Available in PDF, EPUB and Kindle. Book excerpt: Constitutional Amendments: Making, Breaking, and Changing Constitutions is both a roadmap for navigating the intellectual universe of constitutional amendments and a blueprint for building and improving the rules of constitutional change. Drawing from dozens of constitutions in every region of the world, this book blends theory with practice to answer two all-important questions: what is an amendment and how should constitutional designers structure the procedures of constitutional change? The first matters now more than ever. Reformers are exploiting the rules of constitutional amendment, testing the limits of legal constraint, undermining the norms of democratic government, and flouting the constitution as written to create entirely new constitutions that masquerade as ordinary amendments. The second question is central to the performance and endurance of constitutions. Constitutional designers today have virtually no resources to guide them in constructing the rules of amendment, and scholars do not have a clear portrait of the significance of amendment rules in the project of constitutionalism. This book shows that no part of a constitution is more important than the procedures we use change it. Amendment rules open a window into the soul of a constitution, exposing its deepest vulnerabilities and revealing its greatest strengths. The codification of amendment rules often at the end of the text proves that last is not always least.

Defying the traditional division between normative and positive theoretical approaches, this book explores how political reality on the one hand, and constitutional ideals on the other, mutually inform and influence each other. Seventeen chapters from leading international scholars cover a diverse range of topics and case studies to test the hypothesis that the best normative theories, including those regarding the role of constitutions, constitutionalism and the rule of law, conceive of the ideal and the real as mutually regulating.

Available in PDF, EPUB and Kindle. Book excerpt: History comes alive in this illustrated guide to the Constitution and all 27 Amendments. The Constitution has been in the news a lot recently. But most of us could probably use a refresher on this founding document of America--you can probably name the first and second amendments, but what about the 11th, or the 22nd? And what does all of that formal political language actually mean for us today? The U.S. Constitution for Everyone answers these questions and more, like: - How does impeachment work, anyway? - How long is a Senator's term? - What is covered by "freedom of speech"? - What are "emoluments"? - How exactly does a bill become a law? This book makes understanding your rights easy with clear explanations of the complete text of the U.S. Constitution, as well as all 27 Amendments, alongside fascinating historical facts and explanations. A must-read for students, curious citzens, and everyone who'd like to know more about the supreme laws of our nation.

Book excerpt: Written by an American political scientist who is also a barrister, and a practicing American lawyer, this casebook emphasizes the deep roots of American constitutional rights in both English and American constitutional development. It illustrates how these rights grow or declineóthrough constitutional amendments, executive actions, statutes, custom, and judicial decisions. The five parts of the book cover rights enforceable against the federal government and states, physical and economic rights, rights of the accused, freedom of speech and press, and the guarantee of a republican form of government.

Available in PDF, EPUB and Kindle. Book excerpt: Mark R. Levin has made the case, in numerous bestselling books that the principles undergirding our society and governmental system are unraveling. In The Liberty Amendments, he turns to the founding fathers and the constitution itself for guidance in restoring the American republic. The delegates to the 1787 Constitutional Convention and the delegates to each state’s ratification convention foresaw a time when the Federal government might breach the Constitution’s limits and begin oppressing the people. Agencies such as the IRS and EPA and programs such as Obamacare demonstrate that the Framers’ fear was prescient. Therefore, the Framers provided two methods for amending the Constitution. The second was intended for our current circumstances—empowering the states to bypass Congress and call a convention for the purpose of amending the Constitution. Levin argues that we, the people, can avoid a perilous outcome by seeking recourse, using the method called for in the Constitution itself. The Framers adopted ten constitutional amendments, called the Bill of Rights, that would preserve individual rights and state authority. Levin lays forth eleven specific prescriptions for restoring our founding principles, ones that are consistent with the Framers’ design. His proposals—such as term limits for members of Congress and Supreme Court justices and limits on federal taxing and spending—are pure common sense, ideas shared by many. They draw on the wisdom of the Founding Fathers—including James Madison, Benjamin Franklin, Thomas Jefferson, and numerous lesser-known but crucially important men—in their content and in the method for applying them to the current state of the nation. Now is the time for the American people to take the first step toward reclaiming what belongs to them. The task is daunting, but it is imperative if we are to be truly free.

Book excerpt: It's possible: we Americans can fix our broken federal government. Our Founders made sure of it. For 50 years, political insiders have been trying to suppress all knowledge of how to reform our government. No longer! In this book, America's leading active scholar on the constitutional amendment process reveals how we can bypass Congress to win the reforms we need. Relying on three centuries of history, over two centuries of decided case law, and vast historical and legal research, Professor Natelson answers such questions as: * How does the Constitution let us bypass Congress to get the reforms we need? * What exactly is a "convention for proposing amendments"--and what it is not? * How is the convention organized and governed? * What are the legal rules governing the process? * Which writings about the amendment process are reliable--and which are just propaganda? The Law of Article V is an indispensable guide for all Americans who love their country.

Since 1789, amendments, interpretation, and changes in the English language have made it more difficult for ordinary Americans to understand what our Constitution currently requires. This book attempts to act as a sort of "pocket guide" for the engaged citizen who wants to better understand our founding document without going to law school.

Book excerpt: Seminar paper from the year 2004 in the subject American Studies - Culture and Applied Geography, grade: 2,0, Martin Luther University (Institut f r Anglistik und Amerikanistik), course: The American Constitution: Past and Present, 13 entries in the bibliography, language: English, abstract: From the beginning on Americans have proclaimed liberty, have fought wars in its name have evaluated events and institutions and politics in the light of liberty. They were convinced that they are free people and they always wanted to serve as a model for the rest of the world. Besides the Declaration of Independence, the Constitution, ratified on the 17th of September 1787, is the fundamental document that symbolizes this freedom and that serves as a legal basis of the juridical system of the United States. This original document does not include speech freedom and freedom of the press, which are two of the most important liberties a free nation should have. The Bill of Rights that includes these liberties was added later, as amendments to the original document. However, the Constitution and its amendments serve as more or less strict guidelines, as the text is not unambiguous. It is difficult to interpret the twisted language of it and as I will show in this work, the opinions reach from one extreme to the other. Justices of the Supreme Court play a leading role in interpreting the Constitution, therefore a lot of juridical cases deal directly or indirectly with the interpretation of the Constitution and are a subject of this term paper. In this term paper I am going to show how the original Constitution was finally ratified, and how difficult it is to change this document. The aim of the Framers was to make the changing of the Constitution as challenging as possible. The difficulty of the amendment process is explained with the help of an example; The Equal Rights Amendment. After discussing the basis of the amendment process I will analyze how freedom of speech and freedo
