NESG estimates are based on observed bycatch consisting of 20 harbor porpoises, 5 short-beaked common dolphins, 1 Atlantic white-sided dolphin, 1 common bottlenose dolphin, 1 Risso's dolphin, 2 harp seals, 69 gray seals, and 22 harbor seals. The 2013 serious injuries and total mortalities in the MAG fishery were 62 (CV = 0.67) short-beaked common dolphins and 19 (CV = 1.06)harborporpoises. MAG estimates are based on observed by catch consisting of 2 short-beaked common dolphins and 1 harbor porpoise. The majority of marine mammal bycatch was observed on hauls targeting monkfish or skate using large-mesh nets that soaked for relatively long durations. For the NESG fishery, full pinger deployment was high in 2013 for times and areas required by the 2010 Harbor Porpoise Take Reduction Plan (HPTRP), ranging from 89 - 100%. The 2012 serious injuries and total mortalities in the MAG fishery were 63 (CV = 0.83) harbor porpoises, 15 (CV = 0.93) short-beaked common dolphins, and 14 (CV = 0.98) gray seals. MAG estimates are based on observed takes consisting of 2 harbor porpoises, 1 short-beaked common dolphin, and 1 gray seal. Relative to 2011, total annual bycatch of all marine mammal species, save short-beaked com-mondolphin, hasdeclined. However, high uncertainty around estimated takes confounds definitive trends in marine mammal bycatch within the NESG and MAG fisheries.

Compliance with the 2010 Harbor Porpoise Take Reduction Plan pinger regulations was 86% in 2015, where compliance refers to the correct number of pingers used, not the pingers' functionalit y. Compliance rates in the 2015 MAG fishery were low for large mesh gillnets (55%) and relatively high for small mesh gillnets (87%).

By examining a suite of over 90 indicators (including socioeconomic, governance, environmental forcing, major pressures, systems ecology, and fisheries criteria) for 9 major US fishery ecosystem jurisdictions, the authors systematically track the progress the country has made towards advancing EBFM and making it an operational reality. The assessment covers a wide range of data in both time (multiple decades) and space (from the tropics to the poles, representing over 10% of the world's ocean surface area). The authors view progress towards the implementation of EBFM as synonymous with improved management of living marine resources in general, and highlight the findings from a national perspective. Although US-centric, the lessons learned are directly applicable for all parts of the global ocean. Much work remains, but significant progress has already been made to better address many of the challenges facing the sustainable management of our living marine resources. Mean annual serious injury and mortality in the MABT fishery were 179.81 (CV=0.14) shortbeaked common dolphins, 38.28 (CV=0.28) Risso's dolphins, 15.71 (CV=0.42) offshore common bottlenose dolphins, 28.06 (CV=0.39) gray seals, and 11.40 (CV=0.40) harbor seals. Mean annual serious injury and mortality estimates for 8 species described in this report are below their respective potential biological removal (PBR) levels. The 2 exceptions are gray and harp seals that have unknown PBRs. There was evidence of acoustic deterrent devices being used on bottom trawl gear primarily in the MABT fishery, resulting in higher bycatch rates for offshore bottlenose dolphin and Risso's dolphins when pingers were used. Observer reports show no evidence of continued use of pingers on bottom trawl gear since 2012. However, uncertainty exists on the use of pingers and their effect on bottom trawl bycatch rates given nonsystematic data collection by fisheries observers on pinger usage in NEBT and MABT fisheries in the Northwest Atlantic region. Book excerpt: "The Marine Mammal Protection Act (MMPA) requires the National Marine Fisheries Service (NMFS) to estimate annual levels of human-caused mortality and serious injury to marine mammal stocks (section 117) and to categorize commercial fisheries based on their level of incidental mortality and serious injury of marine mammals (section 118). Serious injury (SI) determination guidelines were developed at NMFS-convened workshops in 1997 and 2007 (Angliss and DeMaster 1998; Andersen et al. 2008) and in January 2012 the agency published new national guidelines for distinguishing serious from nonserious injuries of marine mammals (NMFS 2012). A serious injury is defined as an injury that is more likely than not to result in mortality. A major goal of the new guidelines was to establish national consistency and transparency in SI determinations. To implement the new guidelines, science center SI determination (SID) staff from each region review all documented marine mammal injury events on an annual basis. For this document, fisheries observer (OBS) and at-sea monitor (ASM) records are reviewed for incidentally-caught animals that were released/observed alive. Observer comments on the condition of released animals and any associated photographs are compared to specific injury categories described in the new guidelines' procedure manual and each event is assigned an injury determination. Once completed, the Northeast Fisheries Science Center (NEFSC) SI small cetacean and pinniped determination table is independently reviewed by the Southwest Fisheries Science Center's (SWFSC) SID staff, the Greater Atlantic Regional Fisheries Office (GARFO), and the Atlantic Scientific Review Group (SRG) before the SI determinations were finalized.
