Available in PDF, EPUB and Kindle. Book excerpt: According to some estimates, there are around 20 to 60 million people with disability in India. For long this invisible minority went without any kind of protection or even legislation aimed at recognizing their basic rights. It was only in 1995 that the government passed the Persons with Disabilities (PWD) Act, which addressed the issues of non-discrimination, right to equal opportunity, and affirmative action for persons with disabilities for the first time. This book is a critical and comprehensive analysis of the PWD Act. It examines the Act from a historical perspective, giving an overview of the various legal approaches towards addressing disability-related discrimination. The author critically examines the various provisions of the Act—the definition of disability, affirmative action, equal opportunities in education, reservation in employment, and implementation. The volume also offers an international perspective on disability law by comparatively analysing Indian disability law with international jurisprudence. Taking into account the judgments of the Supreme Court and various high courts, it presents a forward thinking interpretation of the Act in light of the UN Convention on the Rights of Persons with Disabilities which India has ratified.

Book excerpt: Essentials of Law for Health Professionals 3e has been thoroughly revised and updated throughout to reflect the most recent changes in legislation relevant to the provision of health care services in Australia. Employment status of health professionals and issues of work cover, health and safety obligations, anti-discrimination issues are clearly outlined and discussed in the new edition. Legal issues surrounding genetics, fertility and surrogacy are reviewed in conjunction with the current position on abortion and wrongful deaths. The breadth of material is presented in a manner that is more in keeping with a student resource text rather than a law book. It emphasises major points and includes summaries on how the law relates to practice rather than merely stating the law. The new third edition continues to present contemporary issues relevant for Health Science students from the clinical setting through to management and employment, as they apply to each state. Streamlined new edition includes updates to key chapters such as: Chapter 5 Negligence, which has been completely rewritten to discuss negligence by jurisdiction Chapter 8 Manipulation of Life now deals with topical and controversial issues such as abortion, wrongful death, tissue transplants, genetics and infertility Chapter 10: Contractual and Industrial Elements of Professional Practice has been updated to include the most recent changes to Industrial Relations Law, information that is essential for any Health Professional entering into employment. Chapter 11: Statues Controlling Health Service Delivery has been revised with respect to drugs and continues to provide the significant legislation most likely to impact on the daily practice of the health professional namely poisons, mental health legislation, child and elder abuse, and the notification of births and deaths. New Chapter 12: Registration and Regulation of Health Professionals highlights the contemporary issues faced by health professionals with the implementation of National Registration. Addition of legislation regulating research and a discussion of the legislative and common law controls on conducting research within Australian healthcare systems – National Health and Medical Research Council Act Update all appendices and include the Decision Making Framework for Nurses plus Glossary Takes a multidisciplinary approach to the subject of health care law and includes case-studies and activities. Discussion on the implications of evidence-based practice on the standard notionally attributed to the duty of care.

Available in PDF, EPUB and Kindle. Book excerpt: This collection of essays arose from a conference held to mark the silver anniversary of the Australian Sex Discrimination Act (1984). The collection has two aims: first; to honour the contributions of both the spirited individuals who valiantly fought for the enactment of the legislation against the odds, and those who championed the new law once it was passed; secondly, to present a stock-take of the Act within the changed socio-political environment of the 21st century. The contributors present clear-eyed appraisals of the legislation, in addition to considering new forms of legal regulation, such as Equality Act, and the significance of a Human Rights Act. The introduction of a proactive model, which would impose positive duties on organisations, is explored as an alternative to the existing individual complaint-based model of legislation. The contributors also pay attention to the international human rights framework, particularly the Convention on the Elimination of all Forms of Discrimination against Women and the UN Declaration on the Rights of Indigenous People. The essays are illuminated by recourse to a rich vein of historical and contemporary literature. Regard is also paid to the comparative experience of other jurisdictions, particularly the UK and Canada.

Book excerpt: Skilled migration is rapidly rising as countries vie for the 'best and brightest' migrants to fill labour market shortages or to add to their stock of 'knowledge workers'. The 'knowledge economy', and the increasing value placed on human capital over physical capital, has led to what some describe as a 'war over skills'. Within this context, the way in which Australia seeks to attract skilled permanent and temporary migrants is put under the spotlight in this very timely publication. Are we open and flexible or defensive and protectionist? This book compares the policies of Australia with those of other nations. What makes this book unique is the input of lawyers, for the first time in Australia, in the discussion of issues. Their challenge to existing selection policies, taxation systems and recognition mechanisms provides a major new contribution to these topics.

Available in PDF, EPUB and Kindle. Book excerpt: This book comprises a definitive collection of papers on administrative justice, written by a set of very distinguished contributors. It is divided into five parts, each of which contains articles on a particular aspect of administrative justice. The first part deals with the impact of 'contextual changes' on administrative justice and considers the implications of changes in governance and public administration, management and service delivery, information technology, audit and accounting, and human rights for administrative justice. The second part deals with conceptual issues and describes a number of competing approaches to the administrative justice. The third part deals with the application of administrative justice principles to private law disputes while the fourth part deals with the distinctive characteristics of administrative justice in three other jurisdictions. The final part deals with current developments in administrative justice and the book concludes with a discussion of legislative and policy developments in the UK. The general approach of the book is socio-legal and interdisciplinary. The chapters adopt a variety of disciplinary perspectives, including those derived from political science, public policy, social policy, accounting and information technology as well as from law. Although most of the contributors are academics, some are practitioners. For these reasons, the book should be of interest to lawyers, particularly those with interests in administrative law, and to social scientists, particularly those with interests in public administration, public policy and public management.
