Book excerpt: Excerpt from Endangered Species Act; Incentives to Encourage Conservation by Private Landowners: Hearing Before the Subcommittee on Environment and Natural Resources of the Committee on Merchant Marine and Fisheries, House of Representatives, One Hundred Third Congress, First Session And I think we need these extra sort of mechanisms to resolve those. I don't think it is really the norm, though, and the parallel I would make is with the experimental population provision of the law, which was designed to facilitate reintroduction of highly - of endangered and highly controversial, mainly large predators. And I think that that has worked and the experimental population provi sion has provided the flexibility that has taken some of the tension out of this debate. Mr. Studds. I think you are correct, and I assume you are cor rect in that these kinds of extraordinary problems are not the norm, they are the exception. However, they are perceived broadly in the land and certainly by folks in this institution in many cases as being a major, major problem. That by definition makes it a major, major problem. Book excerpt: Protecting endangered species of animals and plants is a goal that almost everyone supports in principle—but in practice private landowners have often opposed the regulations of the Endangered Species Act, which, they argue, unfairly limits their right to profit from their property. To encourage private landowners to cooperate voluntarily in species conservation and to mitigate the economic burden of doing so, the government and nonprofit land trusts have created a number of incentive programs, including conservation easements, leases, habitat banking, habitat conservation planning, safe harbors, candidate conservation agreements, and the "no surprise" policy. In this book, lawyers, economists, political scientists, historians, and zoologists come together to assess the challenges and opportunities for using economic incentives as compensation for protecting species at risk on private property. They examine current programs to see how well they are working and also offer ideas for how these programs could be more successful. Their ultimate goal is to better understand how economic incentive schemes can be made both more cost-effective and more socially acceptable, while respecting a wide range of views regarding opportunity costs, legal standing, biological effectiveness, moral appropriateness, and social context.

Available in PDF, EPUB and Kindle. Book excerpt: Winner, Independent Press Award - Conservation/Green, 2021 The only hope for successful conservation of America’s threatened, endangered, and at-risk wildlife is through voluntary, cooperative partnerships that focus on private land, where over 75% of at-risk species can be found. Private landowners form the bedrock of these partnerships, and they have a long history of rising to meet the challenge of conservation. But they can’t do it alone. This book is a guide for private landowners who want to conserve wildlife. Whether engaged in farming, ranching, forestry, mining, energy development, or another business, private working lands all have value as wildlife habitat, with the proper management and financial support. This book provides landowners and their partners with a roadmap to achieve conservation compatible with their financial and personal goals. This book introduces the art and language of land management planning as well as regulatory compliance with laws such as the Endangered Species Act of 1973. It categorizes and explains the tools used by wildlife professionals to implement conservation on private lands. Moreover it documents the multitude of federal, state, local, and private opportunities for landowners to find financial and technical assistance in managing wildlife, from working with a local NGO to accessing the $6 billion per year available through the federal Farm Bill.

Book excerpt: One major lesson derived from the implementation of the Endangered Species Act (ESA) over the past 30 years is that direct regulation is not the only nor the optimal way to protect endangered species on working lands because of an undue burden imposed on private landowners. The role of a voluntary conservation program is to rearrange incentives so that society bears the cost rather than the landowner. Employing a survey research methodology, I used theories of reasoned action and random choice to explore landowners' stated preferences for conservation programs. I found landowners' stated interest in compensation programs to be moderate at best. For those willing to consider programs involving endangered species, associating land management requirements for species conservation with direct benefits to the landowner is important, but perhaps not as important as ensuring that the program provides adequate financial incentives, consideration of the term of the program, and a level of certainty regarding the landowner's future obligations under the ESA. Landowners are not a homogenous group. I identified two classes of landowners according to preferences for program structure. One group was highly sensitive to program structure, aside from financial incentives, while the other was likely to participate if adequately compensated with financial and technical assistance. These differences related to opinions on endangered species protection and dependence on their land for income. Voluntary incentive programs increasingly are a popular tool to maintain and enhance conservation; however, these programs are only successful insofar as landowners choose to enroll. This research demonstrates that improving recovery efforts on private lands requires program administrators to have a more complete understanding of landowners' views on endangered species and conservation programs in general, as well as their motivations for owning and operating their land. By doing so, programs with broader appeal and greater efficacy can be designed and implemented.
