Book excerpt: Estate and tax planning attorneys face unique ethical challenges when representing non-traditional couples (i.e., elder couples who do not marry, homosexual couples, etc.). Currently, there are four recognized ethical theories concerning the legal representation of individuals: individual representation; joint representation; intermediary representation; and family representation. The position endorsed by this paper is that the first three ethical theories of legal representation reinforce the primacy of the individual. By contrast, family representation embraces and supports an entity theory of ethical behavior (similar to ethical theories for corporate representation). The conclusion is that family representation offers estate and tax planning attorneys the most appropriate standard for ethical behavior in their representation of non-traditional couples. The paper then explains how the theory of family representation must be expanded in order to provide a workable standard of ethical behavior for estate and tax planning attorneys who represent non-traditional couples. The paper is divided into the following sections: (1) an overview of the shift from "the family" to "the individual" as the fundamental organizing unit of western society and the development of non-traditional couples within this framework; (2) a discussion of the estate and tax planning issues faced by non-traditional couples; (3) a review of the ethical responsibilities of an attorney who represents traditional couples; and (4) an application of these ethical responsibilities to the representation of non-traditional couples, resulting in the foregoing conclusions.

Available in PDF, EPUB and Kindle. Book excerpt: How do lawyers resolve ethical dilemmas in the everyday context of their practice? What are the issues that commonly arise, and how do lawyers determine the best ways to resolve them? Until recently, efforts to answer these questions have focused primarily on rules and legal doctrine rather than the real-life situations lawyers face in legal practice. The first book to present empirical research on ethical decision making in a variety of practice contexts, including corporate litigation, securities, immigration, and divorce law, Lawyers in Practice fills a substantial gap in the existing literature. Following an introduction emphasizing the increasing importance of understanding context in the legal profession, contributions focus on ethical dilemmas ranging from relatively narrow ethical issues to broader problems of professionalism, including the prosecutor’s obligation to disclose evidence, the management of conflicts of interest, and loyalty to clients and the court. Each chapter details the resolution of a dilemma from the practitioner’s point of view that is, in turn, set within a particular community of practice. Timely and practical, this book should be required reading for law students as well as students and scholars of law and society.

Available in PDF, EPUB and Kindle. Book excerpt: This Article examines the ethical dilemmas faced by attorneys who represent clients suffering from Alzheimer's disease. To do so, this Article raises three (3) hypothetical case studies, and applies the ABA Model Rules of Professional Conduct, and the American College of Trust and Estate Counsel ("ACTEC") Commentaries, where appropriate, to those hypothetical case studies. Additionally, this Article proposes initiatives to ameliorate the lack of awareness and discussion of Alzheimer's disease in the law school curriculum, and finally, modest initiatives that the practicing bar can embrace to further a discussion and awareness among practicing attorneys about the ethical dilemma attorneys face in their daily interaction with actual and potential clients suffering from Alzheimer's disease. This article's objectives are twofold. First, the intention is to use this Article as a vehicle to expose law students, legal educators, practicing attorneys, policymakers, and layperson observers to the impact, medical symptoms and manifestations of Alzheimer's disease in accessible and easy to understand terms. Second, to use this Article as a tool for teaching, raising understanding, and providing guidance on a multitude of ethical considerations that law students (who will soon be lawyers) and practicing members of the bar should consider while being exposed to actual or potential clients who suffer from Alzheimer's disease.

Book excerpt: "... focuses primarily on the rules of professional conduct that govern lawyers, with emphasis on the application of the rules to lawyers whose practices involve tax and estate planning. These so-called ethical rules represent serious efforts at self-regulation by the legal profession in each state. The rules are intended to protect the public, the profession, and the legal system as a whole. The ethical rules are related to, but distinct from, the standard of performance by which a lawyer's civil liability (malpractice) is determined. Notably, the violation of an ethical rule could give rise to a disciplinary action against the lawyer, which could result in the lawyer being exonerated, censured, suspended from practice or disbarred. The same conduct could also have serious civil consequences for the lawyer or the lawyer's firm, including the invalidation of documents, recovery of fees paid to the lawyer, and imposition of liability on the lawyer or the firm in a malpractice action"--P. iii.
