Book excerpt: Migration has become an increasingly important phenomenon for European societies. Patterns of migration flows can change greatly over time, with the size and composition of migrant populations reflecting both current and historical patterns of migration flows. Combined with the complexity and long-term nature of the migrant integration process, this can present challenges to policy-makers who need good quality information on which to base decisions. It is important that the statistics should go beyond the basic demographic characteristics of migrants and present a wider range of socio-economic information on migrants and their descendants. This publication looks at a broad range of characteristics of migrants living in the European Union and EFTA countries. It looks separately at the foreign-born, the foreign citizens, and the second generation. It addresses a variety of aspects of the socio-economic situation of migrants including labour market situation, income distribution, and poverty. The effects of different migration-related factors (i.e. reason of migration, length of residence) are examined. The situation of migrants is compared to that of the non-migrant reference population.

Available in PDF, EPUB and Kindle. Book excerpt: This thought-provoking collection analyses the European Community's external relations between 1957 and 1992, with a particular focus upon their broader impact and global significance. Reconceptualizing the long arc of the EC's international role, from its inception in the 1950s to the end of the Cold War, the chapters identify and assess the factors that either supported or impeded Europe's international projection within this period. Organized into three parts, the authors investigate the EC's relations with key countries and world regions, discuss its activities within key policy areas, and offer reflections and conclusions on the various arguments that are put forward. Each chapter considers the entire period from 1957-1992 to identify and explain overarching trends, key decisions and historical conjunctions through scholarly literature, key debates and original discussion of each topic or policy issue. A final chapter situates the main findings within wider contexts, situating the EC in Cold War history. Bringing together international history and international relations, this project allows for cross-disciplinary dialogue and the careful discussion of key concepts, analytical approaches, and empirical findings. Filling a gap in our understanding of the early development of the EC's role as an autonomous global actor, this book holds important messages for the modern day, as the EU's position in global politics continues to shape the world.

Book excerpt: This volume suggests new, theoretically informed approaches for historians and social scientists to engage with the policy of enlargement – across rounds and in all its diversity. It follows three approaches: first tracing Longue Durée developments; second, investigating enlargement Beyond the Road to Membership; and third, exploring the Entangled Exchanges and synergies between the EC/EU and its outside. It attempts to properly historicise the process of enlargement with contributions from historians, social scientists and a legal scholar exemplifying suggested approaches and theoretical reflections from the various disciplines.

Available in PDF, EPUB and Kindle. Book excerpt: This book comprises a set of papers that were prepared for and delivered at the Global Competition Law Centre's Annual Conference "Modernisation and Enlargement: Two Major Challenges for EC Competition Law". The book presents an analysis of the new Regulation 1/2003 on the implementation of the competition rules laid down in Article 81 and 82 of the Treaty. This new Regulation represents a cultural revolution for EC competition lawyers, who were accustomed to notifying agreements in order to obtain some legal certainty for their clients. Modernisation opens up a brand new world where corporations and their lawyers will be asked to self-assess the validity of their agreements under EC competition law. The direct effect given to Article 81(3) will also stimulate implementation at the national level, including actions in national courts, although several procedural issues may impede private actions in courts. Amongc its other features, Regulation 1/2003 also creates a European Competition Network (ECN), which provides an institutional focus for cooperation between the NCAs and the Commission, as well as among the NCAs themselves. Enlargement of the European Union was one of the factors, which contributed to the adoption of Regulation 1/2003. Enlargement will expand the geographical scope of application of EC competition rules, but it will also create many important challenges. The NCAs of the new Member States are relatively new organisations, which in some cases lack the expertise and resources to pursue a credible enforcement agenda. These Member States are, however, willing to take on those challenges and, though a period of adaptation will be needed, there are no reasons why they should be unable to progressively develop a successful competition policy. Already, some agencies (e.g., in Hungary or Poland) have developed a credible enforcement record. This book is invaluable for all EU competition lawyers.

Available in PDF, EPUB and Kindle. Book excerpt: Discrimination is an incongruity in the contemporary EC. Then, the author provides an in-depth analysis of two of the post-Maastricht developments in the context of free movement: the establishment of the status of Union citizenship by the Treaty of Maastricht in 1993 and the development of that status through the Court's recent jurisprudence; and the formal completion of the internal market in 1993, as required by the provisions inserted into the EC Treaty by the Single European Act. Focusing on the central issue of whether reverse discrimination is - and should remain - outside the scope of EC law, the author explains what has been the impact of each of these developments on the question of the permissibility of reverse discrimination in EC law. A brief discussion of the available solutions to the problem and their advantages and disadvantages concludes the presentation. This is a ground-breaking study in an area of European law that has received scant academic attention so far and is just beginning to be explored. In it, scholars, policymakers and practitioners will discover a firm foundation from which to pursue and ultimately define the limits of reverse discrimination in EC law.

This book was released on 1999-01-01 with total page 231 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents an analysis of the recent development of administrative procedures in EC law. It is a pathbreaking study of what might be termed the “constitutionalising norms” now emerging, including a range of 'process rights' and procedural standards, such as the right to access to information, the right to be heard, the principle of care and duty to state reasons. These new standards are increasingly applied in areas as diverse as competition, State aids, customs matters, anti-dumping and the European Social Fund. Different strands of case-law of the EC courts are thus connected to document the overall evolution of procedural rules peculiar to the EC administrative system as a whole. The author adopts a critical stance, in particular, towards the case-law of the Court of First Instance and points out the increasing pressure being brought to bear on the European Commission in respect of its procedural requirements. Particular emphasis is placed on the concept of 'care', i.e. the duty to collect and examine the factual and legal points of individual cases impartially and carefully. The book reveals both the theoretical and practical relevance of this principle as a means of both procedural and substantive review and the reasons why it is likely to be misinterpreted by the courts.
