Book excerpt: This report follows up some of the proposals made in a previous Committee report (HCP 152-xxxiii-I, session 2001-02; ISBN 0215003829) on the subject of EU democracy and accountability. It also highlights the more significant proposals in the draft treaty articles produced by the Convention on the Future of Europe. Conclusions reached include: support for the provision that the Council of Ministers should meet in public when dealing with legislation and a full transcript of debates be made publicly available; the protocol on subsidiarity and proportionality needs to be strengthened by four measures in order to ensure the full involvement of national parliaments; that national parliamentarians should have voting rights in the election of any Commission President; and that, because the Convention is not a representative body, its recommendations will need to be carefully considered by national parliaments and governments well before the Inter-Governmental Conference in 2004.

Book excerpt: The Committee's report examines the report of the Working Group of the Convention on the Future of Europe and the draft Treaty Articles derived from it relating to criminal justice matters. Their report notes concern about the way these far-reaching and controversial proposals for change were made on the basis of such a narrow range of evidence. It focuses on four main issues, regarding the role of national parliaments; the harmonisation of the criminal procedure and of substantive criminal law; the jurisdiction of the European Court of Justice; and the proposed post of European Public Prosecutor. Overall, the Committee concludes that the European Parliament is not sufficiently close to the public to secure democratic legitimacy in the sensitive area of criminal justice, and any substantial increase in its power at the expense of national parliaments cannot be justified. Any harmonisation of criminal law and procedure should proceed with the agreement of all member states or not at all.

Book excerpt: When the Committee published the Scrutiny Reform Report 18 months ago asked the Government to ensure that it responded to the Report within the customary two-month deadline. This did not happen, the Government response was received on the day the House rose for the summer recess, 22 July 2014, eight months after the Report's publication. Moreover, the tone of the Government's response to the key recommendations was overwhelmingly negative and did not sufficiently address our proposals, including those relating to the introduction of a form of national veto and the disapplication of EU law. In this Report the Committee first consider in more detail the background to, possible causes of and the implications of the Government's failure to schedule EU document debates, before turning to some of the other outstanding issues covered in the Scrutiny Reform Report, in particular papers deposit, limitâ documents, and the coverage of EU scrutiny and wider EU issues by the BBC. The Committee also sets out some outstanding scrutiny issues which the successor Committee may wish to consider, in particular scrutiny of the proposed EU-US Transatlantic Trade and Investment Partnership.
