Updated as of May 29, 2018 The best scientific and commercial data available indicate that gray wolves (Canis lupus) in Wyoming are recovered and are no longer in need of protection as part of an endangered or threatened species under the Endangered Species Act of 1973, as amended (Act). Updated as of May 29, 2018 We, the U.S. Fish and Wildlife Service (Service), in coordination with the State of Wyoming and other partners, will reestablish additional populations of the black-footed ferret (Mustela nigripes), a federally listed endangered mammal, into prairie dog (Cynomys spp.) occupied habitat in Wyoming and classify any reestablished population as a nonessential experimental population (NEP) under section 10(j) of the Endangered Species Act of 1973, as amended (Act). This final rule establishes the NEP area and provides for allowable legal incidental taking of the black-footed ferret within the defined NEP area. The best available data indicate the reintroduction of black-footed ferrets to Wyoming is biologically feasible and will promote conservation and recovery of the species. This NEP area and two previously designated NEPs in Wyoming collectively cover the entire State of Wyoming and provide consistent management flexibility Statewide. We are also amending the historical range column for the species within the List of Endangered and Threatened Wildlife (List) to include Mexico; the historical range information in the List is informational, not regulatory. Updated as of May 29, 2018 We, the U.S. Fish and Wildlife Service (Service), are issuing this final rule to comply with court orders that reinstate the regulatory protections under the Endangered Species Act of 1973, as amended (ESA), for the gray wolf (Canis lupus) in Wyoming and the western Great Lakes. Pursuant to the U.S. District Court for the District of Columbia court order dated September 23, 2014, this rule reinstates the April 2, 2009 (74 FR 15123), final rule regulating the gray wolf in the State of Wyoming as a nonessential experimental population. Gray wolves in Montana, Idaho, the eastern third of Washington and Oregon, and north-central Utah retain their delisted status and are not impacted by this final rule. In addition, pursuant to the U.S. District Court for the District of Columbia court order dated December 19, 2014, this rule reinstates the March 9, 1978 (43 FR 9607), final rule as it relates to gray wolves in the western Great Lakes including endangered status for gray wolves in all of Wisconsin and Michigan, the eastern half of North Dakota and South Dakota, the northern half of Iowa, the northern portions of Illinois and Indiana, and the northwestern portion of Ohio; threatened status for gray wolves in Minnesota; critical habitat for gray wolves in Minnesota and Michigan; and the rule promulgated under section 4(d) of the ESA for gray wolves in Minnesota. Book excerpt: The tension between wildlife protection under the Endangered Species Act and water management in the Platte River Basin has existed for more than 25 years. The Platte River provides important habitat for migratory and breeding birds, including three endangered or threatened species: the whooping crane, the northern Great Plains population of the piping plover, and the interior least tern. The leading factors attributed to the decline of the cranes are historical overhunting and widespread habitat destruction and, for the plovers and terns, human interference during nesting and the loss of riverine nesting sites in open sandy areas that have been replaced with woodlands, sand and gravel mines, housing, and roadways. Extensive damming has disrupted passage of the endangered pallid sturgeon and resulted in less suitable habitat conditions such as cooler stream flows, less turbid waters, and inconsistent flow regimes. Commercial harvesting, now illegal, also contributed to the decline of the sturgeon. Endangered and Threatened Species of the Platte River addresses the habitat requirements for these federally protected species. The book further examines the scientific aspects of the U.S. Fish and Wildlife Service's instream-flow recommendations and habitat suitability guidelines and assesses the science concerning the connections among the physical systems of the river as they relate to species' habitats.
