Available in PDF, EPUB and Kindle. Book excerpt: The Rewards of Punishment describes a new social theory of norms to provide a compelling explanation why people punish. Identifying mechanisms that link interdependence with norm enforcement, it reveals how social relationships lead individuals to enforce norms, even when doing so makes little sense. This groundbreaking book tells the whole story, from ideas, to experiments, to real-world applications. In addition to addressing longstanding theoretical puzzles—such as why harmful behavior is not always punished, why individuals enforce norms in ways that actually hurt the group, why people enforce norms that benefit others rather than themselves, why groups punish behavior that has only trivial effects, and why atypical behaviors are sometimes punished and sometimes not—it explores the implications of the theory for substantive issues, including norms regulating sex, crime, and international human rights.

Available in PDF, EPUB and Kindle. Book excerpt: The idea of rewarding private parties who participate in the enforcement of public rules is not uncommon. Still, in the field of anti-cartel enforcement the policy of rewarding acts which are beneficial to the public is limited and typically takes the form of forgoing or reducing penalties under leniency programmes or settlement procedures, rather than providing rewards which would benefit their recipients in a more meaningful way. This article discusses why competition enforcement should more firmly follow the policy of providing rewards and financial incentives to individuals and how such systems may work. To this end, the article analyses informant reward schemes implemented in the United Kingdom, Hungary, and the Slovak Republic.

Book excerpt: Enforcement is a fundamental challenge for international law. Sanctions are costly to impose, difficult to coordinate, and often ineffective at accomplishing their goals. Rewards are likewise costly and domestically unpopular. Thus, efforts to address pressing international problems-such as reversing climate change and coordinating monetary policy-often fall short. This Article offers a novel approach to international enforcement and demonstrates the advantages of such an approach over traditional sanctions or rewards. It develops a mechanism of Reversible Rewards, which combines sticks and carrots in a unique, previously unexplored way. Reversible Rewards require that a sum of money be offered as a reward to the Target for its compliance (Incentive 1). Alternatively, the same amount of money can be used to pay for sanctions in case the Target turns down the reward (Incentive 2). This way, the money earmarked for the enforcement effort "works twice" and thus doubles the Target's incentives to comply. Moreover, Reversible Rewards can be pre-committed in an enforcement fund to solve the problem of credibility. The Article demonstrates that, relative to sanctions or rewards used alone, Reversible Rewards reduce the costs of international enforcement and increase compliance with international rules.

Available in PDF, EPUB and Kindle. Book excerpt: Why has an economy that has done so many things right failed to grow fast? Under-Rewarded Efforts traces Mexico’s disappointing growth to flawed microeconomic policies that have suppressed productivity growth and nullified the expected benefits of the country’s reform efforts. Fast growth will not occur doing more of the same or focusing on issues that may be key bottlenecks to productivity growth elsewhere, but not in Mexico. It will only result from inclusive institutions that effectively protect workers against risks, redistribute towards those in need, and simultaneously align entrepreneurs’ and workers’ incentives to raise productivity.

Book excerpt: This article offers a new mechanism of law enforcement, combining sanctions and rewards into a scheme of 'reversible rewards.' A law enforcer sets up a pre-committed fund and offers it as reward to another party to refrain from violation. If the violator turns down the reward, the enforcer can use the money in the fund for one purpose only - to pay for punishment of the violator. The article shows that this scheme doubles the effect of funds invested in enforcement, and allows enforcers to stop violations that would otherwise be too difficult to deter. It argues that reversible rewards could be used to bolster enforcement in international and domestic law, and could also be applied strategically in litigation.
