analysing the legal treatment of sexual assault in intimate relationships, with a view to challenging the legal impunity for and inadequate legal responses to this form of gendered violence.

Book excerpt: A compelling new history of the EU and the people who sought to shape and challenge it--from Maastricht to today The European Union is the most ambitious, and one of the most contentious, international organizations ever created. Decisions made in Brussels shape the lives of over 500 million Europeans, and its laws and policies resonate around the world. But how has the EU endured over three turbulent decades marred by crises at home and abroad? In this major account, Dermot Hodson traces the development of the EU from its establishment in 1993 through to Brexit, Covid-19, and the invasion of Ukraine. Hodson shows how the union has been held together not by faceless technocrats but national leaders who stood together in times of turmoil despite a fierce backlash from a new generation of right-wing populists. Circle of Stars offers a rich appraisal of Europe's troubled past and turbulent present--focusing on the people who built the EU as we know it today.

Available in PDF, EPUB and Kindle. Book excerpt: Where products develop ever more rapidly, the law may face difficulties in responding accordingly to new security threats which may arise. In the field of product liability, an extraordinary need for legal development has thus been perceived, with legislators and judges feeling compelled to find new solutions and to look across borders for these. In the detailed reports in this book, the World Tort Law Society proves that it is in an ideal position to examine the most significant concepts. The report on North America studies the special regime for product liability from its origin in the case law of the US; the European report is centred around the EU Product Liability Directive with its merits and faults; and the influence of these two systems as well as new answers are shown in the reports on Asia, Russia and four key jurisdictions in the rest of the world. Similar questions are discussed worldwide: How can a strict liability regime for products be justified, and can it be justified in all cases? How does the special regime relate to general rules of tort law? Should services be subject to a similar regime? The Members of the Society seek to provoke thought for solutions to these pervasive problems. In this spirit, the volume’s comparative conclusions invite discussion, and the book includes four responses to that call from eminent tort lawyers from different legal backgrounds.
