Book excerpt: In response to a congressional request, GAO reviewed: (1) the Environmental Protection Agency's (EPA) approval of state actions to allow increased levels of sulfur dioxide emissions; (2) the impact of such revisions on future economic growth; and (3) the legal basis for these increases. GAO found that, from 1981 to 1983, EPA approved 114 revisions to state implementation plans involving sulfur dioxide, 58 of which permitted increased emissions. These revisions allowed a net increase of 1.5 million tons of sulfur dioxide emissions during that period. The GAO review of 18 state plan revisions showed that increased sulfur dioxide emissions could reduce the recreational value of land and waterways, increase building maintenance costs, and increase health care expenses. After a state's adoption and submission to EPA of a state plan revision, EPA approval is mandatory and the revision must meet Clean Air Act criteria. However, states are allowed to attach conditions to their state plan revisions. GAO found that: (1) for the 18 state plan revisions it reviewed, EPA and the states followed the act's key requirements; (2) EPA could improve the techniques it uses in making approval decisions; (3) mathematical models are needed that can better project the interstate impacts of sulfur dioxide emissions and the impact of those emissions on certain types of terrain; and (4) some states calculated compliance with the emission standards by a method that was not approved by EPA. EPA, however, has ongoing research to find methods of correcting these problems.

EPA is finding that Oklahoma's regional haze SIP did not address the sulfur dioxide Best Available Retrofit Technology requirements for six units in Oklahoma in accordance with the Regional Haze requirements, or the requirement to prevent interference with other states' visibility programs. EPA is promulgating a Federal Implementation Plan to address these deficiencies by requiring emissions to be reduced at these six units. This action is being taken under section 110 and part C of the CAA. Updated as of May 29, 2018 EPA is approving portions of a State Implementation Plan (SIP) revision submitted by the State of Colorado for the purpose of addressing the "good neighbor" provisions of Clean Air Act ("Act" or "CAA") section 110(a)(2)(D)(i) for the 1997 8-hour ozone National Ambient Air Quality Standards ("NAAQS" or "standards") and the 1997 fine particulate matter ("PM 2.5") NAAQS. This SIP revision addresses the requirement that the State of Colorado's SIP ("Interstate Transport SIP") have adequate provisions to prohibit air emissions from adversely affecting another state's air quality through interstate transport. In this action, EPA is approving the Colorado Interstate Transport SIP provisions that address the requirement of section 110(a)(2)(D)(i) that emissions from Colorado sources do not significantly contribute to nonattainment of the 1997 PM 2.5 NAAQS in any other state, interfere with maintenance of the 1997 PM 2.5 NAAQS by any other state, or interfere with any other state's required measures to prevent significant deterioration of air quality for the 1997 PM 2.5 and 8-hour ozone NAAQS. EPA is also approving certain revisions to Colorado Regulation No. 3 submitted by the State of Colorado in separate prior submissions. This action is being taken under section 110 of the CAA. Updated as of May 29, 2018 EPA is taking interim final action to reaffirm the promulgation of certain revisions of the Acid Rain Program rules in order to prevent disruption of this program, which has achieved significant, cost-effective reductions in sulfur dioxide (SO 2) emissions from utility sources since its commencement in 1995. These rule revisions were finalized in the Federal Register notices that also finalized the Clean Air Interstate Rule (CAIR) and the Federal Implementation Plans for CAIR (CAIR FIPs). The U.S. Court of Appeals for the District of Columbia Circuit recently issued a decision vacating and remanding CAIR and the CAIR FIPs. EPA and other parties have petitioned for rehearing, and the Court has not yet issued a mandate in the case. These revisions to the Acid Rain Program rules were not addressed by, or involved in any of the issues raised by, any parties in the proceeding or the Court. EPA believes it is reasonable to view these revisions as unaffected by the Court's decision. However, EPA is reaffirming-pursuant to its authority under Title IV of the Clean Air Act (CAA) and CAA section 301-the promulgation of these revisions in this interim final rule in order to remove any uncertainty about their legal status because they have been in effect since mid-2006, most of them are crucial to the ongoing operation of the Acid Rain Program, and the rest of them streamline and clarify requirements of the program. Updated as of May 29, 2018 EPA is taking final action on revisions to the San Joaquin Valley Unified Air Pollution Control District portion of the California State Implementation Plan. Specifically, EPA is taking final action on three amended District rules, one of which was submitted on March 7, 2008 and the other two of which were submitted on March 17, 2009. Two of the submitted rules reflect revisions to approved District rules that provide for review of new and modified stationary sources ("new source review" or NSR) within the District, and the third reflects revisions to an approved District rule that provides a mechanism by which existing stationary sources may voluntarily limit their operations to avoid the requirement to secure a Federally-mandated operating permit. The NSR rule revisions relate to exemptions from permitting and offsets requirements for certain agricultural operations, to the establishment of NSR applicability and offset thresholds consistent with a classification of "extreme" nonattainment for the ozone standard, and to the implementation of EPA's NSR Reform Rules. With respect to the revised District NSR rules, EPA is finalizing a limited approval and limited disapproval because, although the changes would strengthen the SIP, there are deficiencies in enforceability that prevent full approval. With respect to the rule pertaining to operating permit requirements, EPA is finalizing a full approval. EPA is also taking final action to remove certain obsolete conditions placed on previous approvals of various California nonattainment plans. Lastly, EPA is deferring further action on the Agency's proposal to correct the May 2004 approval of the previous version of the District's NSR rules pending receipt from California of an interpretation of the District's legal authority with respect to agricultural sources under state law.
