El título del mismo así lo refleja: empresa pública, empresa privada (gestora del servicio por concesión) y empresa de interés general, bajo el nuevo modelo de regulación para la competencia. La primera parte es una larga reflexión sobre el comportamiento del sector empresarial público de los años 40 a los 90, que el autor califica como "la gran frustración". En sus páginas, revisa escritos suyos dispersos de hace 25 ó 30 años que han sido corregidos o ratificados en función de la realidad observada en este medio siglo. De acuerdo con la lógica de las ciencias sociales que proclamara Popper, el autor ha querido -dice- "falsar" afirmaciones suyas de antaño, rectificando algunas y reteniendo otras que en su opinión siguen siendo válidas porque la observación de lo ocurrido en estos años las confirma. Cuando la empresa pública, hoy, se levanta de nuevo en el horizonte de algunas economías latinoamericanas, que quieren revisar el camino andado en los 90; y cuando, en España, Comunidades Autónomas y Corporaciones Locales están haciendo de ella el instrumento, una y otra vez utilizado, de su acción política, bueno será -dice también el autor- echar una mirada al pasado y ver qué se puede hacer con la empresa pública y cómo hacerlo; cuáles son sus riesgos y sus mentiras y qué es lo que no se debe hacer con ella. El libro lleva un subtítulo expresivo a este respecto que dice así: "Lecciones retrospectivas, de las que algo se puede aprender...". La actual explosión del sector empresarial público autonómico y local haría bien en tomar en consideración estas lecciones. La segunda parte -¿reforma de la empresa pública o privatización?- ofrece un análisis de las alternativas que se plantearon en España -y en otros muchos países- en los años 90, con las dudas e indefiniciones que imperaron en aquellos momentos. Las privatizaciones venían a poner en tela de juicio uno de los signos de identidad del socialismo, imperante en muchos países de Europa, entre ellos España. Los gobiernos socialdemócratas de toda estirpe tuvieron ante ellas una actitud vergonzante. Finalmente, la tercera parte contiene una exposición sintética y clarificadora de los dos modelos de gestión privada de servicios públicos: 1) el modelo de regulación tradicional, bajo un sistema cerrado de titularidad pública, monopólico, de planificación vinculante, explotación centralizada y remuneración en base a costes; y 2) un modelo de regulación para la competencia, abierto, sin derechos de exclusiva, con planificación empresarial y explotación descentralizada, en base a precios. El paso de uno al otro ha supuesto una verdadera revolución en la gestión de estas actividades y es todavía un proceso in fieri. El autor es, quizás, la primera pluma en lengua española en el campo del derecho público económico. Sus estudios en materia de agua, energía, obras públicas o telecomunicaciones plasmados en numerosos trabajos anteriores son bien conocidos en España e Iberoamérica. Este es un libro de madurez, escrito -o mejor reescrito- después de más de 30 años de observación y análisis de la vida política y económica en España y otros países. Los profesionales del derecho y la economía, políticos y administradores, jueces y estudiosos del Estado, empresarios y asesores encontrarán en él un análisis vivo, penetrante y en algún punto agresivo -¿por qué no?- de una de las realidades más polémicas de la vida política en los últimos años -la gestión empresarial pública- que hoy parece querer volver.

As the world looks for an exit from this economic crisis – the worst in eight decades – the focus of attention is naturally on the causes, the factors that account for its wide reach and severity, as well as on strategies that might bring it to a closure. The quest for exit strategies is at the very centre of the issues and concerns explored in the present volume, produced by the IIAS. Like the preceding volumes, but even more emphatically, this volume, representing a collective endeavour of scholars and practitioners from many parts of the globe, finds cause to lay the blame, for our difficult predicament, on the institutional deficit, the policies, the practices and values that have followed in the trail of a highly misleading and erroneous model of governance. The «Market Model of Governance» as it is known, sought to reform, the structures and culture of administration and government in private sector ways. While instrumental values like efficiency and effectiveness were raised and praised profusely, those of democratic governance were discounted by comparison. In particular, integrity, the rule of law and due process, equity, legality and public service professionalism suffered a steep decline, in several parts of the world. Likewise, the invasion and the capture of public space, inevitably led to an unprecedented surge of greed, abuse and corruption that contributed directly to the crisis which is upon us. Looking for exit strategies, as its title aptly suggests, the present volume offers a rich menu of ideas drawn from the current experience of all the world ́s main regions. Not surprisingly, two concepts stand out throughout the book as necessary correctives, as well as pressing remedies to the world ́s ongoing malaise. They call for the recapture of our common administrative space and the reaffirmation of the values and virtues appropriate for democratic governance. To the IIAS, none perhaps are more important than public service professionalism and none other can contribute more effectively to the reform and consolidation of sound institutions for national, sub national, global and regional governance. For these reasons, at this juncture, the new volume like the others should be featured in every public library and become a vademecum of all scholars and practitioners of public administration and politics around the world.
