Book excerpt: Examining the EU's promotion of human rights for lesbian, gay, bisexual, trans+ and intersex (LGBTI) persons in Uganda during the period of 2009 to 2017, this book investigates how a public administration defines and deals with a wicked problem. The empirical puzzle of how the topic of human rights for LGBTI persons, despite its highly contested nature, travelled between Brussels and Kampala, became codified in form of LGBTI Guidelines (2013) and institutionalized within EU foreign policy is addressed as one of translation and sensemaking. The investigation focuses on the process of problem definition in everyday practice by EU staff and EU member states’ staff in Brussels and Kampala. This book therefore provides key insights into how public administrations deal with wicked problems, how contested ideas can become institutionalized and how an idea is translated and made sense of across time, levels and cultural boundaries. The findings are of interest especially to scholars of wicked problems, sociological new institutionalism and public administration as well as international relations and EU studies, human rights, gender and sexuality studies.

Lesbian, Gay, Bisexual, Transgender, and Intersex rights are heavily contested across the globe, with over 70 countries criminalizing same-sex relations and at least 10 imposing the death penalty. The book details how the EU, based on different member state positions, attempts to jointly formulate and implement guidelines for the external promotion of LGBTI rights. It also problematizes the various normative and policy-based Eurocentric prescriptions to further these rights. Drawing on an international political sociology framework infused with queer theoretical thought, the author investigates the apparent normative tensions emerging from Europe’s promotion of LGBTI rights as liberal human rights and the ensuing pushback by culturally and politically conservative states. He examines the compatibility of EU institutional and member states’ conceptions of LGBTI rights and the more general question of the EU’s normative agenda-setting power on the world stage. He then explores the external policy areas in which LGBTI rights promotion is formulated and diffused – namely in development and foreign aid, in enlargement and neighbourhood policies, and in other international organizations. In conclusion, the author suggests viewing the contention surrounding LGBTI rights within broader governance contexts, and thus reimagining rights promotion in a more holistic manner. Book excerpt: In the past decade, protection of the human rights of LGBTI persons has taken centre stage in the debate about protection and promotion of human rights internationally. This development at the international level has had its vibrations felt at the African regional level and also within domestic country settings. Uganda has been one of the watershed nations in this debate especially with the discussion of its Anti- Homosexuality Bill, 2009 which proposed the death penalty for what was referred to as aggravated homosexuality, and other serious punishments for homosexuality and promotion of homosexuality. Unlike the rights of other minorities and other marginalised groups, LGBTI rights are regarded as overly controversial, with many states regarding the issue as one of morality rather than one of human rights. This controversy still subsists and is yet to be resolved. The dominant legal argument that arises from the group opposed to the recognition and protection of LGBTI rights in Uganda is the legal positivist argument that the text of the law does not cover LGBTI rights. This argument is used both in domestic and international settings. This booklet intends to squarely address this issue. It examines the domestic law in Uganda, the East African sub regional instruments, the African regional instruments and the UN instruments that Uganda is party to, to conclude that indeed LGBTI rights are protected by the laws of Uganda. The booklet will act as a one-stop source for the legal standards applicable to Uganda on LGBTI rights at the domestic, sub regional, regional and international levels.

Book excerpt: Between 2009 and 2014, an anti-homosexuality law circulating in the Ugandan parliament came to be the focus of a global conversation about queer rights. The law attracted attention for the draconian nature of its provisions and for the involvement of US evangelical Christian activists who were said to have lobbied for its passage. Focusing on the Ugandan case, this book seeks to understand the encounters and entanglements across geopolitical divides that produce and contest contemporary queerphobias. It investigates the impact and memory of the colonial encounter on the politics of sexuality, the politics of religiosity of different Christian denominations, and the political economy of contemporary homophobic moral panics. In addition, Out of Time places the Ugandan experience in conversation with contemporaneous developments in India and Britain--three locations that are yoked together by the experience of British imperialism and its afterlives. Intervening in a queer theoretical literature on temporality, Rahul Rao argues that time and space matter differently in the queer politics of postcolonial countries. By employing an intersectional analysis and drawing on a range of sources, Rao offers an original interpretation of why queerness mutates to become a metonym for categories such as nationality, religiosity, race, class, and caste. The book argues that these mutations reveal the deep grammars forged in the violence that founds and reproduces the social institutions in which queer difference struggles to make space for itself.
