O surgimento e a consolidação dos direitos humanos no cenário internacional somente foi possível com o rompimento do pensamento de que a soberania dos Estados era absoluta. A primordial finalidade dos direitos humanos é a proteção efetiva da dignidade da pessoa humana através da satisfação das necessidades básicas das pessoas. Quando se protege os direitos da pessoa humana assegurando a sua dignidade, permite-se que o indivíduo desenvolva sua personalidade livremente. Os Estados têm o dever de proteger e promover os direitos humanos, reconhecendo-os em seus ordenamentos jurídicos, ou seja, em suas Constituições como direitos fundamentais. Então, em busca de uma maior efetivação desses direitos, surgiram na sociedade internacional organizações internacionais e outras entidades que buscam defender os direitos humanos, atuando conjuntamente com os Estados soberanos. Foram criados sistemas de proteção dos direitos humanos, sendo um sistema global, regido pela Organização das Nações Unidas, e quantro sistemas regionais, sendo eles: o europeu, o africano, o árabe e o interamericano.

Book excerpt: In this Open Access book, Katharina Merian discusses memories of Marielle Franco from the perspective of the concept of dangerous memory introduced by the political theologian Johann Baptist Metz. Franco was an Afro-Brazilian human-rights activist and city councilor of Rio de Janeiro who was assassinated on March 14, 2018. Her murder elicited worldwide protest and empathy. Today she is considered an international symbol in the fight for human, women, and LGBTQ+ rights. Based on the memories of people from Franco’s inner circle, the study explores Franco’s life, what it meant to the people around her, and how her image was transformed following her murder. By critically engaging with Metz’s concept of dangerous memory, which concerns memories of suffering and unfulfilled hopes that challenge the present, Merian demonstrates that the memories of Franco represent a decolonial dangerous memory that sparks individual and collective self-empowerment among Black women, members of the LGBTQ+ community, and favela residents. This work not only contributes to a critical reappraisal of Franco’s story and the meaning of her memory in the Brazilian and international context but also proposes a differentiated understanding of dangerous memory that highlights the relationship between solidarity and self-empowerment in a moment of existential danger and threat. Katharina Merian is a senior research associate at the Faculty of Theology and Study of Religion of the University of Zurich in Switzerland.

It sets out the following aspects of the constitutional development and erosion: - the different phases of the promised transition from military rule to a 'social-democratic constitutionalism'; - the obstacles to democratisation derived from the absence of true institutional reforms in the judicial branch and in the civil-military relationship; - the legal and social practices which maintained a structure that obstructed the emergence of an effective social-democracy, such as the neoliberal pattern, the acceptance in the political field of unlawful organisations, such as the milícias, and the way the digital revolution has been harming the formation of democratic sovereignty. Situating Brazil in the global context of the revival of authoritarianism, it details the factors which are common to the third wave of democratisation reflux. Accounting for those aspects, particular to the Brazilian jurisdiction, it shows that there is a tension in the Brazilian constitution. On the one hand, such constitutionalism was renewed by democratic pressure on governments to undertake social politics since 1988. On the other hand, it retained authoritarian practices through the hands of diverse institutions and political actors. By exploring the ideas of constitutional erosion and collapse, as well as democratic, social and digital constitutionalism, the book presents a comparative analysis of Brazil and other jurisdictions, including the United States, South Africa, and Peru.
