Ces responsabilités sont envisagées à partir de la typologie suivante : responsabilités administrative, didactique, juridique, morale et sociale. L'enquête s'appuie sur la mise en rapport des responsabilités exigées par l'institution scolaire, et sur les représentations de ces responsabilités issues de l'analyse des réponses à un questionnaire (472 réponses), de l'étude de l'évaluation de l'EPS au baccalauréat, de l'examen de dossiers d'accidents scolaires et sur une série d'entretiens avec des responsables administratifs et pédagogiques. Un des résultats les plus marquants est que la responsabilité didactique est essentiellement orientée vers la socialisation au détriment des capacités motrices spécifiques aux activités physiques et sportives. Bien que les enseignants d'EPS tiennent à être des enseignants de plein droit, les responsabilités revendiquées ne recouvrent pas toutes les attentes institutionnelles ; elles relèvent davantage du statut antérieur à leur intégration dans l'Education nationale que du statut actuel

Le régime spécial dérogatoire de cette loi fait bénéficier les membres de l’enseignement public d’une quasi-immunité par le biais de la substitution de la responsabilité de l’Etat à la leur. Cependant, la victime devra prouver la faute de surveillance imputable à l’enseignant pour pouvoir engager la responsabilité de l’Etat. Cette loi a fait l’objet de vives critiques car, si elle protège effectivement l’instituteur, elle risque, par contre, d’entraîner l’impossibilité pour la victime de se faire indemniser. Or, aujourd’hui, les principes de la responsabilité civile font passer au premier rang l’indemnisation des victimes. Pour contrer cette situation, la jurisprudence admet de plus en plus facilement la preuve d’un défaut de surveillance en interprétant de manière extensive les conditions d’application de la loi. Devant de tels détournements, la légitimité du texte de 1937 est alors de plus en plus contestée, tandis que la consécration parallèle de responsabilités d’autrui objectives renforce sa marginalité. En effet, face à la responsabilité des parents du fait de leurs enfants mineurs et à l’émergence d’une responsabilité générale du faitd’autrui, le système de 1937 devient dépassé et délaissé. Par ailleurs, ce régime est confronté à une montée du contentieux administratif relatif aux accidents scolaires. Si le dommage est provoqué par un défaut d’entretien normal de l’ouvrage public, l’enseignant sera exempt de tout reproche, seule la collectivité publique sera responsable devant le juge administratif. Enfin, la protection de la loi de 1937 est compromise par les actions en réparation exercées devant les juridictions répressives afin que l’enseignant soit personnellement mis en cause. Ainsi, réactualiser le régime juridique de la responsabilité des enseignants est une nécessité urgente vivement réclamée qui répondrait à un besoin de sécurité juridique.
