It is based on Recommendation Rec(2008)11 of the Committee of Ministers of the Council of Europe on the European Rules for juvenile offenders subject to sanctions or measures, which was adopted on 5 November 2008. The first part of the book contains the text of the recommendation and is followed by a commentary which explains in finer detail the rules and the points raised by the text. The final section provides an analysis of the national replies to a questionnaire related to the treatment of juvenile offenders. This book explores its development and analyses the penological and human rights foundations on which it is based. It examines the findings of the European Committee for the Prevention of Torture, the recommendations of the Council of Europe, and the judgments of the European Court of Human Rights. From these sources it makes the general principles that underlie European prison law and policy explicit, emphasising the principle of using imprisonment as a last resort and the recognition of prisoners' rights. The book then moves on to apply these principles to conditions of imprisonment, regimes in prison, contacts between prisoners and the outside world, and the maintenance of good order in prisons. The final chapter of the book considers how European prison law and policy could best be advanced in future. The authors argue that the European Court of Human Rights should adopt a more proactive approach to ensuring that imprisonment is used only as a last resort, and that a more radical interpretation of the existing provisions of the European Convention on Human Rights will allow it to do so. It concludes that the growing cooperation on prison matters within Europe bodes well for the increased recognition of prisoners' rights across Europe. In spite of some countervailing voices, Europe should increasingly be able to give an international lead in a human rights approach to prison law and policy in the same way it has done with the abolition of the death penalty.

Our authors have contributed articles on migration, employment mobility, new familial relations, the Internet and new media, young people’s social and political engagement, their connections with their own countries, with Europe or the wider world, and intercultural contacts in general, and others besides. They address the potential benefts but also the tensions and contradictions that are inherent in contemporary social, cultural, economic and technological changes. Such changes are creating opportunities for young people to connect in new and positive ways with other young people, with their families and communities and with social institutions, in ways that increasingly “cross borders” of various kinds. But it is also clear that these changes do not always take place in a smooth or mutually complementary way: expanded opportunities are not necessarily enhanced opportunities; increased participation in education has not translated into more and better employment prospects; societies and communities are increasingly diverse and yet some perceive this as a threat rather than an opportunity. A related question arises as to whether the policies that are designed both to shape and respond to young people’s circumstances and the resulting practices are themselves appropriately connected or disconnected with each other. Perspectives on youth is published by the partnership of the European Union and the Council of Europe in the feld of youth with the support of fve countries: Belgium, Finland, France, Germany and the United Kingdom. Its purpose is to bring national youth policies closer together and to keep the dialogue on key problems of child and youth policy on a solid foundation in terms of content, expertise and politics. It entered into force in February 1989 and all 47 member States are Parties to the Convention. The Convention has already established itself as an important human rights instrument. Its approach is quite different from that of the European Convention on Human Rights. Whereas the ECHR provides a remedy for particular human rights violations after the event, the Convention for the Prevention of Torture (ECPT) seeks to prevent human rights violations, through a system of visits to places of detention.
