Book excerpt: Conducted at the request of the European Parliament's Special Committee on the COVID-19 pandemic, this literature review examines the patterns in, consequences of and correlation between national approaches to parliamentary oversight of governments' responses to the COVID-19 pandemic in the EU27 and four other countries (Canada, Switzerland, the United Kingdom and the United States). The review begins by assessing parliaments' involvement during the early stages of the health crisis, when many countries were operating under emergency regimes or statutory frameworks that provided for rapid action. It then maps the parliaments' law-making and oversight role during the pandemic, demonstrating that they were not necessarily side-lined. The study goes on to assess successes and failures and, on that basis, factors in the resilience of parliamentary oversight. Mapping the widespread use of sunset and review clauses in emergency legislation, the study reflects on parliaments' cooperation with supreme audit institutions and independent fiscal institutions, which enhanced their budgetary oversight role during the pandemic. The literature review also identifies best practice regarding oversight during the COVID-19 pandemic and reforms that parliaments could pursue to strengthen their preparedness for future crises.

Currently unsolved problems often have much in common, in vexed areas such as ethics requirements or how procedural rules permit minorities fair access to legislative time before majorities prevail. British successes include the enhanced authority and effectiveness of select committees and the acquisition of more debating time by the creation of a parallel Chamber. Unsolved problems at Westminster begin with the powers and status of the Lords, and go on through the search for more effective review of EU activities, adapting parliamentary scrutiny to more sophisticated government financial information, and making better use of legislative time without diminishing back-bench rights. The accelerated pace and extent of procedural changes in Congress is problematic. Constant pursuit of campaign funds, increased party exploitation of Members' ethical shortcomings, and partisan reapportionments, have diminished collegiality and compromise. Business is conducted with greater predictability, with fewer quorum calls, postponement and clustering of votes, and by utilization of ad hoc special orders, often in derogation of openness and minority rights in the House. Minority complaints have been frequent and occasionally extreme. Conversely constant filibuster threats in the Senate have enhanced minority party power there. An 'inverse ratio' between the greater complexity, importance, and urgency of pending legislation on the one hand, and diminution of deliberative capacity, fairness. and transparency on the other, has been repeatedly demonstrated, especially at the stage of final compromises between the Houses.

Despite this, we know very little about how questions are used by MPs and what impact questions have on controlling the government. This volume advances our theoretical and empirical knowledge of the use of questioning in a number of different parliamentary settings. The propensity of parliamentarians to ask questions indicates that the interrogatories are an important tool for measuring an individual legislator’s job. Ultimately, how a parliamentarian chooses to use the questioning tool provides a unique insight into legislator behaviour and role orientation. Many of the chapters in this volume provide new empirical measures of legislator activity and use this data to provide new tests of leading theories of legislator behaviour. At an institutional level, questions provide an important source of information for the chamber and are a critical tool of government oversight – as many of the chapters in the volume indicate. Evidence of the impact of questions on executive and bureaucratic oversight challenges conventional views of parliaments as weak and ineffective parts of the political process.
