Book excerpt: The situation in Bosnia has increasingly deteriorated to such an extent that the current political atmosphere is, according to some observers, as tense and dangerous as before the war. Political deadlock is preventing progress on any substantive issues; there are renewed threats about dissolving the state; and Republika Srpska is officially defying the authority of the Office of the High Representative (OHR). The author analyses the legitimacy of past OHR decisions and, given the ongoing political problems in Bosnia, recommends that the Bonn Powers be retained by the OHR or the EU Special Representative, but with caveats. That is, that the Bonn Powers ought only be used to uphold the objectives justified under the Dayton Agreement: the preservation of peace, the promotion of the democratic process, and the protection of human rights.

Book excerpt: The subject of this dissertation is the analysis of the democratization process in Bosnia and Herzegovina (BiH), following the Dayton Agreement in 1995. How and to what degree can the democratization process in BiH be discussed in light of existing democratization theories? Using theoretical democratization approaches to identify independent variables that influence the democratization process in BiH, the focus is on a full set of political institutions and institutional designs that are usually alleged to be important preconditions for the consolidation of democracy. Within this framework, the question of statehood, the constitution-making procedure and the resulting institutional framework, and the role of international actors in the BiH context are highlighted. Finally, emphasizing the influence of international factors, such as the role of the EU in the democratization process in post-communist Europe, the EU's influence on this process in BiH is closely examined. The book examines the existing democratic structures and processes in BiH with the model of "consociational democracy" as a specific type of democracy. To describe his new role as extremely difficult would by no means be overstating the task at hand. Fourteen years after the General Framework Agreement for Peace in Bosnia and Herzegovina, better known as the Dayton Peace Agreement (DPA), brought the Bosnian war to an end, the country's latest political deadlock has demonstrated that domestic politics still needs to be underpinned by the presence of the HR and, more broadly, the support of the international community, ideally with the European Union (EU) in concert with a firmly engaged United States.

Book excerpt: The Dayton Peace Agreement on Bosnia successfully ended the war in late 1995. However, the price for peace was an extremely weak and dysfunctional postwar state that would probably not have survived without substantial international support over the following decade. This paper argues that things have begun to visibly change on the ground in Bosnia and Herzegovina (BiH) only with the emergence of the EU as the main international peacebuilding actor in more recent years, and notably since 2003. The EU's increased peacebuilding role in BiH, carried out within the framework of the European Security Strategy, has allowed for critical progress towards making Bosnia's common state institutions increasingly self-sustaining. There is no doubt that the potential does now exist to turn postwar Bosnia into a sustainable multi-ethnic democracy. The central hypothesis developed in this paper is that since 2003 EU conditionality has increasingly become a viable alternative to international trusteeship in BiH. This is because conditionality has begun to be assertively communicated by the 'double-hatted' High Representative/European Union Special Representative (HR/EUSR) on the ground and is now clearly linked to the perspective of EU membership. There is evidence that difficult political, administrative and economic reforms have been recently adopted by BiH authorities in compliance with EU conditionality, crucially without straightforward international imposition. But this paper also argues that EU peacebuilders need to further improve their strategic effectiveness and political coordination on the ground, to support continuing reform in BiH once the Office of the High Representative (OHR) is closed down, possibly by late 2007.
